ORDER NO. 84-289 62 81 WHEREAS, the Board of County Commissioners of Deschutes County, Oregon, received verified petitions of more than twenty per cent (20%) of the electors registered in the area proposed to be incorporated as the City of LaPine; and WHEREAS, the hearing on the proposed incorporation of the City of LaPine was duly noticed in accordance with law; and WHEREAS, a hearing was held on Wednesday, August 8, 1984, at 10:00 a.m. in the Deschutes County Courhouse Annex, Bend, Oregon, on the proposal to incorporate an area of Deschutes County as the City of LaPine; and WHEREAS, said hearing was continued until October 10, 1984; and WHEREAS, said hearing was again continued until November 7, 1984; and WHEREAS, it appearing that the Board of County Commissioners should alter the boundary as set forth in the petition to exclude land which may not be benefited by the proposed incorporation; and WHEREAS, it is necessary to refer the question of incorpor- ation of the proposed City of LaPine to the electors within the area proposed for incorporation; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the description of the exterior boundaries of the proposed City of LaPine, as determined by the Board of County Commissioners, is set forth in Exhibit "A", attached hereto and by this reference incorporated herein, and further depicted on the map marked Exhibit "B", attached hereto and by this reference incorporated herein. Section 3. That the findings and conclusions in support of the proposed incorporation of the City of LaPine, marked Exhibit "C", attached hereto and by this reference incorporated herein, are hereby approved. Section 4. That an election on the proposition for incor- poration shall be held within the boundaries of the proposed City of LaPine described in Section 1 hereof, on Tuesday, March 26, 1985, between the hours of 8:00 a.m. and 8:00 p.m. That the County Clerk shall include on the ballot for the election the description of the boundaries of the proposed City of LaPine using streets and other generally recognized features, and a statement of the rate of taxation expressed in dollars per thousand dollars of assessed value estimated to be sufficient to support an adequate level of municipal services in the amount of $3.65 per thousand dollars. That the notice of election shall be in substantially the form marked Exhibit "D", attached hereto and by this reference incorporated herein. That the Board of County Commissioners issue notice of election of the first City Council of the proposed City of LaPine as is set forth in Exhibit "E" attached hereto and by this reference incorporated herein. Section 5. If the majority of votes cast in the election favor the incorporation of the City of LaPine, all expenses of election and preparation of the metes and bounds or legal description as finally approved shall be paid from the general fund of the newly incorporated City in the same manner that other claims against the City are paid. FINDINGS 1. County. Deschutes County is the only county involved in the proposed incorporation. Prior to circulation, a petition was filed with the County Clerk of Deschutes County. 2. Petition. The County Elections Clerk dated and time -stamped the petition and authorized its circulation. One copy of the petition was retained by the Elections office and two others forwarded to the County Court. 3. Petitioners. Mary F. Gordon of 16480 Foss Road, LaPine, Oregon, Kristi R. Otteni, 51468 Bonnie Way, LaPine, Oregon, and Richard Stradther, 16460 Findley Butte Road, LaPine, Oregon, were designated as chief petitioners and are electors within the proposed boundary. 4. Tax Rate. The petition included a rate of $3.65 per thousand on an estimated assessed valuation of $11 million to provide essential services. 5. Incorporation Area. The petition included a proposed map outlining the area to be incorporated. The area being considered is smaller than that designated in the proposal, and includes no property not in the original proposal. 6. Number of Residents. More than 150 persons reside in the area. 7. Verified Signatures. Each sheet of the petition turned in to the County Clerk contained not more than 20 signatures and was verified on its face with the total number of verified signatures submitted, exceeding 20% of the registered voters in the proposed area of incorporation. 1 - FINDINGS OF FACT VOL 62 FADE SS 8. Hearings. The hearings on incorporation which were scheduled for August 8, 1984, with a continuation to October 10 and November 7 were duly published and posted as provided by law. 9. Location: The area proposed to be incorporated is generally located in southern Deschutes County. The land is situated in a portion of Sections 10, 11, 14 and 15 of Township 22 South, Range 10 East, Willamette Meridian. The description for the boundary is marked Exhibit "A", attached hereto and by this reference incorporated herein, and is further depicted on the map marked Exhibit "B", attached hereto and by this reference incorporated herein. 10. Comprehensive Plan Designation: The approved Deschutes County Comprehensive Plan designates the area as a rural service center. 11. Zoning: The proposed incorporation area is zoned RSR -M, Rural Service Residential - M; RSC, Rural Service Center; R -I, Rural Industrial; RR -10, Rural Residential. 12. Site Description: The proposed incorporation area is generally level, and there are trees throughout. The existing land uses are a mix of commercial, industrial, residential and governmental. 