MINUTES
DESCHUTES COUNTY BOARD OF COMMISSIONERS
December 9, 1987
Chair Prante called the meeting of the Board of Health to order
at 10:04 a.m. Board members in attendance were Lois Bristow
Prante, Dick Maudlin, and Tom Throop. Also present were Lynn
Huntington, Director of Health Department, Rick Isham, Legal
Counsel, Karen Green, Assistant Legal Counsel, Craig Smith,
Planning Director, and Larry Rice, Director of Public Works.
Lynn Huntington had given out pamphlets to the Board members
containing statistics on Health Department programs. She stated
that she would provide an update shortly after the fiscal year at
which time final statistics would be available. There were no
questions from the Board, so meeting was adjourned.

9, 1987, at 10:12 a.m.

Commissioner Throop entered into the record a letter of
October 20 from Robert Liberty of 1000 Friends of Oregon.
Mr. Liberty had expressed concerns over whether or not the
land would continue to be used for agricultural purposes.
He felt that allowing smaller lots would prohibit commercial
use of the land for agriculture. Commissioner Throop had a
letter from Marvin Young, Extension Agent, which addressed
this issue.

2. ORDINANCE NO. 87-032
A public hearing was held on Ordinance No. 87-032, an
ordinance amending Ordinance No. 86-056, to exclude certain
segments of the Deschutes River from fill and removal
regulations. Since the portions of the river included were
designated Scenic Waterways, the State already placed
stringent regulations on these stretches. Therefore, it was
felt that removing County conditional use requirements would
eliminate an unnecesary repititious process for applicants.
Craig Smith, Planning Director, stated that the Department
of Land Conservation and Development had been given their
45-day notice, and the Planning Division had not received
any response. No one else wished to testify on the matter.

INSTRUCTIONS FOR FILING THE PETITION
Valuation Appeals
Petitions concerning personal property valuation must be filed with the Board at its May session. Valuation
appeals must be filed no later than May 31. An extension to this filing deadline can only be granted if the
assessor mails a value increase notice after the first Monday in May. If a notice is mailed after that date, the
time within which the petition must be filed is extended for three weeks from the date of mailing. In no case
shall a valuation petition be filed with the Board after July 1.
If filing deadlines have passed, contact your assessor to determine your appeal rights.
Late Filing Penalties
Late filing penalties may be appealed any time the May Board is in session. If the May Board has adjourned
when the petitioner receives notice of a late penalty, an appeal can then be made to the November Board.
Petitions to the November Board must be filed no later than December 1.
If filing deadlines have passed, contact your assessor to determine your appeal rights.
GENERAL INFORMATION
Filing a petition with the Board does not automatically ensure a value reduction, suspend tax payments,
invalidate the present assessment, or excuse the late filing penalty. The Board is required to find the correct
true cash (market) value of the petitioner's property, or in the case of a late filing penalty, to determine if the
penalty is justified.
To succeed in an appeal, the petitioner must present evidence supporting his or her arguments. The petitioner
must offer proof to show that the market value of the property is incorrect or that the late filing penalty should
be removed. For further information, refer to the free information circular "Property Value Appeal Procedure"
available from your assessor. Only the property owner, the person in whose name the property is assessed,
or their attorney may sign this petition. Petitions signed by any other person will be rejected.
When completing the petition, pay particular attention to the following:
1. Be sure to enter your opinion of true cash value.
2. Be sure to state the facts on which you base your opinion.
3. Be sure to indicate whether you desire to appear at the Board hearing.
4. Be sure to sign the declaration and include your address and telephone number.
File one copy of the petition with the Board'of Equalization and retain one copy for your file. (The county clerk is the clerk for
the Board of Equalization.)
