HomeMy WebLinkAbout2022-04-11 Supplemental Burden of ProofAPPLICATION NARRATIVE SUPPLEMENT Submitted To: City of Bend Deschutes County For: Bend Urban Growth Boundary Expansion and RM Bend Comprehensive Plan Designation Deschutes County Comprehensive Plan Map Amendment (changing the Bend UGB location and changing the Comprehensive Plan Designation from Rural Residential Exception to Urban Growth Boundary) and Zone Change from MUA10 to UA HB 4079 – City of Bend Affordable Housing Pilot Program April 2022 Page 2 of 61 Hayden Homes – HB 4079 UGB Expansion Subsequent to the planning submittals to Deschutes County and the City of Bend, City of Bend Planning Staff indicated that the right-of-way abutting the subject property needs to be included in the reviews and decisions. To accommodate the City of Bend request/requirement, the applicant is providing a survey and legal description of the property and the abutting right-of-way to be included in the UGB Expansion. When including the abutting rights-of-way, the area of the UGB Expansion is 39.55 acres. All references to the size of the UGB expansion in the submittal materials should be revised to 39.55 acres (including the 35.32 property, in addition to abutting rights-of- way). Other than the revised acreage, the noted revision is not substantive and does not change the findings. NEED RESPONSE   Greg,   I apologize I did not catch this before we deemed the application complete, but the City will need the UGB Expansion (and subsequent annexation) to include the right-of-way of Bear Creek Road (outlined in dark blue below). The UGB Expansion submittal will need to be revised by approximately 2.45 acres with an accompanying legal description to include the Bear Creek Road right-of-way.