13. Background Information: The estimated population of the proposed city is 185 people. The area has an assessed valuation of approximately $11 million and comprises approxi- mately 397.94 acres. The majority of the area's assessed valu- ation comes from the business corridor located on both sides of Highway 97. The area proposed for incorporation is bounded on the North by Bureau of Land Management forest land; on the West by a marsh area with flooding potential within the 100 year flood plain. The South and East boundaries are larger parcels of land in either private or governmental ownership, including a sig- nificant parcel close to the proposed boundaries owned by the County and zoned and designated for industrial park purposes. 14. Commercial Area: There are 143 lots designated for commercial purposes. Approximately 60 of these lots are 2500 square feet. There are 65 lots ranging from .2 acres to 1.0 acre; and 13 lots which are 1 to 3 acres. Most of the commercial land is developed and, without additional services, cannot expand or increase in density. The area consists of approximately 62 buildings. 15. Ind�ustrry: There are twelve (12) industrial zoned parcels wit inn to proposed incorporated area. This accounts for 24.24 acres. One lot is .87 acres; four lots are 1.25 acres; one lot is 1.77 acres; one lot is 1.9 acres; three lots are 2.5 acres; and one lot is 5 acres. 2 - FINDINGS OF FACT VOL 16. Residential: In the scaled down area, there are 136.11 residential acres with 145 housing units which gives a residen- tial housing density of .93 dwellings per acre. County popula- tion figures show an average of 2.68 persons per household. 17. Maps: Maps showing the location's relative size and density of the residential, commercial and industrial uses, including the parcel sizes and ownership patterns, are attached to these Findings and incorporated by this reference. 18. Location of Urban Level Facilities and Services: a. Police Protection: There is located in LaPine a County Sheriff substation with regular manning. There are no plans at this time for a change in either location or the level of service being provided to the area. b. Fire Protection: Fire protection is provided by the LaPine Rural Fire Protection District. The fire district's main station is located within the core area and has a response time of three to five minutes. Equipment within the proposed city limits is as follows: (1) Truck - 1000 gal. per minute, 1000 gal. total water. (2) Truck - 750 gal. per minute, 1000 gal. total water. (3) Truck - 750 gal. per minute, 3500 gal. total water. (4) Tractor trailer - 500 gal. per minute, 4000 gal. total water. (5) Tractor trailer - 500 gal. per minute, 2500 gal. total water. (6) 1-1/2 ton truck - 250 gal. per minute, 1000 gal. total water. In the event of a major fire, Stations 2 and 3 are also available to answer alarms within the proposed incorporation area. Station 2 has the following: (1) Truck - 1000 gal. per minute, 1000 gal. total water. (2) Truck - 500 gal. per minute, 750 gal. total water. (3) Truck - 250 gal. per minute, 3000 gal. total water. 3 - FINDINGS OF FACT c VOL 62 ebCj 99 Station 3 has the following: (1) Truck - 1000 gal. per minute, 1000 gal. total water. (2) Truck - 250 gal. per minute, 1000 gal. total water. C. Water: There is existing community water within the proposed incorporationa rea. The high school has a deep well system and in one of the community trailer parks there is a community water system serving all of the homes in the park. The trailer park system is comprised of two wells with one well used extensively and the other well held in reserve. The well at the high school is capable fo providing a 1250 gallon per minute water supply. That represents an approximate daily gallonage availability of 1,800,000 gallons. A population base of 185 people would normally use approximately 55,000 gallons per day. While there are no formal agreements for public use of this facility, the availability of water is present and the potential does exist. d. Parks: At the present time, the park area in town is on BLM land operated with coordination through the County and controlled by the local Lions Club. The park area is available for use by people in the area. e. Sewage Treatment and Collection: By Oregon Administrative Rule Chapter 340, Division 41, §580 was added in order to protect the shallow acquifer located in the vicinity of the community of LaPine in Deschutes County. The report included the Environmental Quality Commission's support of the implementa- tion of the LaPine aquifer management plan adopted by the Deschutes County Board of Commissioners on September 28, 1982, which requires the following: Waste water generated within the core area of the community of LaPine shall be collected and treated and disposed of in a manner which prevents future pollution of the ground water by not later than January 1, 1987. An engineering plan and financing plan shall be completed and submitted to the department not later than January 1, 1985. The report further found that the aquifer drinking water stanard and the installation of sewer facilities will not immediately restore the quality to safe levels. Citi- zens of the LaPine core area need to develop a safe drinking water supply for the community as soon as possible. In a response directly to Goal 11, the regulation found the proposed rule would necessitate the construction of public sewers and sewage treatment