WHEREAS, the County Surveyor is responsible for the

WHEREAS, it is necessary and convenient to use the

WHEREAS, a form of government corner field services agree-
ment has been developed by the County Surveyor to allow private
surveyors to set and preserve government corners; and
WHEREAS, it being in the best interests of the County to
authorize the County Surveyor to contract with said private
surveyors for such services; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That the Deschutes County Surveyor is authorized
to enter into government corner field services agreements on
behalf of Deschutes County in substantially the form marked
Exhibit "A ", attached hereto and by this reference incorporate
herein, with licensed land surveyors for the setting and restora-
tion of government corners.

IN THE MATTER OF GOVERNMENT CORNER FIELD SERVICES
FOR THE DESCHUTES COUNTY SURVEYORS OFFICE
Whereas DESCHUTES COUNTY enacted Ordinances to provide services
for land corner preservation, and
Whereas DESCHUTES COUNTY established a public land corner
preservation fund and assigned it to the Deschutes County Surveyor
(herein referred to as County Surveyor), and
Whereas the County Surveyor sees the benefit to the public to
purchase selected government corner field services from the
undersigned registered Professional land Surveyor of Oregon
(hereinafter referred to as Land Surveyor) related to government
corners under certain conditions, now therefore,
The parties agree as follows:
1. If during the process of performing a land survey for a
client, the Land Surveyor locates a government corner that
is in danger of being lost due to decay of monumented
corner or an inadequate monument, the Land Surveyor may
contact the County Surveyor to arrange for government
corner field services hereunder.
2. As part of the review by the County Surveyor to determine
whether government corner field services will be purchased
from Land Surveyor, the following things will be
considered:
A. The Land Surveyor must provide a copy of the
respective government corner records and restored
corner records, assembled in chronological order, to
the County Surveyor.
B. The Land Surveyor must provide a completed visitation
form to the County Surveyor showing the evidence found
about the corner.
C. The Land Surveyor must provide his /her client's name
to the County Surveyor for the survey being performed
that is related to the proposed government corner
field services.
D. The Land Surveyor may be asked for further
information.
3. The County Surveyor reserves the right to refuse an offer
to purchase government corner field services for the
identified corner.

4. Upon a favorable review of the information submitted by the
Land Surveyor, the County Surveyor may request that a
Deschutes County Purchase Order be drawn to have the Land
Surveyor perform government corner field services on the
specific government corner(s) according to the terms of the
purchase order.
5. On the issuance of a Deschutes County Purchase Order signed
by the County Surveyor, the following government corner
field services will be performed:
A. Services to be done by County Surveyor's Office:
a) Issue to the Land Surveyor an aluminum "Deschutes
County Surveyor Office" cap for the corner(s).
b) Provide the Land Surveyor a standard restored Corner
form on which the land Surveyor will show the
government corner history of the corner.
B. Services to be done by Land Surveyor:
a) The Land Surveyor will mark the cap and set out
reference ties in accordance with the standards set by
the County Surveyor's Office.
b) Upon completion of the government corner field
services, the Restored Corner form must be completed
by the Land Surveyor, sealed with the Oregon
Registered Professional Land Surveyor stamp and filed
with the Deschutes County Surveyor's Office as
required by law. The Restored Corner form must be in
permanent black ink or a permanent written process
showing the field measurements observed to all
existing corner evidenced such as monuments, bearing
trees, etc. and the new bearing tree or reference
points marked.
6. Payment will be approved when the Land Surveyor has filed
the Restored Corner form and submitted an invoice for
services to the Deschutes County Surveyor. All or any
portion of payment may be withheld if the government corner
field services and Restored Corner form are not completed
according to the Deschutes County Surveyors Office
Standards.
7. The County will pay Land Surveyor a flat rate for
government corner field services performed (which includes
completing the Restored Corner Form) as follows:
A. It is assumed the Land Surveyor is on site and no
travel expenses will be allowed.

B. For remonumentation services for a section corner or
quarter corner at a location other than a paved road,
a fee of Eighty Dollars and No /100 ($80) per corner
which includes completion of the Restored Corner form.
C. For remonumentation service for a Section Corner or
Quarter Corner located in a paved road, a fee of One
hundred twenty five and No /100 Dollars ($125) per
corner which includes completion of the Restored
Corner form.
8. Land Surveyor agrees that the performance of the
obligations are the Land Surveyor's sole risk and that the
Land Surveyor shall indemnify Deschutes County, its
officers, agents, and employees, against all suits, actions
or proceedings and hold them harmless from, any and all
liability for damages, costs, losses and expenses resulting
from, arising out of, or in anyway connected with Land
Surveyor's services, or from Land Surveyor's failure to
perform fully hereunder, and Land Surveyor's further agrees
to defend Deschutes County, its officers, agents, and
employees, against all suits, actions or proceedings
brought by any third party against them for which
contractor would be liable hereunder.
I, THE UNDERSIGNED LAND SURVEYOR, have read the above conditions
for field services and agree that no field services will commence
until a signed and numbered purchase order is issued by the County
Surveyors Office.
