ORDER NO. 85-002 WHEREAS, the Board of County Commissioners, by Resolution, initiated the improvement of certain dedicated public roads known as portion of Old Wagon Road in Sage Meadow Subdivision and all of Squawback Lane East, all of Squawback Lane West, all of Paddock Green, all of Tumble Weed Turn, that portion of Squaw Back Road and that portion of Old Wagon Road in Squaw Back Woods Addition to Indian Ford Ranch Homes in Deschutes County, Oregon; and WHEREAS, the County Engineer investigated the improvement, and estimated the cost of the improvement, and a cost estimate of this improvement has been prepared in accordance with ORS 371.625; and WHEREAS, it is necessary that notice, pursuant to ORS 371.60, be mailed to each benefited property owner; and WHEREAS, it is necessary that a hearing be held for the purpose of hearing remonstrances to said improvement; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the Engineer's Report relating to the improvement of certain dedicated public roads known as portion of Old Wagon Road in Sage Meadow Subdivision and all of Squawback Lane East, all of Squawback Lane West, all of Paddock Green, all of Tumble Weed Turn, that portion of Squaw Back Road and that portion of Old Wagon Road in Squaw Back Woods Addition to Indian Ford Ranch Homes, in Deschutes County, Oregon; be accepted and hereby approved. Section 2. That a hearing be set on February 27, 1985, at 10:00 a.m. at the Deschutes County Courthouse Annex, Bend, Oregon, for the purpose of hearing remonstrances to said improvements. Section 3. The County Engineer has made a favorable report to the Board of County Commissioners regarding the proposed improvement. Upon completion of the proposed improvement, the roads will be accepted into the County Road System, and will be maintained by Deschutes County. The total estimated cost of the proposed improvement and the proposed total amount of the assessment against your land is as shown above. If you object to the proposed improvement and assessments shown in the Engineer's Report, you are required to file written objection, if any, with the Board of County Commissioners, c/o Deschutes County Department of Public Works, 61150 S.E. 27th Street, Bend, Oregon 97702, within 20 days of the date of this notice, or at the public hearing on the proposed improvement before the Board of County Commissioners, which will be held on February 27, 1985 at 10:00 a.m. in the Deschutes County Courthouse Annex, Bend, Oregon, in order to stop this improvement. If more than 50% of the owners of land representing more than 50% of the total amount of the assessment for the proposed improvement file objections, the proposed improvement will be declared abandoned and no new resolution shall be filed within a period of one year. If the required number of objections are not received, the improvement will proceed and you will be notified of the actual assessment when it is determined by the Engineer. This assessment, as finally approved by the Board of County Commissioners, will be entered into the lien docket of Deschutes County and will be released when the assessment is paid in full. HUDSON, Director of Public Works, On Behalf of the Board of County Commissioners M E M O R A N D U M TO: BOARD OF COUNTY COMMISSIONERS FROM: DAVE HOERNING, COUNTY ENGINEER DATE: JANUARY 17, 1985 SUBJECT: ENGINEER'S REPORT FOR SQUAW BACK WOODS LOCAL IMPROVEMENT DISTRICT VOt 62 FADE 502 Deschutes County received a request to improve certain roads within Squaw Back Woods Addition to Indian Ford Ranch. Due to this request the Deschutes County Board of Commissioners initiated a Local Improvement District by Resolution 85-004. The Resolution was referred to the Deschutes County Public Works Department for an engineering investigation of the proposed improvements in accordance with ORS 371.625. The engineer's investigation of the Squaw Back Woods Local Improvement District found the following: 1. In the Engineer's judgement, improving the roads to Deschutes County Road Standards for a Rural Local Road is feasible. 2. For these roads to meet County Road Standards the following work must be completed: a. Mobilization - normal mobilization costs incurred in preparation of the work. } b. Traffic Control - signs and flaggers will be provided to warn, safeguard, protect, guide and inform the public and 5 workers. c. Subgrrade - a minimal amount of earthwork will be required to construct subgrade. There will be some construction a required to provide proper drainage. d. HSC - placing, shaping, compacting and fine grading of base will be required. A six (6) inch depth of compacted cinder base will be utilized. The finished width shall be thirty-two (32) feet measured between the edge of shoulders. e. Paying - the paving will be an Asphalt Penetration Macadam (0-9 oil mat). The pavement will be twenty four (24) feet in width. VOL 62 %-E503 f. Engineering and Administration County expenses in �. preparation of plans and specifications, inspection, surveying, accounting and payment collection and other incidental costs. 3. The estimated cost for improving the roads as outline above, is: a. Mobilization $ 5,000.00 b. Traffic Control 1,000.00 C. Subgrade 27,000.00 d. Base 47,000.00 e. Paving 97,000.00 f. Engineering & Administration 27.000.00 $204,000.00 4. The two homeowners associations and the County Engineer have created a two level assessment based on the amount of road within the boundaries of each association. under this system the homeowners in Sage Meadows would pay equal assessments on $19,000 ($19,000/14 lots = $1,330 per lot) and the remaining owners would pay equal assessments on the remaining portion $185,000 (185,000/61 lots = $3,040 per lot). 5.
