WHEREAS, Deschutes County maintains approximately 95-8 miles
of County roads. Due to climactic conditions, Deschutes County
must periodically plow snow, sand, and remove accumulations of
snow and ice on County roads; and
WHEREAS, given limited County fiscal resources, and the
availability of manpower and equipment, the County must provide a
measured response to snow and ice accumulations on County roads
to provide, within the limitations . applicable, adequate main-
tenance of said roads; and

WHEREAS, the Director of Public Works has developed a Snow
and Ice Control Plan which sets forth the County's policies and
procedures to deal with snow and ice accumulations on roads which
are maintained by the County; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. The Snow and Ice Plan of Deschutes County,
marked Exhibit "A ", attached hereto and by this reference incor-
porated herein, is hereby adopted as the Snow and Ice Control
Plan of Deschutes County, Oregon.
Section 2. That the Director of Public Works is directed to
implement the Snow and Ice Control Plan as set forth in Section 1
of this Resolution.
Section 3. The Snow and Ice Plan shall be annually reviewed
and presented to the Deschutes County Budget Committee for fund-
ing. Proposed Annual updates shall be proposed along with suffi-
cient documentation to show necessary appropriation of funds to
implement the plan during the next fiscal year.

The purpose of this Deschutes County "Snow and Ice Plan" is to
provide the Department of Public Works with an adopted set of
goals, objectives, standards, and operating procedures for snow
and ice control on County roads.
GOAL
within budget and equipment limitations, to maintain snowy and
icy County roads in the safest condition possible.
OBJECTIVES
1. Assess needs.
2. Inventory resources available.
3. Arrange for supplemental resources during times of severe
conditions through inter - governmental agreements and private
service contracts.
4. Define service standards.
5. Prepare a master County road map[ showing County roads by
priority.
6. Identify service priorities by geometry, location, and
function of County roads.
7. Allocate available resources.
8. Identify those roads or portions of roads to be closed to the
public throughout the winter months.
9. Develop a system for recording services provided.
10. Provide for an annual review of the plan in conjunction with
the budget.

INTRODUCTION

Deschutes County is located in Central Oregon east of the
crest of the Cascade Mountain Range. Elevations of roads
within the County vary from a low of 3,100 feet to a maximum
of 6,300 feet. These elevations result in different snow and
ice conditions throughout the County.
The estimated County population is 65,400. An additional
40,000 residents are projected by the year 2,000, according
to the State of Oregon.
The County contains the cities of Bend, Redmond, and Sisters.
Each city maintains its own city streets. The State of
Oregon and U.S. Forest Service maintain roads under their
jurisdiction. The County inventory consists of 23.1 miles of
urban arterials, 31.2 of urban area collectors, and 94 miles
of urban area local roads. In addition, there are
approximately 71.9 miles of rural arterials, 234.8 miles of
rural collectors, and 421.6 miles of rural local roads. The
total mileage under County maintenance is approximately 958
miles, including 81.4 miles of County roads within forest
boundaries.
509 miles of public access roads are not maintained and are
not covered in this plan.
Deschutes County attracts a substantial number of tourists
from within Oregon and several states. Tourism peaks are
during the summer vacation months, and again during the
skiing season, from late November until May.
Deschutes County has a dry climate. Annual average
precipitation in the city of Bend is 12 inches. Over six
inches of precipitation in the form of snow falls between
November and February in the city of Bend. At Mt. Bachelor,
located west and south of Bend, snow depths can reach 180
inches. County roads, receive snow levels within this range,
with occasional absence of snow in the northern and eastern
portions of the County. Winter conditions are intermittently
encountered in the high desert in the eastern part of the
County. The high elevation and openness of the eastern
portion of the County is conducive to snow drifting.

