WHEREAS, Deschutes County Department of Public Works
petitioned the Board of County Commissioners of Deschutes County,
Oregon, to vacate a portion of Murphy Road, located in Township
18 South, Range 12 East, Sections 17 and 18, Deschutes County,
Oregon; and
WHEREAS, the Board of County Commissioners has determined it
to be in the public interest to consider such vacation; now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That it is the intent of the Board of County
Commissioners of Deschutes County, Oregon, to vacate a portion of
Murphy Road described in Exhibit "A ", attached hereto and by this
reference incorporated herein, to Bend Golf and Country Club, an
Oregon Non - Profit Corporation, because it appears the road is no
longer needed for public use, and will not be needed in the
future.
Section 2. That it is the intent of the Board of County
Commissioners of Deschutes County, Oregon, to vacate a portion of
Murphy Road described in Exhibit "B ", attached hereto and by this
reference incorporated herein, to Timber Ridge Homeowners
Association, an Oregon Non - Profit Corporation, because it appears
the road is no longer needed for public use, and will not be
needed in the future.

Section 3. That the County Engineer shall file an
Engineer's Report with the Board of Commissioners, describing the
ownership and uses of property to be vacated, and whether the
vacation would be in the public interest, within fourteen (14)
days of the date of this Resolution.

Description of a portion to be vacated to Bend Golf and Country
Club, an Oregon Non- Profit Corporation.
A tract of land lying in the Northeast Quarter of the
Southeast Quarter (NEB SEA) of Section 17, Township 18 South,
Range 12 East of the Willamette Meridian, Deschutes County,
Oregon, being more particularly described as follows:
Commencing at the 2" Brass cap marking the East one - quarter
corner of said Section 17; thence South 00° 32' 13" West 523.63
feet along the East line of said Section 17 to a point on the
southwesterly right -of -way line of the new alignment of Murphy
Road being the Point of Beginning; thence continuing along the
East line of said Section 17 South 00° 32' 13" West 77.83 feet;
thence 103.18 feet along the arc of a 220.00 foot radius curve to
the right, the chord of which bears North 12° 31' 34" West 102.23
feet; thence North 00° 54' 18" East 60.68 feet to a point on the
southwesterly right -of -way line of the new alignment of Murphy
Road; thence along said right -of -way line 85.60 feet along the
arc of a 530.00 foot radius curve to the left, the chord of which
bears South 14° 52' 10" East 85.51 feet to the Point of
Beginning.

A tract of land lying in the Northwest Quarter of the
Southwest Quarter (NWY4 SWV) of Section 16, Township 18 South,
Range 12 East of the Willamette Meridian, Deschutes County,
Oregon, being more particularly described as follows:
Commencing at the 2" Brass cap marking the West one - quarter
corner of said Section 16; thence South 00° 32' 13" West 523.63
feet along the West line of said Section 16 to a point on the
Southwesterly right -of -way line of the new alignment of Murphy
Road being the Point of Beginning; thence continuing along said
right -of -way line 339.30 feet along the arc of a 530.00 foot
radius curve to the left, the chord of which bears South 37° 50'
12" East 333.54 feet to a 5 /8" iron rod with an aluminum cap
marking the right -of -way P.T.; thence North 56° 10' 36" West
163.15 feet; thence 102.73 feet along the arc of a 230.00 foot
radius curve to the right, the chord of which bears North 430 23'
04" West 101.88 feet to a point on the West line of said Section
16; thence North 00° 32' 13" East 98.56 feet along said section
