WHEREAS, the Deschutes County/City of Bend River Task Force recommended, through the "Deschutes County/City of Bend River Study", that a committee be created to serve as an ongoing forum for water resource issues related to the Deschutes River and its tributaries which were identified by the Task Force, and to make recommendations to Deschutes County and the City of Bend regard- ing how to accomplish the water resource goals and policies contained in the River Study; and WHEREAS, the Deschutes County Planning Commission and the Bend Urban Area Planning Commission, after reviewing the River Study and hearing public testimony, also have recommended to the Deschutes County Board of County Commissioners that such a com- mittee be created, that it be called the "Deschutes Basin Re- source Committee", and that it review and study state laws rela- ting to water resources and make recommendations to the planning commissions; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. There is hereby created the Deschutes Basin Resource Committee. (1) Purpose. The purpose of the Deschutes Basin Resource Committee is to recommend to the Deschutes County Board of County Commissioners and the Bend City Commission the means to accomplish the water resources goals and policies contained within the Deschutes County/City of Bend River Study, and to provide an ongoing forum for direction and policy for maintaining and enhancing the Deschutes River Basin. Because many of the River Study goals and policies are beyond the scope of City or County jurisdiction and require action by state agencies or the Legislature, 1 - ORDINANCE NO. 86-063 � VOL 72 RAW the committee's purpose also is to review and monitor state laws and to recommend to the Deschutes County Board of County Commissioners and the Bend City Commis- sion changes in such laws necessary to carry out the goals and policies contained in the River Study. (2) Authority. The Deschutes Basin Resource Committee is an advisory committee charged with making recommend- ations to the Deschutes County Board of County Commis- sioners and the Bend City Commission on how to imple- ment the water resources goals and policies of the River Study and other matters dealing with the Des- chutes River and its tributaries. (3) Committee Membership. The Deschutes Basin Resource Committee shall be made up of the following members, to be appointed jointly by the Deschutes County Board of County Commissioners and the Bend City Commission, and at least one member of which is from Jefferson County: A. Two representatives from the irrigation districts. B. One representative from the Oregon Department of Water Resources. C. One representative from the Oregon Department of Fish and Wildlife. D. One representative from nonconsumptive water resource users (e.g., recreators). E. One representative from a local conservation or environmental organization. F. One representative from the business community. G. Two representatives from the public at large. The County and City shall provide adequate staff and material support for the committee. (4) Responsibilities. In providing advice and recommenda- tions to the Deschutes County Board of County Commis- sioners and the Bend City Commission, the Deschutes Basin Resource Committee should: (a) Request assistance through Bonneville Power Admin- istration's (BPA's) technical assistance program for technical improvements in methods of irriga- tion and means of conservation of both water and energy, and request assistance from the Water Resources Department, Bureau of Reclamation, and 2 - ORDINANCE NO. 86-063 VOL 72 P.AcE 40S the Soil and Conservation Districts, to initiate an in-depth study and set priority of actions that should be taken to improve the irrigation dis- tricts' delivery system. (b) Review and study of state water laws. (c) Study and make recommendations consistent with the goals and policies of the comprehensive plans related to water resources. (d) Report to the Board of County Commissioners and the City Commission at least semi-annually. Section 2. The Board of County Commissioners adopts as its findings and conclusions supporting this Ordinance the Staff Report, dated May 21, 1986, relating to the Deschutes River Corridor. Section 3. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
