On behalf of Central Oregon LandWatch, thank you for the opportunity
to comment on the above applications concerning tax lots TL 7800 and TL
7900 in the North Half of the Southeast Quarter (N1/2 SEI/4) of Section 29,
Township 15 South, Range 12 East, Willamette Meridian, Deschutes County,
Oregon. LandWatch respectfully urges the Hearings Officer to deny both
applications.
The County's exclusive farm use (EFU) zone is designed to preserve the
limited amount of agricultural land in the county to the maximum extent
possible. The agricultural land use policy of the state of Oregon is that the
preservation of agricultural land in large blocks is necessary in maintaining the
agricultural economy of the state, and for the assurance of adequate, healthful
and nutritious food for the people of this state and the nation. ORS 215.243(2).
To prevent fragmentation of its agricultural land base Deschutes County
strictly limits development in the EFU zone to parcels created either in

accordance with the County's subdivision or partition laws, or prior to the
adoption of those laws. DCC 22.04.040(B)(1)(a);1 DCC 18.04.030:
"Lot of Record means:
A. A lot or parcel at least 5,000 square feet in area and at least 50 feet
wide, which conformed to all zoning and subdivision or partition
requirements, if any, in effect on the date the lot or parcel was created,
and which was created by any of the following means:
1. By partitioning land as defined in ORS 92;
2. By a subdivision plat, as defined in ORS 92, filed with the
Deschutes County Surveyor and recorded with the Deschutes
County Clerk;
3. By deed or contract, dated and signed by the parties to the
transaction, containing a separate legal description of the lot or
parcel, and recorded in Deschutes County if recording of the
instrument was required on the date of the conveyance."
Creation of parcels by deed has been prohibited in Deschutes County
since 1977. See DCC 17.04.02; ORS 92.012.2 TL 7800 and TL 7900 were not
created in conformance with all zoning and subdivision or partition
requirements, but were created by deed on August 31, 2021, as explained
below. TL 7800 and TL 7900 are neither lots of record nor eligible for an
exception to the requirement that they must be lots of record. DCC
1 DCC 22.04.040(B)(1)(a): Permits Requiring Verification; "Unless an exception applies pursuant to
subsection (B)(2) below, verifying a lot or parcel pursuant to subsection (C) shall be required prior to the
issuance of the following permits: a. Any land use permit for a unit of land in the Exclusive Farm Use
Zones...".
2 DCC 17.04.02: No person may subdivide or partition land within the County except in accordance
with ORS 92 and the provisions of DCC Title 17.
ORS 92.012: No land may be subdivided or partitioned except in accordance with ORS 92.010
(Definitions for ORS 92.010 to 92.192) to 92.192 (Property line adjustment).

22.04.040(B)(1). No land use decision may be made concerning them. DCC
22.20.15(A).3
The relevant time period for verification of lot of record status is the
present time interval, prior to the granting of final land use approval. DCC
22.04.040(B)(1)(a).
In granting approval of 247-21-000508-SP the County erroneously relied
on lot of record decisions LR-98-44 and LR-91-56 (Att. 1, 2), which were
issued for parcels that no longer exist. Staff has not kept up with the times: the
boundaries of TL 7800 and TL 7900 have changed twice since parcels with
those names were verified as lots of record in LR-98-44 and LR-91-56.
The parcels verified as lots of record in LR-98-044 and LR-91-56 ceased
to exist on July 30, 2021, when Central Land and Cattle Company, LLC deeded
0.5 acres out of TL 7800 and TL 7900 to Pinnacle Utilities, LLC. Att. 3 (deed
2021-44814); Att. 5 (map). On July 30, 2021, the joint area of TL7800 and TL
7900 was reduced in size by 0.5-acres. Id.
On August 31, 2021, the applicant reconveyed the 0.5 acres from
Pinnacle Utilities back to Central Land and Cattle. Att. 4 (deed 2021-50325).
As of that date TL 7800 and TL 7900 are new, new parcels.
Though the current parcel boundaries overlie the boundaries of the old
TL 7800 and TL 7900, Deschutes County law protects land in the EFU zone
from fragmentation in part by strictly regulating the time and manner in which

2. Make any other land use decision...

parcels were created. The reconveyance of the 0.5 acres back to Central Land
and Cattle does not validate the unlawfully created parcels. Validation of
unlawfully created units of land is governed by statute. ORS 92.176. The
statutory remedy to validate unlawfully created units of land is limited to units
of land unlawfully created before January 1, 2007, and does not apply:
"ORS 92.176(6): A county or city may not approve an application to
validate a unit of land under this section if the unit of land was
unlawfully created on or after January 1, 2007."
Moreover, prior determinations of lot of record status are not protected
by the doctrine of the law of the case, which is inapplicable here. As the
Supreme Court has explained the doctrine of the law of the case does not apply
where there has been a change in facts bearing on the legal issue in question.
State v. Langley, 331 OR. 430, 444 n. 9, 16 P.3d 489 (2000) (the doctrine of the
law of the case is inapplicable in light of new facts or evidence bearing on the
legal issue in question).
The facts bearing on whether TL 7800 and TL 7900 were created in
accordance with all applicable subdivision and partition regulations, and thus
whether they are lots of record, changed materially on July 30, 2021 and
changed again on August 31, 2021. Att. 3, 4.
The County was further in error in finding TL 7800 and TL 7900 are lots
of record because the entire resort property was determined to be a lot of record
in CU-05-20. Deschutes County code requires each element or development
phase of a destination resort to satisfy the relevant site plan or subdivision
criteria. DCC 113.040(C). Verification of the lot of record status of these EFU
parcels is independently required at this time.

The Hearings Officer lacks the authority to approve development
applications concerning TL 7800 and TL 7900. DCC 22.04.040(B)(1)(a); DCC
22.20.15(A) (no land use decision or approval of any application for land use
development may be issued to any property that is in violation of applicable
land use regulations).
For the above reasons, LandWatch respectfully recommends denial of
both applications.

Tax Lot 7800 was created by a Warranty Deed, dated March 14, 1952, recorded in Volume 124, Page 426 of the Deschutes County Book of Records. The parcel met all land use regulations, applicable at the time it was created. The current configuration of the parcel was established when a Minor Partition (MP-79-159) split off Tax Lot 7801.
The property is zoned EFU-40, Exclusive Farm Use -40 acre minimum lot size. Development of the property is subject to the requirements of the Deschutes County Zoning Ordinance PL-15, as well as those of the Building and Environmental Health Divisions.
