DEC I 119,936 ORDER NO. 86-078 WHEREAS, a petition requesting a vacation of a portion of R&, d , described in Exhibit "A" and Exhibit "B", attached hereto and by this reference incorporated herein, was filed with t -he Board of County 'Clommissioners of Deschutes County, Oregon, on October 29, _1986; and WHEREAS, the Board of County Commissioners declared its intent to vacate said Road by Resolution No. 86-058, dated October 29, 1986; and WHEREAS, notice of hearing was given in accordance with 'Law; and WHEREAS, a hearing was held on December 10, 1986 to consider the proposed vacation; and WHEREAS, the Board finds that it is in the public interest to vacate the pub�. ic property; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the property, described in Exhibit, "A", is hereby vacated to Bend Golf and Country Club, an Oregon Non -Profit Corporation. Section 2. That the property, described in Exhibit "B" is hereby vacated to Timber Ridge Homeowners Association, an Oregon Non-Proflt Corporation. Section 3. That Deschutes County requested that this road be vacated, and therefore payment of costs is waived. Section 4. That any person liable for payment of costs shall pay the amount of costs established. Section 5. That the Deschutes County Surveyor is directed to mark the plat, if any, as provided in ORB Z71.230. Section 6. That this Order shall be recorded with the Deschutes County Clerk, and copies shall be filed with the Deschutes County Surveyor and County Assessor. ORDER NO.
