Staff Report Overview of Application •Amending Deschutes County Comprehensive Plan, Zoning Designations, and the Bend UGB to accommodate an Affordable Housing Pilot Project •The Deschutes County portions of the proposal will be reviewed during the public hearing concurrently with a simultaneous review of an application under City of Bend development codes •Specifically, the secondary application concerns the expansion of the City of Bend UGB and the specific development of the subject property for the affordable housing project Overview of Application •Proposal developed specifically in response to the State of Oregon’s requests for affordable housing pilot projects for two selected cities •Applied on basis of House Bill (HB) 4079 (2016) •HB 4079 is administered by Oregon Administrative Rule (OAR) 660-039 Overview of Application •HB 4079 requires 30% minimum of future housing units to be affordable housing •Affordable housing = Households are making 80% or less than Area Median Income AND not spending more than 30% on rent/mortgage. Overview of Application •35.32 acre Multiple Use Agricultural (MUA10) property •The total proposed UGB expansion including abutting right-of-ways is 39.55 acres •City of Bend will annex, partition, master plan, and entitle the property in subsequent phases Subject Property Affordable Housing Pilot Project •OAR 660-039-0000, Purpose •Encourages local governments to provide an adequate supply of land within urban growth boundaries that is dedicated to affordable housing; •Encourages the development of affordable housing on land dedicated to affordable housing; •Protects land dedicated to affordable housing from conversion to other uses before or after the development of affordable housing; •Enhances public understanding of the relationship of land supply to the development of affordable and needed housing; and •Enhances public understanding of how cities can increase the amount of affordable and needed housing. Affordable Housing Pilot Project •OAR 660-039-0030, Compliance with Goals, Statutes, Administrative Rules •A qualifying city submitting a pilot project nomination is exempt from compliance, and the reviewing body is not required to select a pilot project that complies, with: •ORS 197A.320 (Priority of land to be included within a UGB) •The Land Need or Boundary Location provisions of Goal 14 •Goals 3, 4, 6, 8, 9, 10, 12, 13 •Any administrative rules implementing, clarifying, or interpreting these goals Criteria for Approval •OAR 660-039-0030(1) specifies which Statewide Planning Goals apply (1, 2, 5, 7, and possibly 11) •Findings address and satisfy applicable Statewide Planning Goals, policies of the Deschutes County Comprehensive Plan, and criteria of the Deschutes County Zoning Code •OAR 660-039-0090: •Requires the City of Bend to ensure a portion of the property (at least 30% of units) will develop as a pilot project for affordable housing Public Comments •One written comment has been received by staff from members of the public •Habitat for Humanity submitted comments in support of the proposal, citing affordable housing needs in the region Next steps in process Hearings Officer opens public hearing to hear applicant’s presentation and accept public testimony then can: •Continue hearing to date certain •Close public hearing and establish open record period for additional written evidence or testimony, rebuttal and final argument •Close oral and written record Questions?
