An Order Vacating Excess
Public Property on Empire Avenue

ORDER NO. 86-068
WHEREAS, the Deschutes County Department of Public Works requested a
vacation of a portion of Excess Public Property on Empire Avenue, described
in Exhibits "A" and "B", attached hereto and by this reference incorporated
herein, on August 20, 1986; and
WHEREAS, the Board of County Commissioners declared its intent to
vacate said excess of Public Property by Resolution No. 86-052, dated August
20, 1986; and
WHEREAS, notice of hearing was given in accordance with law; and
WHEREAS, a hearing was held on October 1, 1986 to consider the proposed
vacation; and
WHEREAS, the Board finds that it is in the public interest to vacate
the public property; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS
as follows:
Section 1. That the property, described in Exhibit "A", is hereby
vacated to James D. Hogue and Frank Storch, tenants in common, each as to an
undivided 1/2 interest, dba S & H Associates.
Section 2. That the property, described in Exhibit "B", is hereby
vacated to Bend Millwork Company.
Section 3. That Deschutes County requested that this Public Property
be vacated, and therefore payment of costs is waived.
Section 4. That the Deschutes County Surveyor is directed to mark the
plat, if any, as provided in ORS 271.230.
Section 5. That this Order shall be recorded with the Deschutes County
Clerk, and copies shall be filed with the Deschutes County Surveyor and
County Assessor.

PARCEL A - VACATED TO JAMES D. HOGUE AND FRANK STORCH TENENTS IN
COMMON, EACH AS TO AN UNDIVIDED 1/2 INTEREST, dba S & H
ASSOCIATES.
A parcel of land, containing 0.35 acres more or less, lying
in the Northwest one-quarter (NW4) of Section Twenty-one
(21) of Township Seventeen (17) South, Range Twelve (12)
East of the Willamette Meridian, Deschutes County, Oregon,
being more particularly described as follows:
Commencing at the North one-quarter corner of said Section
21; thence South 380 16' 11" West 1936.28 feet to the POINT
OF BEGINNING; thence 85.88 feet along the arc of a 2824.79
foot radius curve to the right (long chord bears South 800
51' 39" East 85.88 feet); thence South 180 18' 20" West
165.40 feet; thence South 810 41' 31" West 94.83 feet;
thence North 180 18' 20" East 194.20 feet to the Point of
Beginning and terminus of this description.

in the Northwest one-quarter (NW4) of Section Twenty-one
(21) of Township Seventeen (17) South, Range Twelve (12)
East of the Willamette Meridian, Deschutes County, Oregon,
being more particularly described as follows:
Commencing at the North one-quarter corner of said Section
21; thence South 320 41' 51" West 1849.74 feet to the POINT
OF BEGINNING; thence South 240 29' 23" West 44.07 feet;
thence South 140 00' 56" West 110.34 feet; thence North 830
56' 41" West 122.95 feet; thence North 180 18' 20" East
165.40 feet; thence 117.55 feet along the arc of a 2824.79