ARTERIAL ROAD - A restricted access street of substantial
continuity which is primarily a traffic arterial and so
designated by the County.
AVAILABLE RESOURCES - Sanding material, equipment, and
manpower that is available to provide snow and ice control
services.
BOCC - The directly elected policy body of Deschutes County
Government.
CINDER - Volcanic slag crushed to 3/4 -0 sanding material.
COLLECTOR ROAD - A restricted access street supplementary to
the arterial street system used or intended to be used
principally for the movement of traffic between arterials and
local streets.
CONTRACTS FOR SERVICE - Executed, documented agreements
between Public Works and private companies for work to be
done as needed.
CURVE - Any bend in the road where the posted speed is less
than the statutory speed.
DIRECTOR - Director of Public Works for Deschutes County, or
his designee.
DIVISION DIRECTOR - Director of the Division of
Transportation and Solid Waste within Public Works, or his
designee.
DOCUMENTATION - Written or electronically recorded
information in respect to road conditions or services
rendered.
EMERGENCY RESPONSE - Any time period between when notified of
emergency, and when a plan is activated.
EQUIPMENT MAINT. SUPERVISOR - The Director of the Division of
Fleet and Equipment within the Public Works Dept., or his
designee.
FLOODING - The over flowing of water from one point to
another.
GRADE - Any up or down change in a horizontal road surface.
ICE - Water made solid by cold which may result in a slippery
surface.

INTER - AGENCY AGREEMENT - A written arrangement between
County, Municipal, State and Federal agencies.
LOCAL ROAD - A street intended primarily for access to
abutting properties.
PLOWING - To remove snow from roadways by a vehicle.
RISK MANAGER - A person designated by County Legal Council to
administer the County's program of self insurance.
ROAD SUPERINTENDENT - Transportation Supervisor within
Division of Public Works.
RURAL AREA - That area within Deschutes County outside of the
Urban Growth Boundaries.
SANDING - The act of placing material on a road to increase
traction.
SANDING MATERIALS - 3/4 -0 crushed cinders or aggregate.
SERVICE AREA - Areas within the County where snow and ice
control services are provided.
SNOW - Moisture, when frozen in the upper air currents,
resulting in soft white crystalline flakes which accumulate
on the ground.
SNOW AND ICE CONTROL PLAN - An adopted written document
containing policies, organization and administration plans,
and maps that pertain to snow and ice control.
SNOW SEASON - Nov. 1 thru May 1.
SUPERVISOR - Any so designated employee within the Department
of Public Works.
TRAFFIC ENGINEER - An employee of the Engineering Division of
Public Works registered as a Professional Engineer in Oregon
and designated as Traffic Engineer.
URBAN AREA - (UGB) Areas of City and immediate adjacent areas
designated by adopted plans.

The annual Preparedness Plan is as follows and shall be
completed before November 1 of each year.
1. Update Inter - agency Agreements.
2. Ensure contracts for supplemental services are executed.
3. Provide refresher training in elements of the plan.
4. Using a check off list, the Shop Foreman will ensure that
all equipment is in a state of readiness.
5. Distribute copies of the plan to personnel.
6. The Traffic Engineer will take appropriate action
to close roads or post no parking signs.

SERVICE PRIORITIES

Narrative in support of establishing priorities.
The following factors were taken into consideration in
establishing service priorities:
1. The need to serve the majority of the population using
available resources within the least amount of time;
2. The need to ensure the County's major traffic carriers
will function;
3. The need to ensure access to public safety services,
employment centers, governmental services, and other
essential services;
4. The need to avoid road closures which may be brought on if
early snows are not removed quickly;
5. The need to plan service routes that are efficient;
6. The need to service sections of roads with steep grades,
curves, anJ. intersections.
PRIORITY 1 ROADS
* All arterial and collector roads within the County's Urban
Growth Boundaries containing the cities of Bend and Redmond;
* All arterial and collector roads within rural service
communities including LaPine, Terrebonne, and Tumalo;
* Entrance roads to the planned community of Sunriver;
* Those roads that combine to make efficient service routes,
and lie adjacent to or connect urban communities;
* Those roads that service rural residential areas or roads
at high elevations including: Burgess, Deep Woods, Day Road,
LaPine State Park Road, Huntington, Dorrance Meadows, and
Sixth in the LaPine area; Skyliner, Saddleback, Sundance, in
the Bend area; Smith Rock and Central in the Terrebonne
area.

Snow plowing will begin at the first accumulation of four (4)
inches of snow in accordance with the priorities. A travel
lane in each direction will be opened on the first pass.
Traffic lanes will be maintained after the initial opening
and lanes widened to prepare for the possibility of
additional accumulations.
Where drainage is impaired and cannot be corrected, and as a
result water accumulates, high water signs will be placed as
appropriate.
In order to provide for a lane in each direction the
Department, through its Traffic Engineer, may post roads
prohibiting on- street parking during the snow season.
The County is not responsible for opening driveways that have
ace's onto County roads, however the County may provide or
o: - }.- assistance for the elderly or handicapped upon request
ar.L: .pproval by the Board of Commissioners.

