WHEREAS, ORS 459.165, ORS 459.200(6) and Ordinance No.
85-037 require that all persons providing solid waste collection
service shall provide their customers within the urban growth
boundaries of the Cities of Bend and Redmond with monthly on -
route collection of recyclable material; and
WHEREAS, ORS 459.200(8) provides that solid waste franchise
collection rates established by the County shall allow the fran-
chisees to recover additional costs of providing the opportunity
to recycle for their customers, as well as their costs for edu-
cation, promotion, and notification of the opportunity to re-
cycle; and
WHEREAS, the Board of County Commissioners, by Resolution
No. 86-001, adopted an additional landfill user fee of $.50 per
load to fund the County program of recycling education, promotion
and notification; and
WHEREAS, the Board of County Commissioners finds that an
increase of $.50 per month in the solid waste franchise collec-
tion rate for customers within the urban growth boundaries of the
Cities of Bend and Redmond is necessary and adequate to allow
collection franchisees to recover their costs of providing on -
route recycling to those customers, and, in conjunction with the
additional landfill user fee established in Resolution No.
86-001, will equitably distribute the costs of the County's re-
cycling program between collection franchise customers and solid
waste self -haulers; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. Ordinance No. 85-037 is amended to increase the
solid waste franchise collection rates by $.50 per customer per
month for all persons within the urban growth boundaries of the
Cities of Bend and Redmond who purchase service from a solid
waste collection franchisee.

Section 2. This ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this ordinance takes effect on February
1, 1986.
