RESOLUTION NO. 88 -049
WHEREAS, Deschutes County Department of Public Works petitioned the
Board of County Commissioners of Deschutes County, Oregon, to vacate a
portion of Burgess Road, located in Deschutes County, Oregon; and
WHEREAS, the Board of County Commissioners has determined it to be
in the public interest to consider such vacation; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That it is the intent of the Board of County
Commissioners of Deschutes County, Oregon, to vacate a portion of
Burgess Road described in Exhibit "A ", attached hereto and by this
reference incorporated herein, because it appears the road is no longer
needed for public use, and will not be needed in the future.
Section 2. That the County Engineer shall file an Engineer's
Report with the Board of Commissioners, describing the ownership and
uses of property to be vacated, and whether the vacation would be in the
public interest, within fourteen (14) days of the date of this
Resolution.

PARCEL TO BE VACATED

A tract of land located in the Northwest Quarter of the Northeast
Quarter of Section 2, Township 22 South, Range 10 East of the
Willamette Meridian, Deschutes County, Oregon, described as follows:
Commencing at the North Quarter corner of said Section 2, a B.L.M.
brass cap monument; thence South 89° 45' 03" East 303.86 feet,
along the North line of said Section 2, to the Point of Beginning;
thence 123.69 feet along the arc of a 110.00 foot radius curve to
the right, the chord of which bears South 34° 25' 32" West 117.28
feet to the ncrthwest corner of Lot 1, Block 1, Glenwood Acres;
thence along the northerly line of said Lot 1, North 66° 38' 19"
East 109.00 feet; thence continuing along the northerly line of
said Lot 1, 168.81 feet along the arc of a 686.80 foot radius curve
to the right, the chord of which bears North 73° 40' 48" East 168.38
feet to a point on the westerly right -of -way line of Huntington
Road; thence North 06° 29' 42" East 5.38 feet, along the westerly
right -of -way line of Huntington Road, to a point on the North line
said Section 2; thence North 89° 45' 03" West 195.97 feet, along
the North line of said Section 2, to the Point of Beginning.
SUBJECT TO the reservation of a utilities easement in and upon all
of the property; for the purposes of continuing, constructing,
installing, maintaining, repairing, reconstructing, replacing,
enlarging and altering; wires, poles, pipes, lines, structures,
casings supports, equipment, facilities and appurtenances; at the
present and in the future; necessary or conven.ent; to Deschutes
County, a political subdivision of the State of Oregon, its agents,

ENGINEER'S REPORT FOR PUBLIC ROAD VACATION

TO: BOARD OF COUNTY COMMISSIONERS
FROM: DESCHUTES COUNTY ENGINEER
SUBJECT: ENGINEER'S REPORT RELATING TO THE VACATION OF
A PORTION OF BURGESS ROAD, DESCHUTES COUNTY,
OREGON.
1. Property proposed for vacation is owned by the
Deschutes County and is used for the following: The
parcel is no longer being used for road purposes due to
the reconstruction and realignment of Burgess Road.
2. It is the Engineer's assessment that the proposed
vacation is in the public interest because: The parcel
will benefit the adjoining property and is not being
used by Deschutes County.
3. The following other pertinent facts were considered in
making this report: A utility easement is being
retained on the property proposed to be vacated. The
land is not needed for futu . road purposes.