SANDING

":-The County'shall sand those portions of roads where vehicles
are most likely to loose traction or are required to slow
down, or come to a stop. These locations include
intersections, curves, grades, and bridges.
Sanding shall begin according to the following criteria:
1. Upon receipt of information that ice conditions exist.
2. Upon compaction of snow after snowfall has ceased.
3. After re— plowing of lanes when appropriate.
4. When ice accumulates and ice ridges form during freezing
and thawing conditions during prolonged cold periods,
attempts shall be made to reduce the ice ridges in size
through use of plows and graders. When completed, area
will be sanded.
5. When, in the judgment of the Supervisor, sanding is
required in addition to standard procedures.
6. These procedures may be modified during times of heavy
snowfall when sanding would not be effective.
Equipment mobilization will be within one hour of the
decision to sand by the Supervisor.
The Department will receive information as to road conditions
from its Supervisors in the field, phone calls to the office,
and checks with the Sheriff and State Highway Department. The
Department will make arrangements with other public and
private contractors for sanding assistance as a standby
measure. County dispatch will relay deputy reports to the
Department.

D. Annual Budget Consideration /Resource allocation
The County budget process begins in February of each year and is
completed prior to July 1 of each year. During this time all
departmen=s prepare and propose their budgets for consideration.
The Department of Public Works prepares both line item and
program budgets. The official budget is the line item budget.
The program budget contains programs of service and includes a
sub program entitled Snow and Ice Control. This program proposes
the amounts of monies requested for the categories of personnel,
materials and services, new equipment, equipment rental and
contract services. The Budget Committee will review the proposed
program of service and recommend a level of service commensurate
with competing programs for all other services. The Board of
Commissioners will consider the Staff and Committee
recommendations and make a final decision on resource allocation.
The final budget will then convert the program budget to a line
item format which will apply to the next year's Snow and Ice
Control Program of Service.

STOCKPILE LOCATIONS

The County will utilize the State of Oregon's sanding material
stockpiles under an Inter - Agency Agreement, as well as providing
sites of its own where appropriate to ensure that adequate
material is available. Following are existing stockpiles of
sanding material:
Area 1. Sister's ODOT site.
Area 2. Redmond's ODOT site
Area 3. Bend's ODOT site and the County's Knott site
Area 4. LaPine's ODOT site and the Vandevert site
Area 5. Brother's ODOT site and the Horseridge site

COMMUNICATIONS

Communications within the Department and between the Department,
other agencies, and organizations is a very important part of
this Snow and Ice Control Plan. All methods of communications are
required to ensure the plan is carried out.
The County has a master switchboard for all in- coming calls.
Messages can be transferred to any supervisory employee by
transferring the call to a station, or by electronic mail, or by
written work order. In the later case all incoming calls dealing
with requests for services are logged in quadruplicate (4) and
distributed as soon as possible. Responses are written on a copy
and filed. The County is in the process of purchasing and
installing an emergency generator to ensure operations can
continue in case of a power outage.
The County has mobile radios in all moving equipment that go into
available resources for implementing the plan. The system is
connected directly to the Sheriff's dispatch operation enabling
radio contact between the Sheriffs Department and the Public
Works Department. The Sheriff is also connected electronically
with 9 -1 -1, therefore the Public Works Department can receive
condition reports from both sources. Mobile radios are backed up
by portable units for absence from vehicles or for communications
between vehicles.
The radio transmitting system relies upon a central station and
two satellite stations which are repeaters. This system provides
coverage throughout the ;tire County.
All Road Division Supervisors have pagers, and can be r.ached
during the day as well as those evenings and weekends ti-:at they
are on call. The Sheriff's Department is provided with a list of
employees that are on call 24 hours a day, 7 days a week.
The Traffic Engineer and others are trained in the use of video
recording equipment, and a:? on call to document accidents on a
twenty -four hour a day ba- s, including weekends.
Information about storm events is provided by the radio, the
Sheriff's office, the State Highway Department, and Department
employees who are assigned to assess road conditions on off hours
and employees during regular working hours. Citizens also call in
concerns about conditions• and requests for service. Internal
operations ensure that all such information is made available to
the proper staff.

