BOARD OF COMMISSIONERS MEETING
WORK SESSION JUNE 26, 1986

Hossick, Rick Isham, and Chuck Brown were present.
Membership of the Deschutes River Basin Committee was the first
item discussed. It was agreed that more business people and non -
consumptive users and fewer irrigators were needed on the
committee.
There was considerable discussion on the rimrock setback ordinan-
ces. Commissioner Maudlin suggested leaving the ordinances as
they are currently. The proposed ordinance would put a 100 ft.
setback on the rimrock. Dick Maudlin was opposed to this. He
felt that the existing 20 ft. rimrock setback was adequate.
There was also discussion regarding exceptions. It was agreed
that anything within 100 ft of the river, even a site located on
the rimrock could apply for an exceptions variance under the
ordinance, however, in no case will the rimrock setback be less
than 20 ft.
There was also discussion regarding conservation easements as a
condition of approval for a land use action. This could also be
a condition of approval for a setback exception. There was
discussion on whether a property owner should be forced into the
position of allowing public access on his property. Craig Smith
stated that this is a negotiated agreement and nothing will take
place that the owner does not agree to. These would only be
negotiated when a land use application was before the planning
department. The urban growth boundary is where they want to
assure public access.
Fill and removal ordinances were also discussed. It was felt
that enforcing a limit of five cubic yards per year would be
impossible so it was recommended that a permit be required for
any fill and removal activity. It was suggested that notices go
out in the tax statements to make people aware of this new
ordinance. It was agreed that there should be a sunset clause in
the ordinance so that within one year the planning department can
review its effectiveness. The ordinance will expire in two years
unless it is renewed by the Board.
Commissioner Tuttle was concerned that planned unit developments
approved before the setback ordinance went into effect should not
be affected by the restrictions. Craig Smith responded that it
would not be a problem since the current setback rules are close
to what has been adopted. These ordinances should not create any
non -conforming uses with the exception of the rimrock ordinance,
but the rimrock ordinance as proposed as modified is less
restrictive.

Commissioner Prante suggested that a thirty-two member Deschutes
Basin Resource Committee was too large. After further discussion
it was decided that a large committee would be fine. The
recommendations were: one Water Resources rep., one Fish and
Wildlife rep., one Forest Service rep., two non -consumptive
users, two public at large members, one member from Jefferson
County, two business people, and reps. from the irrigating
districts. It was also noted that the Planning Commission had
changed the wording to make the committee advisory to them. The
Commissioners changed this to make the committee advisory to the
Board of Commissioners.
Dick Maudlin suggested that they strike all references to scenic
rivers. The ordinance indicates that the committee should
recommend that the State proceed to make this a scenic river and
he objects to that.
There was discussion of the two acre feed standard, which is the
current standard. Development standards were also discussed.
Whether or not to make P.U.D. exempt was discussed and it was
agreed not to exempt anything.
The meeting was adjourned.
