WHEREAS, the Department of Public Works petitioned the Board of County
Commissioners of Deschutes County, Oregon, to vacate a portion of Farrell
Road and a portion of China Hat Road, located in Township 18 South, Range 12
East, Sections 17 and 20, Deschutes County, Oregon; and
WHEREAS, the Board of County Commissioners has determined it to be in
the public interest to consider such vacation; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That it is the intent of the Board of County Commissioners
of Deschutes County, Oregon, to vacate a portion of Farrell Road and a
portion of China Hat Road described in Exhibit "A ", attached hereto and by
this reference incorporated herein, because it appears the road is no longer
needed for public use, and will not be needed in the future.
Section 2. That the County Engineer shall file an Engineer's Report
with the Board of Commissioners, describing the ownership and uses of
property to be vacated, and whether the vacation would be in the public
interest, within fourteen (14) days of the date of this Resolution.

A portion of Parrell Road as established in October 7, 1964 lying
south of the North line of Section 20 of Township 18 South, Range
12 East of the Willamette Meridian and being more particularly
desribed as follows:
Commencing at the Northwest corner of said Section 20; thence
South 89° 18' 56" East 84.85 feet along the North line of Section
20 to the POINT OF BEGINNING; thence South 89° 18' 56" East
238.85 feet along the North line of Section 20 to a point on the
westerly right of way of the existing Parrell Road; thence South
41° 58' 55" West 6.97 feet along the right of way of the existing
Farrell Road; thence 260.38 feet along the arc of a 602.96 foot
radius curve to the right (long chord bears South 78° 22' 57"
West 258.36 feet); thence North 39° 14' 47" West 70.13 feet to a
point on the easterly right of way of China Hat Road as dedicated
to the public in the Dedication Deed recorded in Volume 83, Page
976 of the official records recorded in the office of County
Clerk, Deschutes County, Oregon; thence North 17° 57' 06" West
7.28 feet to a 5/8 inch diameter iron rod with a 2 inch diameter
aluminum cap which marks the right of way intersection of said
China Hat Road with U.S. Highway 97; thence North 27° 02' 54"
East 58.24 feet along the easterly right of way of U.S. Highway
97; thence South 89° 14' 47" East 46.22 feet; thence 18.11 feet
along the arc of a 542.96 foot radius curve to the left (long
chord bears North 89° 47' 53" East 18.11 feet) to the Point of

A portion of Parrell Road as established in October 7, 1964 lying
north of the south line of Section 17 of Township 18 South, Range
12 East of the Willamette Meridian and being more particularly
described as follows:
Commencing at the Southwest corner of said Section 17; thence
South 89° 18' 56" East 84.85 feet along the South line of Section
17 tc the POINT OF BEGINNING; thence 408.84 feet along the arc of
a 542.96 foot radius curve to the left (long chord bears North
67° 16' 17" East 399.25 feet); thence North 45° 42' 00" East
91.53 feet; thence 91.00 feet along the arc of a 1402.39 foot
radius curve to the left (long chord bears North 43° 50' 28" East
90.99 feet) to a 5/8" diameter iron rod with a 2 inch diameter
aluminum cap which marks a point of curvature on the westerly
right of way of the existing Parrell Road; thence South 41° 58'
55" West 385.64 feet along the westerly right of way of the
existing Parrell Road to a point on the South line of said
Section 17; thence North 89° 18' 56" West 238.85 feet along the
south line of Section 17 to the Point of Beginning.

Commencing at the Northwest corner of Section 20 of Township 18
South of Range 12 East of the Willamette Meridian; thence South
01° 00' 58" West 42.12 feet along the west line of said Section
20 to a point on the easterly right of way line of U.S. Highway
37; thence South 27° 02' 54" West 118.47 feet along the easterly
right of way of U.S. Highway 97 to the POINT OF BEGINNING; said
point being the intersection of the southerly right of way of the
existing China Hat Road with the easterly right of way of U.S.
Highway 97 and marked with a 5/8 inch diameter iron rod with a 2