MAINTENANCE AND OPERATIONS
The Director of the Division of Transportation and Solid
Waste is responsible for implementing the Snow and Ice
Control Plan. He may delegate this responsibility to his Road
Superintendent and his staff. Responsibilities will include:
1. Determine the phase of operations.
2. Determine appropriate treatments.
3. Determine timing of services according to priorities.
4. Determine the need for resources and deploy such
resources.
5. Report on the effectiveness and adequacy of services
provided.
OFFICE SUPPORT FUNCTIONS
Receive and transmit service requests to the proper staff and
maintain records of requests. Coordinate administrative
support to the operating Departments. Establish and maintain
contact with other agencies and departments. Provide mobile
radio information.
The Director of Public Works will ensure that all
administrative systems are functioning properly. He will
ensure that the Board of Commissioners are kept informed and
apprised of the need for any additional resources through the
budget process. He shall also cause the plan to be reviewed
on an annual basis, and updated as necessary.
SUPERVISOR
The Supervisor shall perform all those administration actions
necessary to ensure that services are provided according to
the adopted plan in a timely manner. He shall keep his
immediate Supervisor informed as to the actions he has taken
and intends to take, and the effectiveness of the efforts. He
shall request additional assistance when deemed appropriate.
He shall maintain field assessment of conditions throughout a
storm event and coordinate his actions with the Division of
Fleet and Equipment to ensure vehicles are available as
needed.

The Supervisor is responsible for seeing to the removal of
excess material from the travel lanes with special emphasis
placed at intersections and bike lanes after the season. He
will review documentation for adequacy, prepare reports on
the operation as required, and assist in reviewing the plan.__.___

TRAFFIC ENGINEER
The Traffic Engineer is responsible for maintaining the sign
and signal system in as near normal condition as possible; in
addition providing emergency traffic controls as required.
Specific duties include but are not limited to:
1. Manage the inventory and placement of emergency traffic •
control devices.
2. When requested, implement temporary street closures, or
other traffic controls.
3. Implement planned detours and closures.
4. Investigation cooperation with the Sheriff's office of
traffic accidents on County roads, as deemed
appropriate.
5. Serve in a consultive role in the preparation and
implementation of thi plan.

COORDINATE RESPONSIBILITIES WITH SHERIFF'S DEPARTMENT
1. Road crews when working with out a Supervisor will
notify Sheriff's office upon leaving shop, and finishing
shift.
2. Sheriff's Dept. has on hand a list of names to call in
an emergency special notification: weekend "on call
personnel" will be called into Sheriff's office 24 hours
prior to going "on call ".
3. Sheriff's office will be notified when sanding /plowing
equipment is in operation.
4. Deputy sheriff on patrol will notify Department through
dispatch of areas in need of sanding or plowing based
upon their judgment.
5. Dispatch will notify Department upon receipt of a
request to sand or plow for high water.
6. Department will notify Sheriff and other emergency
service agencies of road closures or other special
conditions which may be of assistance to the public.
7. Those employees trained in traffic safety will assist in
traffic control as requested.

This Agreement, made and entered into on the data herein-
after set forth, between the State of Oregon, by and through its
Dewar tent of Transportation, Highway Division, hereinafter
referred to as "State ", and Deschutes County, by and trough its
Board of County Commissioners, hereinafter rc2,2=w--=bd. to as
"County".
WHEREAS, ORS 190.110 authorized the State and Caurt_r to
enter into agreements for the performance of duties and responsi-
bilities of the other; now, therefore,
IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO as
follows:
1. State will allow County to remove sanding material from
all existing State stcckpil a sites located within
Deschutes Caunty, i.e. Sisters, Redmond, Bend, LaPine
and Vandever r stockmi1e sites. The Caunty will use
State equipment to load the material into County
trucks.
2. Count_, will remove a maximum of 750 cubic yards per
year per site.
3. County will submit to State a monthly account of
material removed from each sit_.
4. County will r=eplace material removed from stockpile
site(s) within 2 years according to State's direction,
and also reimburse the material new awing to State from
December 1980 trough February 1987 in the amount of
1,245 cubic yards.
The Oregon Transportation Commission, by duly adopted
delegation order, authorized the District Maintenance Engineer to
approve and execute this Agreement on behalf of the State of
Oregon.

