Ordinance 84- Chairman Young noted that the ordinance contains no
015, Cluster emergency clause, so the first reading and hearing

hearing in two weeks.
Lin Bernhardt, Planner, gave the staff report. The
Planning Commission did approve the Cascade Meadows
cluster development but came back and asked the staff
to revise the ordinance by tightening the conditions
of approval. The ordinance establishes an impact area
which surrounds the area of cluster development. Any
time development occurs impact is created in more area
than just where it occurs. The ordinance also
encourages true clustering rather than leaving things
spread out. Ms. Bernhardt showed the Board some
drawings of Cascade Meadows illustrating the impact
area concept and clustering. She stated that this
type of spread apart development was not really the
intent of the plan for cluster development. The
development ratio will remain at 35/65 (with 65% given
to open space) but the percentage of impact area (the
area surrounding roads and houses) will have
limitation requirements. She noted that the Planning
Commission had wanted to limit the development ratio
to 20/80, but it was felt that it would be too
restrictive in addition to the impact area standard.
They also do not want to encourage development in a
resource zone (in productive forest land) so they have
limited development to the F-3 zone, which is
marginally productive. The ordinance requires that
the development occur only on the most unproductive
part of the parcel. The major changes are: (1)
further restrictions on the open space development
standard, to include the impact area concept, and (2)
further definition of what occurs in the open space;
and (3) requires that lots be contiguous.
MOTION: PRANTE moved to have the first reading by
title only.

Warranty Deed Rick Isham, Legal Counsel, stated that they are
for Bauhofer & getting close to closing on this exchange of the old
Donnell Post Office Building for the old Bend Memorial Clinic
building.
MOTION: PRANTE moved to sign the Warranty Deed to
Donald Bauhofer and Thomas Donnell.
TUTTLE: Second.
VOTE: UNANIMOUS APPROVAL.
Order 84-184, Chairman Young read this order aloud.
Appropriations MOTION: TUTTLE moved to adopt Order 84-184.
Transfers PRANTE: Second.
VOTE: UNANIMOUS APPROVAL.
