Rick Isham, Legal Counsel was also present. 1. Amendments to the Agenda Chair Prante read aloud the amendments to the age w, d 2. Award of Longevity Pins to County Employees _ co Lane Thomas 5 years° Suzan Taylor 5 years f Dani Wade 5 years These employees were commended for their years of County service. 3. Public Hearing Regarding Reconsideration of Dog Hearing, Bowlin and Colvard, held on 2/6/87 Chair Prante opened the public hearing and asked for any new testimony on this issue. Raymond Bowlin stated that at the last hearing, he did not have information on who he had contacted at the state. He stated that he talked to Dick Baggerly, a branding inspector ? at the livestock department, and also Donna Haug at the same department. Mr. Bowlin stated that Donna Haug knew what his call was about and also stated that llamas were not considered livestock as far as her department was concerned. He also stated that concerning the 1981 hearing, he believes the issue should have gone farther at that time and made law. Lynn Hyder stated that he had a letter from Congressman Bob Smith that refers to llamas as livestock. He also brought in a llama skin to illustrate that fact that he believes llamas are fur-bearing animals and should be considered as livestock in the statute. Commissioner Throop entered the meeting at 10:05 a.m. and apologized for being late. Bill Boyer stated that in the National Llama Journal mention was made to llamas as livestock. Chair Prante asked for any other comments. Hearing none, she closed the public hearing. Chair Prante stated that Order No. 87-019 reads," an order V0., 8,P4GE 710 finding that certain malamute-akita cross dog and a certain pit bull type dog have engaged in the wounding and chasing of livestock and directing the killing of the animal in a humane manner." Rick Isham stated that he has prepared a draft order stating that the Board finds llamas to be livestock. MOTION: Commissioner Throop moved for approval of the order which would kill in the most humane fashion possible the dogs in question. MAUDLIN: Second. Commissioner Throop stated that he believes it is clear that llamas are considered livestock in the statuatory definition. He stated that it is obvious to him from the evidence presented in the hearing that the dogs did attack and do substantial injury to the llamas. Commissioner Maudlin stated that he apologizes for not making a legal motion and for not continuing the motion to send the message that the Commission believes that llamas are livestock. VOTE: MAUDLIN: Yes THROOP: Yes PRANTE: Yes Rick Isham stated that the date set for destroying the dogs is Wednesday, February 18. He stated that he believes the dog owners know their right to appeal. Chair Prante recessed that meeting for two minutes before the next public hearing. Chair Prante reconvened the meeting and opened the public hearing on the review of SP-86-51. 4. Public Hearing on the Review of SP-86-51 for Weyerhaeuser Craig Smith gave the staff report. He stated that this reviews condition #4 of the decision which requires that Antler Avenue be paved within two years. Mr. Smith stated that a group from the County looked at the road and recommended that condition #4 should read something like the following: "Deschutes County shall improve Antler Ave. to a 20 foot wide rock surface road section following the existing contours. This shall include the grading and the placement of 4 inches of crushed hard rock 1 inch minus watered and compacted in place. This improvement shall be completed within one year from the date of the Boards decision." Craig Smith believes that this is the minimun necessary to alleviate some concerns about the current conditions of the road. VD!.~ Chair Prante asked what the approximate cost of this would run. Larry Rice stated that it should be less than $20,000. 5. 6. 7. Commissioner Maudlin asked if he was correct that this has always been a County road, but not maintained regularly. Rick Isham and Craig Smith both stated yes, saying that maintenance was very sporadic. Chair Prante asked for any comments. Hearing none, she closed the hearing. Public Hearing and Consideration of Order No. 87-008, Chair Prante opened the hearing and asked for comments. Hearing none, she closed the hearing. Possible Award of Contract for 1987 SAFE Project MOTION: MAUDLIN moved that we award the 1987 SAFE Project VOL 51PLGE 712 contract based on the information received to Century Marketing Associates. THROOP: Second. Chair Prante stated that this contract came in for less money and provided for twice the staff time. Commissioner Throop stated that a letter should be sent to the steering committee commending them and describing the rationale for the change in contractors. Possible Approval of Purchase of Forklift for Public Works Resolution No. 87-007 exempts the purchase of a used forklift caterpillar from competitive bidding. Possible Signature of Weekly Warrant Vouchers The amount of the weekly vouchers is $97,507.79. MOTION: MAUDLIN moved for signature of the weekly warrant vouchers as approved by the Board. THROOP: Second. VOTE: THROOP: Yes MAUDLIN: Yes PRANTE: Yes 16. Other Staff/Public Concerns Deschutes County was chosen to participate in a nuclear attack drill. MOTION: THROOP moved that the Board of Commissioners adopt an official resolution which makes a statement on our participation and our proposed participation in a drill set for March 3-5 and have it read. . "It has come to our attention that Deschutes County was one of the ten names drawn to participate in a drill set for March 3-5, 1987. The position of the Deschutes County Commission is we decline to participate in this drill." MAUDLIN: Second. O VOL SIPAGE 714 Commissioner Throop believes that to contribute in any way to the fallacy that this community could survive a nuclear attack would be irresponsible. Chair Prante agrees with this. Commissioner Maudlin is concerned about the loss of funds from the federal government if we refuse to participate in the drill. Commissioner Throop hopes that the federal government does not withhold funds and wants to work with the state and federal representatives on that. He further states that we should be prepared for such a loss. MOTION: MAUDLIN moved to authorize the Chair to sign the contract between the Veteran's Service officer and PCC.