A G R E E M E N T
THIS AGREEMENT, made and entered into by and between the
STATE OF OREGON, by and through its Department of Transportation,
Highway Division, hereinafter referred to as "STATE "; the FOREST
SERVICE, United State Department of Agriculture, acting by and
through its Forest Supervisor, hereinafter referred to as "FOREST
SERVICE "; and DESCHUTES COUNTY, by and through its Department of
Public Works, hereinafter referred to as the "COUNTY ".
W I T N E S S E T H
RECITALS:
WHEREAS, STATE, FOREST SERVICE, and COUNTY are interested in
providing the public with access to a snowmobile area in the vicin-
ity of Newberry Crater Road (East and Paulina Lakes Road). The
road is located in R -11 -E, T -21 -S, and T -22 -S and R -12 -E, T -21 -S
and T -22 -S; and
WHEREAS, FOREST SERVICE, COUNTY, and STATE agree that joint
development and utilization of recreational areas and facilities
for the benefit and enjoyment of the public is consistent with the
general objective of both parties; and
NOW, THEREFORE, the premises being in general as above stated,
based upon said RECITALS and the conditions stated, it is hereby
mutually agreed between the parties hereto as follows:
I
The Newberry Crater Road is primarily on FOREST SERVICE land.
The FOREST SERVICE agrees to the winter usage of the road and
further agrees to permit the COUNTY to operate plows on the roadway.
The FOREST SERVICE further agrees to permit the construction of turn-
arounds for the plow trucks and for the road users.
The roadway is shown on the map marked Exhibit "A" attached
hereto and by this reference made a part thereof.
II
The COUNTY agrees to provide any roadway maintenance to the
road as provided for by cooperative agreement between Deschutes
National Forest and Deschutes County, dated November 19, 1966.

The COUNTY agrees to construct, at suitable intervals, turn-.
arounds for the COUNTY plows and for the recreational road users
as funds will permit.
COUNTY shall provide the plc';ing for the area. The snow re-
moval in this area shall be sub - :t to termination because of the
impact of an energy crisis as it relates to the shortage of fuel
by COUNTY. Plowing to be done after the completion of regular COUNTY plowing. �L

III
It is mutually agreed between the parties hereto that snow
removal operations for the areas covered by this agreement may be
reduced or suspended at any time.
IV
May 1 of each year, COUNTY will submit a bill to STATE
for t -ost of services performed under this agreement. STATE
will ..- purse COUNTY from snowmobile fund. Billing and reimbursement
can be mace monthly, at COUPITY optiorki "/j-
STATE, COUNTY, and FOREST SERVICE will annually (by June 30th
of each year) review and determine the scope of public services to
be pr;vided on this roadway. Modifications or amendments to this
agreement will be considered at such time.
VI
Nothing in this agreement shall be construed as obligating
the FOREST SERVICE, COUNTY, or STATE in the expenditure of funds
or for the future payment of monies in excess of appropriations
authorized by law.
VII
This agreement <<.'11 become .affective on the date subscribed
by the last signature and may b -: amended by mutual agreement of
all parties. This agreement shall be for .an indefinite period
of tire, but may be terminated by either party on thirty days
written notice. •

This Agreement, made and entered into by and between
Deschutes County (Department of Public Works), a political sub-
division of the State of Oregon, hereinafter referred to as
"County", and Central Oregon Pavers, Inc., an Oregon corporation,
hereinafter referred to as "Contractor ",
W I T N E S S E T H:
IT IS HEREBY AGREED by and between the parties above men-
tioned, for and in consideration of the mutual promises herein-
after stated as follows:
1. Effective Date. This Agreement is effective December
1, 1987.
2. Duration. This Agreement terminates at 11:59 p.m. on
June 30, 1983.
3. Renewal. This Agreement may be renewed upon notice of
County to Contractor each following July 1.
4. Contractor's Services. Contractor agrees to provide
snow removal and sanding services at the direction of the
Deschutes County Public Works Director or his designee.
5. Consideration. County shall pay Contractor on a fee -
for- service basis at the rates set forth in Exhibit "A ", attached
hereto and by this reference incorporated herein. The maximum
consideration authorized under this Agrement is $10,000.00 per
fiscal year.
6. Termination. This Agreement may be terminated by
County or Contractor upon 30 days advance written notice deliv-
ered to the other party.
7. Independent Contractor. Contractor is engaged hereby
as an independent contractor, and will be so deemed for purposes
of the following:
A. Contractor will be solely responsible for payment of
any Federal or State taxes required as a result of this
Agreement.
B. This Agreement is not intended to entitle Contractor to
any benefits generally granted to County employees.
Without limitation, but by way of illustration, the
benefits which are not intended to be extended by this
Agreement to the Contractor are vacation, holiday and
sick leave, other leaves with pay, tenure, medical and
dental coverage, life and disability insurance, over-

