Arnold - Letter re Public CommentFile Code : 247 -21.-000731--A RE: LUBA Remand on TP 17 Hello Will: August 30,2021- I am writing to provide testimony on what was discussed at the remand hearing for condition 17 in the tentative plan for phase A1 for Thornburgh Resort on August 24,2021. As testimony was given, it became very clear to me that the LUBA remand was based on the source of the mitigating water (i.e., Deep Canyon Creek). Attached is a letter (attachment 1) I submitted to File Code: 247-t9-0O061L-A on September 6,20L9. ln this letter I question changing the source. I discussed the fact that COID will no longer be a source of water and Big Falls Ranch has transferred Deep Canyon Creek surface water T-12651 (attachment 2) to their existing ground water wells. I have included an application G-19139 (attachment 3) and a Limited Lease Application LL-L879 (attachment 4) that were submitted by Pinnacle utilities this summer for additional water rights. Also attached are recorded document for additional sale of water right from a Mlchael Lebeau (attachment 5) and the Tree Farm (attachment 6) to Pinnacle Utilities. To me this change/addition of source should have required a new CMP and FMP. Another concern that was discussed is that there should be "No Net Loss". Given that the CMP and FMP were written over 15 years ago and the exploding population growth and the need for water in the Deschutes Basin and the ongoing extreme drought, one has to believe there already is a net loss. The flow out of Deep Canyon Creek will have lessened (which is happening to other springs in the Deschutes Basin) and the cold water to support local and migrating fish will have increased in temperature and is not providing a benefit for the fish. I would ask that Deschutes County request that the Oregon Department of Fish and Wildlife perform a site survey and check if there any negative impacts to fish and wildlife are occurring. I feel that using 2005 thru 2008 statistics should be updated to today's norms for the creek. I question that there is 5.5 CFS of water flowing from the Deep Canyon spring today as was stated in cancelled OWRD Certificate's 88027 (attachment 7) and 7637I (attachment 8) and the reason for the transfer to ground water was to maintain a steady flow for irrigation from the ground water wells. For the new applications to OWRD a ground water review was done. The finding stated that "Department has found that there is a preponderance of evidence that the proposed use of groundwater will measurably reduce the surface water flows necessary to maintain the free-flowing character of the Deschutes Scenic Waterway in quantities necessary for recreation, fish and wildlife". The original application G-16385 and Permit G-17035 never had a ground water study done and should require one today. This will show there is a net loss to the Deschutes River. Lis Fancher stated during the meeting that when the water is needed for Thornburgh Resort, Big Falls Ranch will transfer the original water back to Deep Canyon Creek. According to the transfer final order Big Falls Ranch has five years to transfer the water rights back to Deep Canyon Creek. There is only 2 years to make the transfer. It is clear to me that just the water from Deep Canyon Creek does not meet the needs of Thornburgh Resort when the development is completed. Other sources are required to meetthe water needs of the Resort, those sources need to be included in a new CMP and FMP. Thanks for letting me express my views. D idA nold File Code: 247 -L9-OOO611-A September 6,2OLg RE: LUBA and TP 17 Hello Jacob: I am writing to express my concerns with Central Land and Cattle Company's, tentative plan approval of condition L7 for part of phase A referred to A1 of the Thornburg Resort Development as set forth in the LUBA's remand of the decision. My first concern is that Central Land and Cattle (CLC) has indicated in condition 17 that they are working with Central Oregon lrrigation District to mitigate water rights for Pinnacle Utility's. ln talking with Leslie Clark, Director of Water Rights for COID, I have found that no such Plan has ever been prepared or signed. ln December of 2005 the Thornburgh Utility Group LLC did approach COID to mitigate water rights and a Development lrrigation Plan (DlP) was drawn up and signed. Completion date on that agreement was 201L. Because it was never completed and the 2011 date has passed this agreement is no longer valid. lt is my feeling that Pinnacle Utility's has been using and old agreement that is no longer valid and this makes the Final Plan (FP) and the Tentative Plan (TP) invalid and both plans should be found in non compliance and be resubmitted. Attached is the correspondence with Leslie Clark and a copy of the 2005 agreement with COID. My second concern is in the agreement with Big Falls Ranch to mitigate and unknow amount of water rights to Pinnacle Utility's. On April 2t,2017 Big Falls Ranch submitted and Application for Permanent Water Rights Transfer to the Oregon Water Resources Department (OWRD) to move 684-acre feet of water rights from surface water to ground water (Application Attached). On November 20,2OLB OWRD approved the transfer. Attached is the Final Order Approving a Change from Surface Water Point of Diversion to A Groundwater Points of Appropriation. Big Falls Ranch is moving surface water to 4 of their existing wells. lf this is water destined to be mitigated for Pinnacle Utility's why was this water not sent to the ground water mitigation bank? Because of the way Big Falls Ranch and Pinnacle Utilities are operating I feel they are in violation of their Application G-16385 and Permit G-L7036 to appropriate public waters under the section that deals with Ground Water Mitigation Conditions. Document is dated April 3,2Ot3 (document is attached). Because the water rights are not assigned to Pinnacle , and are still under Big Falls Ranch, should Big Falls be working with ODFW for water quality? My last concern is for the existing domestic wells that are in the proposed Thornburgh Resort. A well report Query with OWRD has found that there are 5 existing domestic wells (Document attached). Will these wells be used in the development of the resort? lf so, will they need to be predesignated as Municipal. Can an order be issued that on development of the Pinnacle water system these wells are capped and not used. Thanks for letting me express my views. No comments were filed in response to the notice. 3. On April 11, 2018, the Department,contacted the applicant and agent regarding a deficiency in the application. The application lacks a completed Land-use form. 4. On July 6,2018, the applicant's agent submitted a completed Land Use Form that shows that the land use served by the water use from the proposed groundwater points of appropriation is allowed outright. This final order is sribject to judicial rcview by the Court of Appeals under ORS 183.482. Any petition for judicial review must be frrled within the 60-day time period specified by ORS 183.482(l). The right to the use of the water is restricted to beneficial use at the place of use described, and is subject to all other conditions and limitations contained in Certificates 87655,880n, 7637I and any related decree. 3. If, within five years after approval of the traqsfer, the Department finds that the transfer results in substantial or undue intederence with an existing ground water right due to use of the wells, that would not have occurred in the absence of the transfer, the new point of appropriation shall be subordinate to the existing right injured by the transfer. 7 . The original point of diversion of surface water shall not be retained as an additional or supplemdntal point of diversion under the transferred portion of the right. However, if within five years after approval of the transfer, the Department receives a transfer application to' retum to the last authorized surface water point of diversion, the application shall be approved. 8. Water use measurement conditions: ii. Before water use may begin under this order, the water user shall install a totalizing flow meter, or, with prior approval of the Director, another suitablp measuring device, at each proposed well. b. The water user shall maintain the meters or measuring devices in good working order. c. The water.user shall allow the Watermaster access to the meters or measuring devices; provided however, where the meters or measuring devices are located within a private structure, the Watermaster shall request access upon reasonable notice. 9. Full beneficial use of the water shall be made, consistent with fhe terms of this order, on or before October 1,202,0. A Claim of Beneficial Use prepared by a Certified Water Right Examiner shall be submitted by the applicant to the Department within one year after the deadline for completion of the change and full beneficial use of the water.
