ORDER NO. 85-040
WHEREAS, on January 16, 1985, the Board of County Commis-
sioners of Deschutes County, Oregon, initiated by Resolution the
improvement of certain dedicated public roads known as a portion
of 16th Street, north of "F" Street, and "H" Street in Hillman
Subdivision, in Deschutes County, Oregon; and
WHEREAS, the Resolution was referred to the County Engineer,
who investigated the improvement and estimated the cost of the
improvement, and a cost estimate of this improvement has been
prepared in accordance with ORS 371.625; and
WHEREAS, notice pursuant to ORS 371.630 has been mailed to
each benefited property owner; and
WHEREAS, a hearing on the proposed improvement was held on
April 3, 1985, at 9:00 a.m. at the Deschutes County Courthouse
Annex, Bend, Oregon, for the purpose of hearing remonstrances on
said improvements; and
WHEREAS, three (3) objections were filed with the Board of
County Commissioners regarding said road improvements, repre
senting less than 50% of the owners of land and less than 50% of
the total amount of the assessment for the proposed improvement;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. To improve certain dedicated public roads known
as 16th Street, north of "F" Street and "H" Street in Hillman
Subdivision to Deschutes County Rural Local Road Standards for
the benefit of the area described in Exhibit "A", attached hereto
and by this reference incorporated herein.

Section 2. That the dedicated roads to be improved within
the District described in Section 1 of this Order are to be im-
proved by contract and are described in Exhibit "B", attached
hereto and by this reference incorporated herein.
Section 3. This Order is notice that the land described in
Section 1 is subject to a lien of an assessment for the costs of
the improvement, in an amount to be determined later by an Order
of the County Court. Estimates of the liens of assessment
against each parcel are set forth in Exhibit "C", attached hereto
and by this reference incorporated herein.
Section 4. The County Clerk shall endorse upon the Order
the date of the filing thereof, and shall record and index the
same in a Lien Docket in the office of the County Clerk.

that portion of vacated 17th Street lying between the northerly
right-of-way line of "G" Street and the southerly right-of-way line of
"H" Street; and that portion of vacated 17th Street lying northerly of
the northerly right-of-way line of "H" Street as platted in the Map of
Hillman as filed in the Office of the County Clerk, Deschutes County,
Oregon.
ALSO: The north one-half of the northeast one-quarter of Section 16,
Township 14 South, Range 13 East of the Willamette Meridian, Deschutes
County, Oregon. Excepting therefrom that portion lying within the
Dalles-California Highway and that portion lying within the Burlington
Northern Railroad.