time, Social Security, Workers' Compensation, unemploy-
ment compensation, or retirement benefits (except
insofar as benefits are otherwise required by law if
the Contractor is presently a member of the Public
Employees Retirement System).
C. The Contractor is an independent contractor for pur-
poses of the Oregon Workers' Compensation law (ORS
Chapter 656) and is solely liable for any Workers'
Compensation coverage under this Agreement. If the
Contractor has the assistance of other persons in the
performance of this Agreement, the Contractor shall'
qualify and remain qualified for the term of this
Agreement as a direct responsibility employer under ORS
656.407. If the Contractor performs this Agreement
without the assistance of any other person, Contractor
shall execute a Joint Declaration with County absolving
County of any and all liability from Workers' Compensa-
tion provided in ORS 656.029(2).
8. Decication and Reports. Contractor shall not delegate
the responsibility for providing services hereunder to any other
individual or agency, and shall provide County with periodic
reports to County at the frequency and with the information
prescribed to be reported by County.
9. Constraints. Pursuant to the requirements of ORS
279.310 through 279.320 and Article XI, Section 10, of the Oregon
Constitution, the following terms an conditions are made a part
of this Agreement:
A. Contractor shall:
(1) Make payments promptly, as due, to all persons
supplying to Contractor labor or materials for the
prosecution of the work provides for in this
Agreement.
(2) Pay all contributions or amounts due the Indus-
trial Accident Fund from such contractor or
subcontractor incurred in the performance of this
Agreement.
(3) Not permit any lien or claim to be filed or
prosecuted against County on account of any labor
or material furnished.
(4) Pay to the Department of Revenue all sums withheld
from employees pursuant to ORS 316.167.
B. If Contractor fails, neglects or refuses to make prompt
payment of any-claim for labor or services furnished to

Contractor or a subcontractor by any person in connec-
tion with this Agreement as such claim becomes due, the
proper offices representing County may pay such claim
to the person furnishing the labor or services and
charge the amount of the payment against funds due to
become due Contractor by reason of this Agreement.
C. No person shall be employed for more than eight (8)
hours in any one day, or more than forty (40) hours in
any one week, except in cases of necessity, emergency,
or where the public policy absolutely requires it, and
in such cases the laborer shall be paid at least time
and one -half pay for all overtime in excess of eight
(8) hours a day and for work performed on Saturday and
on any legal holiday specified in ORS 279.334. How-
ever, when specifically agreed to under a written
labor- management negotiated labor agreement, the
laborer may be paid at least time and one -half pay for
work performed on martin Luther King, Jr.'s Birthday,
President's Day, or on any other legal holiday speci-
fied in ORS 187.020.
D. Contractor shall promptly, as due, make payment to any
person or partnership, association or coraoration
furnishing medical, surgical and hospital care or other
needed care and attention incident to sickness and
injury to the employees of Contractor, of all sums
which Contractor agrees to pay for such services, and
all monies and sums which Contractor collected or
deducted from the wages of Contractor's employees
pursuant to any law, contract or agreement for the
purpose of providing or paying for such services.
E. This Agreement is expressly subject to the debt limita-
tion of Oregon counties set forth in Article XI,
Section 10, of the Oregon Constitution, and is contin-
gent upon funds being appropriated therefore. Any
provisions herein which would conflict with law are
deemed inoperative to that extent.
10. Hold Harmless. Contractor shall be responsible for any
and all injury to any and all persons or property caused directly
by reason of any and all activities by Contractor in the perfor-
mance of the Agreement; and further agrees to indemnify, save
harmless and defend the County, its officers, agents and employ-
ees from and against all claims, suits, actions, damages, costs,
losses and expenses in any manner resulting from, arising out of,
or connected with any such injury.
11. Insurance. Contractor shall maintain comprehensive
general liability and property damage insurance in conjunction
with all services performed under this Agreement, in not less

