Commissioner Maudlin opened the meeting at 10:05 a.m. Co1111T<:

Commissioner Maudlin stated that the Board is to consider a
complaint filed on the dog case against Mr. Thomas Gaines.
Commissioner Maudlin noted that Mr. Gaines was not in attendance;
therefore, requested testimony from the Animal Control Officer
involved in the incident.
Leslie Edgecomb, Animal Control Officer, stated that on the
evening of June 8, 1985, she received a call from the Sheriff's
Office indicating that Mr. Gaines was not at home and his dogs
were out. It appeared that Mrs. Susan Hemple was leading her
horses home and the dogs were stalking behind her. Mr. Hemple
placed the horses in her pasture and called the Sheriff's Office
at 10:00 p.m.to notify them that the dogs were in the pasture
with her horses.
Officer Edgecomb noted that she contacted Mrs. Hemple and
explained that she would be out in the morning to pick up the
dogs. However, she then reconsidered and went out and looked at
that time. Officer Edgecomb explained that there have been
problems between Mr. Gaines and the Hemples on prior occasions
involving the dogs and she felt that there might possibly be some
doubt as to the dogs actually being in the pasture. Officer
Edgecomb drove to Tumalo at 11:00 p.m. and parked behind the
irrigation district office. She then walked to the Tumalo
Veterinary Clinic where she could view the Gaines' residence and
Hemple's pasture. She heard a horse running and observed
"Grizz", the Gaines' Malamute chasing and stalking a young horse
in the Hemple's pasture. Officer Edgecomb stated that Grizz did
come to her when she called; however, she did not have a lead and
was unable to pick him up at the time. After waiting for 30
minutes at the Gaines' residence, she decided she would return in
the morning to pick the dog up.
Officer Edgecomb returned to the Gaines' residence at 9:45
a.m. on June 9, 1985 and was told by neighbors that the dog was
running. After traveling for approximately one hour she was
unable to locate the dogs. After receiving a call at 11:15
a.m. that the dog had returned to the residence, she picked up
the Malamute - Grizz.
Officer Edgecomb stated that the dog has been reported to the
Animal Control Office at least 15 times as a nuisance and

Mr. Gaines has been informed that if the dogs have been chasing
livestock, they will be destroyed. Mr. Gaines was cited in April
and his dogs are not licensed.
Commissioner Prante asked if Mr. Gaines has made any attempt
to keep the dogs restrained.
Officer Edgecomb stated that a week after she had cited
Mr. Gaines in April, his dogs were out running.
Commissioner Maudlin asked Officer Edgecomb if Mr. Gaines
requested a hearing.
Officer Edgecomb stated that Mr. Gaines had requested a hearing
after speaking to him last Friday, June 21, 1985, and he was
advised of the hearing date on Monday, June 24, 1985 by Officer
Delette.
Officer Edgecomb noted that Mrs. Hempel had been bitten in a
previous incident; however it was not noted which dog actually
bit her.
MOTION: PRANTE moved that the dog in question,
"Grizz" be disposed.
MAUDLIN: Second.
VOTE: UNANIMOUS APPROVAL.
Commissioner Maudlin adjourned the meeting at 10:15 a.m.
