WHEREAS, the Board of County Commissioners of Deschutes
County finds that the establishment of a mediation program,
whereby mediation services will be provided to the Deschutes
County Circuit Court as part of the court's conciliation services
for resolution of domestic relations child custody and visitation
disputes, will be in the best interests of the citizens of
Deschutes County; and
WHEREAS, the Board of County Commissioners further finds
that under ORS 107.775, such mediation services can be provided
to the circuit court by qualified personnel of the Deschutes
County Mental Health Services; and
WHEREAS, the Board of County Commissioners further finds
that a fee of $75.00, to be paid at the time of filing each
domestic relations suit in circuit court, is necessary and appro-
priate to pay the expenses of Deschutes County Mental Health
Services in providing mediation services to the circuit court as
part of the court's conciliation services; and
WHEREAS, Deschutes County has entered into an intergovern-
mental agreement, attached hereto as Exhibit "A ", with the State
Court Administrator whereby the Deschutes County Mental Health
Services will provide mediation services to the Deschutes County
Circuit Court as part of the court's conciliation services; now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:

Section 1. Deschutes County Mental Health Services shall
provide mediation, through personnel meeting the minimum quali-
fications described in ORS 107.610, to the Deschutes County
Circuit Court of child custody and visitation disputes in domes-
tic relations cases, as part of the court's conciliation ser-
vices, as directed by the circuit court.
Section 2. The fee for such mediation services shall be
$75.00 per domestic relations case, to be collected by the trial
court administrator at the time of filing a domestic relations
suit, and to be paid to Deschutes County as provided in ORS
21.112 and as directed by the circuit court.
Section 3. All mediation fees collected by the trial court
administrator and paid to Deschutes County pursuant to this
Resolution, order of the circuit court and attached intergovern-
mental agreement shall be deposited in the Mental Health Services
Fund, shall be designated as a separate revenue line in that
fund, and shall be used solely to pay the expenses of providing
mediation services under this Resolution, court order and inter-
governmental agreement.
Section 4. This Resolution shall take effect on the 1st
day of June, 1986.

This intergovernmental agreement is entered into by and
between the State Court Administrator of the State of Oregon,
hereinafter "State Court Administrator ", and Deschutes County, a
political subdivision of the State of Oregon, hereinafter
"Deschutes County ".
WHEREAS, the Deschutes County Circuit Court wishes to estab-
lish a mediation program, pursuant to ORS 107.755 to 107.795, to
mediate child custody and visitation disputes in domestic rela-
tions cases; and
WHEREAS, the Deschutes County Circuit Court wishes to obtain
such mediation services from qualified personnel of the Deschutes
County Mental Health Services; and
WHEREAS, the Deschutes County Circuit Court, under ORS
21.112, may direct the collection by the trial court clerk of
fees from persons filing domestic relations suits to pay for
mediation services; and
WHEREAS, the Deschutes County Circuit Court, under ORS
3.280, 8.120, 8.125 and 109.110, may enter into agreements to
obtain court services through the State Court Administrator; and
WHEREAS, Deschutes County wishes to provide mediation ser-
vices to the Deschutes County Circuit Court through qualified
personnel of the Deschutes County Mental Health Services; and
WHEREAS, Deschutes County, through its Board of County
Commissioners, may enter into agreements to provide services to
the Deschutes County Circuit Court under ORS 3.280 and 190.110;
and
WHEREAS, Deschutes County wishes to be compensated for the
expenses of providing mediation services to the Deschutes County
Circuit Court through the collection and payment to the county of
fees authorized under ORS 21.112; and
WHEREAS, Deschutes County has determined that a fee of
$75.00 per domestic relations suit filed is necessary and ade-
quate to pay for the expenses of providing such mediation ser-
vices; now, therefore,
IT IS AGREED THAT:
1. Deschutes County, through its Mental Health Services,
will provide mediation services to the Deschutes County Circuit
Court as described in ORS 107.755 to 107.795.