than 8500,000 combined single limit. Contractor shall provide
County a certificate of insurance as described above, and naming
County,. its officers, agents and employees as an additional in-
sured. Contractor also shall furnish County evidence of auto-
mobile liability insurance of not less than $500,000 per occur-
rence, $200,000 per individual and $50,000 property damage.
Contractor shall notify County immediately upon notification to
Contractor that any insurance coverage required by the paragraph
will be canceled, not renewed or modified in any way.
12. Non- Di.77rimination. Contractor agrees that no person
shall, on the grcnds of race, color, creed, national origin,
sex, marital status, or age, suffer discrimination in the perfor-
mance of this Agreement when employed by Contractor.
13. Non- Anorooriation. In the event sufficient funds shall
not be appropriated for the payment of consideration required to
be paid under the Agreement, and if County has not funds legally
available for consideration from other sources, then County may
terminate this Agreement in accordance with Section 5 of this
Agreement.
14. Attorneys Fees. In the event an action, suit or
proceeding, including appeal therefrom, is brought for failure to
observe any of the terms of this Agreement, each party shall be
responsible for their own attorney's fees, expenses, costs and
disbursements for said action, suit, proceeding or appeal.

County or Contractor upon 30 days advance written notice deliv-

7. Independent Contractor. Contractor is engaged hereby
as an independent contractor, and will be so deemed for purposes
of the following:
A. Contractor will be solely responsible for payment of
any Federal or State taxes required as a result of this
Agreement.
B. This Agreement is not intended to entitle Contractor to
any benefits generally granted to County employees.
Without limitation, but by way of illustration, the
benefits which are not intended to be extended by this
Agreement to the Contractor are vacation, holiday and
sick leave, other leaves with pay, tenure, medical and

time, Social Security, Workers' Compensation, unemploy-
ment compensation, or retirement benefits (except
insofar as benefits are otherwise required by law if
the Contractor is presently a member of the Public
Employees Retirement System).
C. The Contractor is an independent contractor for pur-
poses of the Oregon Workers' Compensation law (ORS
Chapter 656) and is solely liable for any Workers'
Compensation coverage under this Agreement. If the
Contractor has the assistance of other persons in the
performance of this Agreement, the Contractor shall
qualify and remain qualified for the term of this
Agreement as a direct responsibility employer under ORS
656.407. If the Contractor performs this Agreement
without the assistance of any other person, Contractor
shall execute a Joint Declaration with County absolving
County of any and all liability from Workers' Compensa-
tion provided in ORS 656.029(2).
8. Delegation and Reoorts. Contractor shall not delegate
the responsibility for providing services hereunder to any other
individual or agency, and shall provide County with periodic
reports to County at the frequency and with the information
prescribed to be reported by County.
9. Constraints. Pursuant to the requirements of ORS
279.310 through 279.320 and Article XI, Section 10, of the Oregon
Constitution, the following terms an conditions are made a part
of this Agreement:
A. Contractor shall:
(1) Make payments promptly, as due, to all persons
supplying to Contractor labor or materials for the
prosecution of the work provides for in this
Agreement.
(2) Pay all contributions or amounts due the Indus-
trial Accident Fund from such contractor or
subcontractor incurred in the - performance of this
Agreement.
(3) Not permit any lien or claim to be filed or
prosecuted against County on account .of any labor
or material furnished. •
(4) Pay to the Department of Revenue all sums withheld
from employees pursuant to ORS 316.167.
B. If Contractor fails, neglects or refuses to make prompt
payment of any claim for labor or services furnished to

