1986-20634-Order No. 86-068 Recorded 10/15/1986t E' f i' kN'E D . • 86-2490, BtFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COURTT,- VOL SONGE 37 An Order Vacating Excess Public Property on Empire Avenue located in Township 17 South, Range 12 East, Section 21 W.M. *` Deschutes County, Oregon. 86-20634 ORDER NO. 86-068 WHEREAS, the Deschutes County Department of Public Works requested a vacation of a portion of Excess Public Property on Empire Avenue, described in Exhibits "A" and "B", attached hereto and by this reference incorporated herein, on August 20, 1986; and WHEREAS, the Board of County Commissioners declared its intent to vacate said excess of Public Property by Resolution No. 86-052, dated August 20, 1986; and WHEREAS, notice of hearing was given in accordance with law; and WHEREAS, a hearing was held on October 1, 1986 to consider the proposed vacation; and WHEREAS, the Board finds that it is in the public interest to vacate the public property; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the property, described in Exhibit "A", is hereby vacated to James D. Hogue and Frank Storch, tenants in common, each as to an undivided 1/2 interest, dba S & H Associates. Section 2. That the property, described in Exhibit "B", is hereby vacated to Bend Millwork Company. Section 3. That Deschutes County requested that this Public Property be vacated, and therefore payment of costs is waived. Section 4. That the Deschutes County Surveyor is directed to mark the plat, if any, as provided in ORS 271.230. Section 5.
