THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. Order No. 85-121, an Order certifying the
assessments for road improvements on certain real property in
16th Street L.I.D., and Requiring Notices, is amended to read as
follows:
"Section 1. The assessments for road improvements
in 16th Street L.I.D. are hereby certified in accord-
ance with Exhibit "A", attached hereto and by this
reference incorporated herein. The assessment so
certified is listed as "actual cost" in Exhibit "A".
Section 2. That the rate of interest to be
charged on unpaid assessments for which financing
requests are filed with the Board of County Commis-
sioners, and for assessments for which financing
requests are not filed and remain unpaid more than
thirty 30) days from the date of assessment, shall be
nine per cent (9%) per annum.
Section 3. That the Director of Public Works
shall mail on or before October 17, 1985, notices of
the assessments as fixed by this Order to owners of the
said property with an application to finance the
improvements in not more than 20 semi-annual install-
ments. The notice of assessment shall substantially
comply with Exhibit "B", attached hereto and by this
reference incorporated herein. The application to
finance improvements shall substantially comply with
Exhibit "C", attached hereto and by this reference
incorporated herein.
Section 4. That the Order, excepting Sections 2,
3, 4 and 5, be published in a newspaper of general
circulation within Deschutes County on October 17 and
October 24, 1985, with the following heading:

NOTICE OF ASSESSMENT
The Board of County Commissioners of Deschutes County,
Oregon, at its regular meeting on October 9, 1985,
adopted Order No. 85-121, assessing the following
described property for road improvements. Said Order
was amended by Order No. 85-122 on Octoer 10, 1985.
Upon failure of owners to make application to pay the
assessments in installments by November 18, 1985, or
upon failure of the owner to pay the assessment in full
by November 18, 1985, interest will commence and run at
the rate of nine per cent (9%) per year, and the
property assessed will be subject to foreclosure."

Section 5. The County Clerk shall, upon the filing of this
Order, record and index it upon the lien docket'of Deschutes
County known as Assessment District Liens. ,

Amended Engineer's Report.fU Sixteenth Street LID
The Sixteenth Street LID is completed with the exception of one
driveway that needs to be adjusted, and two additional driveways
that provide access to fields need to be constructed as they were
not included on the original plans.
The two additional driveways required a price adjustment of $400.00.
However, during the contract, the cost of the cinders was reduced by
$700.00 for a net reduction in the contract of $300.00. Also,
liquidated damages of $1,820.00 for 28 late days was assessed to the
contractor.
The following is the final itemization of the assessment district:

The Board of County Commissioners of Deschutes County, Oregon, adopted
Order No. 85-121, certifying the above assessment on the above-described
property on October 9, 1985, for road improvements benefiting said
property. Said Order No. 85-121 was amended by Order No. 85-122.
Upon failure of the owner of the property assessed to make application to
pay the assessment in installments by November 18, 1985, interest will
commence to run on the assessment at a rate of nine per cent (9%) per year,
and the property assessed will be subject to foreclosure if the total
amount of the assessment remains unpaid.
If you wish to pay in installments, you must fill out the enclosed appli-
cation listing your name and address, township, range, section and tax lot
number, and the amount of the assessment. The relevant information is at
the top of this notice. You must then sign the application and mail it to
Director of Public Works, Deschutes County Public Works Department, 61150
S. E. 27th, Bend, Oregon 97702, not later than November 18, 1985. You will
be sent information regarding your payments from the Deschutes County
Treasurer.
If you wish to pay the full amount, you must do so on or before November
18, 1985. Payment is to be made to the Deschutes County Treasurer,
Deschutes County Courthouse, Bend, Oregon 97701

Pursuant to the provisions of the Act of the Legislature of Uhe ate
of Oregon, known as the "Bancroft Bonding Act", (ORS 223.205 to
223.300, as amended), applicant makes application to finance the
portion of the cost of the road improvement levied against applicant's
property and being part of the improvement of roads in unincorporated
Deschutes County, Oregon, as the same has been determined and assessed
by the Board of County Commissioners of Deschutes County, Oregon, and
Order No. 85-121, as amended by Order No. 85-122, and docketed upon the
Docket of Assessment District Liens of Deschutes County, Oregon.
The applicant and property owner of the property described below does
hereby waive all irregularities or defects, jurisdictional or other-
wise, in the proceedings to cause said improvement to be constructed or
made for which the assessment is levied, and in the apportionment and
assessment of the cost thereof, and acknowledges that applicant is
indebted and the property legally charged with the assessment.
Applicant agrees to pay the assessment in twenty (20) or fewer semi-
annual installments, together with interest at nine per cent (9%) per
annum on all unpaid assessments. The interest shall be paid semi-
annually in addition to and at the time each principal payment is made.
The installments shall be due and payable on the 1st day of April,
1986, the first day of October, 1986, and thereafter on the 1st day of
April and the 1st day of October in subsequent years.
