Also present were Rick Isham, County-'Legal Counsel, Karen Green, Assistant Legal Counsel, and Craig Smith, Planning Director. 1. APPOINTMENT TO VANDEVERT ACRES SPECIAL ROAD DISTRICT Before the Board was a request from Gene Tedrick to appoint him to the Board of Directors for the Vandevert Acres Special Road District. PRANTE: Move to approve. THROOP: Second the motion. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES 2. PERSONNEL GENERAL POLICIES Before the Board was signature of Policy No. 88-03-01, relating to temporary/seasonal employment and Policy No. 88- 03-02, relating to reimbursement of tuition fees. ADMINISTRATIVE GENERAL POLICIES Before the Board was signature of Policy No. 88-03-03, a policy relating to nonoperational expenses, Policy No. 88- 03-04, relating to petty cash, and Policy No. 88-03-05, relating to County credit card usage. VOTE : PRANTE : YES 00" 0-09 f THROOP: YES MAUDLIN: YES APPEAL OF LOT OF RECORD DETERMINATION Before the Board was an appeal of an administrative decision that had been made on a lot of record application by Mr. Dale Rath. He owns a five-acre parcel on Xenith Road in Redmond which was determined to be an unbuildable, illegally created parcel. Mr. Rath asked the Board to overturn the Planning Division's decision on the basis that the road was an accepted County road, the residents received their mail at the addresses on Xenith Road, and building permits had been issued to other lots in this "subdivision" previously. Mr. Rath stated that the County in essence overturned their own ordinance by issuing these building permits to "illegal" lots. Mr. Rath had no idea that the lots were unbuildable and has been paying taxes assessed on a buildable lot. Craig Smith explained to the Board that the zoning in this area had changed in 1979 to a 10-acre minimum (most parcels here are 5 acres). In order to form legal, buildable lots, Craig explained that the owners of the lots in this subdivision would need to apply for a variance to the minimum lot size, a variance to the road standards, and then an application for a subdivision. Barry Maroni, 9498 N.E. Crooked River Drive, Terrebonne, also owns a parcel in this subdivision. He asked the Board if timing of the recording of deeds had any bearing on whether a lot was legal or not. Karen Green stated that if the lots are conveyed prior to adoption of the subdivision/ partition ordinance, that they would be legal. She will be checking into the lots to determine when they were originally conveyed as separate lots. THROOP: I would move that the Mr. Rath appeal be denied and that we request CDD to work closely with the owners of the lots to set up an expeditious process to get this resolved. PRANTE: Second. APPOINTMENT TO MENTAL HEALTH ADVISORY COMMITTEE Before the Board was a request from the Mental Health Department to appoint Martha Mann to the Mental Health Advisory Committee. THROOP: I'll move the appointment of Martha Mann. PRANTE: I'll second that. VOTE: THROOP: YES PRANTE: YES MAUDLIN: YES 7. ORDER NO. 88-018 Before the Board was signature of Order No. 88-018, an order initiating formation of the Deschutes County 9-1-1 County Service District and setting a final hearing date for April 13, 1988. WEEKLY WARRANT VOUCHERS Total amount of weekly bills: $76,547.23 THROOP: I'll move the approval of the weekly warrant vouchers suject to review. PRANTE: Second. INDEMNITY AGREEMENT FOR PRO-CANAM RACING Before the Board was signature of an indemnity agreement for Pro-CanAm Racing for their yearly motorcycle race which would involve portions of County roads.
