Chair Prante called the meeting to order at 10:10 a.m. Board
members in attendance were Lois Bristow Prante, Tom Throop, and
Dick Maudlin. Also present were Richard Isham, County Legal
Counsel, and Karen Green, Assistant Legal Counsel.
1. AMENDMENTS TO THE AGENDA
There was one amendment to the agenda.
2. PUBLIC HEARING: ORDINANCE NOS. 87-013 AND 87-015 AND
RESOLUTION NO. 87-011
This was a public hearing before the Board of County
Commissioners on ordinance 87-013, an ordinance
amending the Deschutes County Zoning Ordinance to
revise the provisions for dwellings in Exclusive Farm
Use zones; Ordinance No. 87-015, an amendment to the
Deschutes County Zoning Ordinance to revise provisions
concerning nonconforming lots and parcels, and
Resolution 87-011 to rescind the 1979 policy on farm
dwellings.
Craig Smith, Deschutes County Planning Director,
presented the staff report, generally outlining the
intent of the amendments. Karen Green also gave a
staff report, describing the events that had lead up tc
the necessity of the County amending the zoning
ordinance in regard to dwellings in EFU lands. Karen
read through the ordinances and highlighted the
criteria a person would have to meet in order to
qualify for the special tax assessment for agricultural
lands. It was pointed out that preexisting dwellings
on farm lands would not be affected by these new
ordinances; they only dealt with new applications for
farm dwellings in EFU-zoned lands.
Charlie Hemphill from Bend Title Company expressed his
concerns about the County implementing these
ordinances. He felt that people had been mislead to
believe that they could eventually build a dwelling on
their farm use land and continue to receive farm
deferral. Mr. Hemphill suggested allowing taxpayers an
extended amount of time to pay off their taxes when

farm deferral was removed from the property. It was
explained to Mr. Hemphill that the timeline in paying
taxes was governed strictly by the State and that there
was no flexibility by the County.
Brent Lake, Field Representative for Central and
Eastern Oregon for the Department of Land Conservation
and Development, spoke in favor of the ordinances. Mr.
Lake complimented the County for the commendable job on
the amendments to so adequately address the issue of
farm dwellings. Mr. Lake asked that in addition to the
requirement that agricultural/livestock productivity be
proven profitable for two years, that the County also
require farm use to be currently occurring on the
property to qualify for farm deferral.
Judy Hurtley of Sisters asked the Board whether
financial proof of agricultural profits would be
required to qualify for the farm deferral. The Board
members explained to Ms. Hurtley that in the EFU zone,
a person will only have to prove that they intend to
make a profit on the land. In a non-EFU zone, an
income test will have to be met. In addition, it was
explained that there was a special assessment for the
EFU zone, whereas, there is a tax deferral for nonfarm
zones where agricultural/livestock activities are
occurring.
Carol Edmunds of 20903 Knott Road in Bend, asked the
Board whether a 10-acre parcel not zoned EFU could have
a dwelling built on it, continue farming, and receive
the tax deferral, at which the Board responded yes.
The Board continued the public hearing to June 3, 1987,
at 10 a.m. to allow additional comments on the
ordinances and resolution.