Contractor or a subcontractor by any person in connec-
tion with this Agreement as such claim becomes due, the
proper offices representing County may pay such claim
to the person furnishing the labor or services and
charge the amount of the payment against funds due to
become due Contractor by reason of this Agreement.
C. No person shall be employed for more than eight (8)
hours in any one day, or more than forty (40) hours in
any one week, except in cases of necessity, emergency,
or where the public policy absolutely requires it, and
in such cases the laborer shall be paid at least time
and one -half pay for all overtime in excess of eight
(8) hours a day and for work performed on Saturday and
on any legal holiday specified in ORS 279.334. How-
ever, when specifically agreed to under a written
labor - management negotiated labor agreement, the
laborer may be paid at least time and one -half pay for
work performed on martin Luther King, Jr.'s Birthday,
President's Day, or on any other legal holiday speci-
fied in ORS 187.020.
D. Contractor shall promptly, as due, make payment to any
person or partnership, association or corporation
furnishing medical, surgical and hospital care or other
needed care and attention incident to sickness and
injury to the employees of Contractor, of all sums
which Contractor agrees to pay for such services, and
all monies and sums which Contractor collected or
deducted from the wages of Contractor's employees
pursuant to any law, contract or agreement for the
purpose of providing or paying for such services.
E. This Agreement is expressly subject to the debt limita-
tion of Oregon counties set forth in Article XI,
Section 10, of the Oregon Constitution, and is contin-
gent upon funds being appropriated therefore. Any
provisions herein which would conflict with law are
deemed inoperative to that extent.
10. Hold Harmless. Contractor shall-be responsible for any
and all injury to any and all persons or property caused directly
by reason of any and all activities by Contractor in the perfor-
mance of the Agreement; and further agrees to indemnify, save
harmless and defend the County, its officers, agents and employ-
ees from and against all claims, suits, actions, damages, costs,
losses and expenses in any manner resulting from, arising out of,
or connected with any such injury.
11. •Insurance. Contractor shall maintain comprehensive
general liability and property damage insurance in conjunction
with all services performed under this Agreement, in not less

than $500,000 combined single limit. Contractor shall provide
County a certificate of insurance as described above, and naming
County, its officers, agents and employees as an additional in-
sured. Contractor also shall furnish County evidence of auto-
mobile liability insurance of not less than $500,000 per occur-
rence, $200,000 per individual and $50,000 property damage.
Contractor shall notify County immediately upon notification to
Contractor that any insurance coverage required by the paragraph
will be canceled, not renewed or modified in any way.
12. Non - Discrimination. Contractor agrees that no person
shall, on'the grounds of race, color, creed, national origin,
sex, marital status, or age, suffer discrimination in the perfor-
mance of this Agreement when employed by Contractor.
13. Non- Amaromriation. In the event sufficient funds shall
not be appropriated for the payment of consideration required to
be paid under the Agreement, and if County has not funds legally
available for consideration from other sources, then County may
terminate this Agreement in accordance with Section 5 of this
Agreement.
14. Attorneys Fees. In the event an action, suit or
proceeding, including appeal therefrom, is brought for failure to
observe any of the terms of this Agreement, each party shall be
responsible for their own attorney's fees, expenses, costs and
disbursements for said action _suit, proceeding or appeal.

In addition to the described work in the agreement,
CONTRACTOR will provide snow plowing and sanding on
Spring River Road /South Century Drive from the Sunriver
Entrance to the Forest Service Boundary on an as needed
basis.
It is understood and agreed the typical services
under normal weather conditions will not exceed one half
hour per day. It is further agreed that under abnormal
weather conditions, Deschutes County authorizes
contractor to continue needed services on said roads in
accordance with Deschutes County Snow and Ice Plan.
Contractor shall submit documentation of dates and
times of service to the Deschutes County Public Works
Department for purposes of processing payment. The rate
of payment for the above services shall coincide with
the hourly rate in the original agreement.

This Agreement, made and entered into by and between
Deschutes County (Department of Public Works), a political sub-
division of the State of Oregon, hereinafter referred to as
"County", and Mt. Bachelor, Inc., an Oregon corporation, herein-
after referred to as "Contractor ",
W I T N E S S E T H:
IT IS HEREBY AGREED by and between the parties above men-
tioned, for and in consideration of the mutual promises herein-
after stated as follows:
1. Effective Date. This Agreement is effective December
1, 1987.
2. Duration. This Agreement terminates at 11:59 p.m. on
June 30, 1988.
3. Renewal. This Agreement may be renewed upon notice of
County to Contractor each following July 1.
4. Contractor's Services. Contractor agrees to provide
snow removal and sanding services at the direction of the
Deschutes County Public Works Director or his designee.
5. Consideration. County shall pay Contractor on a fee -
for- service basis at the rates set forth in Exhibit "A ", attached
hereto and by this reference incorporated herein. The maximum
consideration authorized under this Agrement is $25,000.00 per
fiscal year.
6. Termination. This Agreement may be terminated by

The person that is on duty for the weekend can be reached at their
home telephone, and if there is no answer, they can be reached by
calling their pager number. The person on call for the weekend will
notify the Sheriff's Department by calling 911 or 338 -0170 on the last
work day of each week, or, if a holiday occurs in the middle of the
week, a call will be made the day before the holiday.
Each supervisor will have the authority to make the decision necessary
in order to correct whatever the problem may be.
