1. Amendments to the Agenda
Chair Prante read aloud the amendments to the agenda.
2. Discussion of the Tumalo Flea Market Appeal
Mark Shipman stated that the staff has no further comments
on this issue. The staff report was submitted on August
20, 1986 at the public hearing.
Dick Maudlin suggested that we allow the use of the building
for the auction indoors only and that the applicants be
allowed to prove to the neighbors of the area that they will
clean up the building. Larry Tuttle stated that he would
want the building brought up to code and the parking lot
paved before being occupied.
MOTION: TUTTLE moved to sustain the hearing officer's
decision to grant a conditional use, but change
the conditions to limit all commercial activities
to within the building.

Commissioner TUTTLE further stated that this is with the
understanding that all the other conditions would be carried
forward.

3. Discussion of Northwest Commercial Property

4. Consideration of Personal Services Contract with Dennis
Branin and Norm Stephens
This agreement is for insurance adjusting services. Rick
Isham stated that the adjustors would receive $32 per hour
plus .2 of an hour per page for secretarial services on

reports. They would also receive $.21 per mile and $1.50
per photo taken.
MOTION: TUTTLE moved to sign the personal services
contract with Dennis Branin and Norm Stephens.

Consideration of Award of Bid for Concrete Work at Addison
Avenue Extension
Dave Hoerning stated that only one firm bid on the project.
Mr. Hoerning recommends that reinforced concrete and not
decorative block walls be used and that Jim and Bob Wilson
curb contractors be awarded this contract in the amount of
$3,380.23.
MOTION: MAUDLIN moved that we award the bid to Wilson
Concrete Service.
TUTTLE: Second.

Consideration of Refunds from the Community Development
Department

District Formation
MOTION: MAUDLIN moved for approval of Oregon Water
Wonderland road district.

10. Discussion Regarding the Administrative Law Judge/Hearings
Officer Issue
Chair Prante stated that the option for limited pre -decision
hearings and a contract hearings officer was the general
consensus. Craig Smith stated that he has talked with the
cities of Bend and Redmond. The city of Bend is interested
in following along with whatever the county does. The city
of Redmond was not sure what they wanted to do since they
use the hearings officer so infrequently. It is possible
that the cities may have their own arrangement with the
hearings officer and not go through the county. Larry
Tuttle feels that the cities should have their own agreement
with the hearings officer. Dick Maudlin agrees with this.
Chair Prante does not want to base the decision on what the
cities may or may not do.
MOTION: MAUDLIN moved to retain a hearings officer by
contract and that we will not sub -contract this to
the cities in the county.
TUTTLE: Second.
Rick Isham stated that the Administrative Law Judge would be
returned to the district court. Only a hearings officer
would be contracted with the county on a case by case basis.

12. Consideration of Maintenance Agreement
A contract with Finzer Business Systems was orginally in
consideration, but it was agreed that Network Office Systems
offered a better agreement.
MOTION: Chair PRANTE entertained a motion to authorize
the chair to sign.

MAUDLIN: Second.
VOTE: TUTTLE: Yes

13. Possible Abproval of Out -of -State Travel for the Health
Department, WIC Program
This is to attend a conference in Seattle on high-risk
pregnancies and prenatal care.
MOTION: Chair PRANTE entertained a motion to approve.

14. Possible Approval of Resolution No 86-056 Declaring the
