Ou7i 87 2290.5 ORDER NO. 87-075 WHEREAS, ORS 271.330 provides that Deschutes County may transfer property to another governmental body after hearing; and WHEREAS, a hearing was held on November 4, 1987; and WHEREAS, the Board of County Commissioners determined that Deschutes no longer needed certain property for public use; and WHEREAS, no objections to the transfer of the property were expressed at said hearing; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the property described in Exhibit "A", attached hereto and by this reference incorporated herein, be transferred to Midstate Electric Cooperative, Inc., without consideration. Section 2. That a Bargain and Sale Deed transferring said property to Midstate Electric Cooperative, Inc. in substantially the form as set forth in Exhibit "B", attached hereto and by this reference incorporated herein, be executed and delivered. EXHIBIT "B" 0089-0579 After Recording, Forward All Tax Statements To: BARGAIN AND SALE DEED DESCHUTES COUNTY, a political subdivision of the State of Oregon, Grantor, conveys to MIDSTATE ELECTRIC COOPERATIVE, INC., a cooperative corporation of the State of Oregon, Grantee, the following described real property: Lot 11, LaPine Industrial Site, Deschutes County, Oregon. SUBJECT TO: All encumbrances of record and those common and apparent on the land. so long as the real property is used for public purposes. If the property ceases to be used for public purposes, it shall auto- matically revert to Grantor. This instrument will not allow use of the property described in this instrument in violation of applicable land use laws and regulations. Before signing or accepting this instrument, the person acquiring fee title to the property should check with the appropriate city or county planning department to verify approved uses.
