ORDINANCE NO. 84-027
WHEREAS, ORS 476.380 prohibits any person from causing,,
permitting, or maintaining on his property, or the property of
another, any open burning of commercial waste, demolition
material, domestic waste, industrial waste, land clearing debris,
or field burning without first securing a permit from the Board
of County Commissioneers; and
WHEREAS, for certain periods of the year a high fire danger
exists; and
WHEREAS, it is in the public interest to prohibit open
burning during that period of time; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. That Section 1 of Ordinance No. 84-009 is
amended to read as follows:
"Section 1. That no person, outside the bound-
aries of a rural fire protection district or a forest
protection district, shall cause or permit to be ini-
tiated or maintained on his own property, or cause to
be initiated or maintained on the propety of another
any open burning of commercial waste, demolition mater-
ial, domestic waste, industrial waste, land clearing
debris, or field burning from July 1 through November 1
of each year unless weather conditions permit earlier
resumption of burning, as determined by the Deschutes
County Fire Defense Board."
Section 2. That Section 2 of Ordinance No. 84-009 is
amended to read as follows:

"Section 2. Notwithstanding Section 1, burning
permits may be issued by the Deschutes County Commis-
sioners, or their designees, if all three of the
following conditions are met:
A. Evidence is presented that the material
must be disposed of prior to November 1, and that no
satisfactory alternative to burning is available.
B. Appropriate fire control measures are
provided by the permitee as specified by the burning
permit to prevent unwanted spread of the fire.
C. The appropriate permit is obtained from
the State of Oregon, Department of Environmental
Quality, if under their jurisdiction."
Section 3. That Section 3 of Ordinance No. 84-009 is
amended to read as follows:
"Section 3. Violation of this Ordinance is a
Class A infraction."
Section 4. This Ordinance being necessary for the immediate
preservation of public peace, health and safety, an emergency is
declared to exist, and this Ordinance takes effect on its
passage.