facilities within the LaPine core area. This measure was consistent with public health and safety, both of LaPine area residents and other persons utilizing commercial facilities in the core area. 4 - FINDINGS OF FACT `VOL 62 PACE 91 In the study to the Environmental Quality Commission from its director,an evaluation of the LaPine core area found that it has urban densities on rapidly draining soils. In response to this report, a sanitary district was formed to begin evaluation of the sewage treatment and disposal problem. The entire area of the district is included within the boundaries of the proposal. Facilities are currently in the process of being engineered to comply with the deadlines and requirements of the adopted rule. 19. Deschutes County Comprehensive Plan: The Deschutes County Comprehensive Plan specifically discusses the LaPine area. It points out, under the "population" category, that the County expects a 4.5% increase in population with most of the growth around Redmond and Bend. The comprehensive plan anticipates slower growth elsewhere except in LaPine stating: "LaPine is an exceptional situation. Original apprais- als of 2% annual growth have been questioned and estimates as high as 12% to 15% have been suggested. Certainly the higher growth rate would help explain the growing problems the community has had with poor water quality, loss of forest and agricultural land and increasing strip development and lagging public facilities and sewers." The Plan indicates that the LaPine area was originally recre- ational housing, but is now changing more and more to permanent occupancies with an estimate that 70% of the housing is now in permanent occupancy. The plan further found that LaPine was an exception to rural development and indicates that in LaPine, emphasis is laid on the incorporation of the community and improvement of local services provided. On page 163 of the plan, in Exceptions to the Forest Land Goals, it was found that in the LaPine area, 13,083 acres are already resiential committted with most lots already below the 10 -acre minimum. On page 34, the Comprehensive Plan included a conclusion that LaPine is already designated as a rural service center. Pages 47 through 51 discuss the residents of the area as being a mixture of retirees and young families. The distance to Bend, which is compounded by winter driving conditions, also creates a certain amount of isolation from more populated areas and a demand for local commercial and public services. The high water tables and flood plains also create problems in planning the community's growth. In reviewing the problems in the LaPine area, the plan indicated that the community is on the verge of becoming an incorporated town and evolving into a useful service and local trade center. The plan concluded that acting now to properly guide the community's growth could solve existing problems and avoid future difficulties. The plan set up the following policies regarding core area development: 5 - FINDINGS OF FACT VOL 62 PAGp' 92 a. The LaPine core area shall be a community center for the area and the County would seek to improve the core area ownership pattern by cooperation with state and federal agencies including the exchange of County land for other public lands if necessary to facilitate a better ownership pattern for community development. b. The LaPine core area was to be encouraged to incorporate. C. The County Planning Department was to assist the community in reviewing the incorporation alternatives and in preparing a community plan. A resource center area for LaPine was developed pursuant to the plan. 20. Interpretation. Mr. Brent Lake, staff member from DLCD reported the division's interpretation of OAR 640-14-040(3) is that each of those areas must be addressed in a report, but there is not a requirement that public water and sewer facilities exist in order to make a determination that land is committed to urban levels. The requirement is that water and sewer are subjects which must be specifically addressed. Comments have also been received from 1000 Friends of Oregon. 1000 Friends of Oregon disagrees with the way the rules, OAR 660-14-030(1), (2), have been interpreted. They state that water and sewer services are one of the prerequisites for incorporation. The County has chosen to follow the Department of Land Conservation and Develop- ment Commission staff's interpretation as mentioned in #12 above. 21. Objections. Five letters were received from residents and property owners opposed to the incorporation. CONCLUSIONS 1. Oregon Administrative Rules, Chapter 660, Division 14, requirements have been met and the rural land is irrevocably committed to urban levels of development. 2. The approved Deschutes County Year 2000 Comprehensive Plan addresses the issue of the LaPine area and the findings support an exception to Goal 11 and 14 pursuant to Oregon Administrative Rule 1660-14-030. 3. The exception area plan (Goals 3 and 4) of the acknowledged Comprehensive Plan for the LaPine area, recognizes the commitment of land to non -resource uses. 4. The Comprehensive Plan designation of rural service center further indicates an urban level of development for the area. 6 - FINDINGS OF FACT VOL 62 PACE 93 5. The size and extent of commercial and industrial uses shows that urban levels of development already exist within the zoned rural service center area. 6. A residential density of .93 dwellings per acre also indicates urban levels of development. 7.
