Dear Deschutes County Planning,
ODFW understands that a hearing will be held on August 24, 2021, to discuss the remand from LUBA
in LUBA No. 2018-140 and the Court of Appeals A171603 (Deschutes County file numbers 247-21-
00731-A, 18-386-TP, 18-454-SP, and 18-542-MA). ODFW submitted a previous letter to the County
regarding TP Condition 17 dated September 6, 2019, which we are respectfully re-submitting here for
the record.
In the attached letter, we outline our understanding of next steps for Phase A-1 of the Thornburgh Resort
to move forward in a manner that results in no net loss of fish habitat quality and quantity. However,
any alteration to the agreed-upon mitigation (including a change in the source) must be evaluated and
approved by ODFW to ensure it continues to meet the no net loss standard. Therefore, TP Condition 17
is necessary to ensure the no net loss standard is maintained.
