Chairman Maudlin called the meeting to order at 10:03 a.m. Board
members in attendance were Dick Maudlin, Tom Throop, and Lois
Bristow Prante. Also present were Rick Isham, County Legal
Counsel, Karen Green, Assistant Legal Counsel, Larry Rice, Public
Works Director, and Craig Smith, Planning Director.
The first item before the Board was to consider a challenge to
Commissioner Throop hearing the appeal of the Ward Road Partners
project. Gary Knight had challenged commissioner Throop for bias
on this appeal at the first hearing which was held on August 10,
1988. At this challenge hearing, Mr. Knight was not present.
Nancy Peterson of 61275 Ward Road, Bend, Oregon, stated that Don
Bauhof er had told her that Commissioner Throop was in f avor of
the proposal/appeal, however, she was not challenging him on his
ability to hear the matter.
Commissioner Throop explained that as the liaison to the Public
Works Department, he had made contact with Don Bauhofer to see if
some kind of agreement could be made. Commissioner Throop stated
that this type of mediation was common.
There was considerable discussion regarding conditions for the
road improvements in connection with the Ward Road development.
Commissioner Maudlin suggested that $1,000 be submitted to the
County f or each lot as the lots sold, that a bond be posted for
completion of the interior road, and that repair of the road
from the northern corner of Ward to Ropp be undertaken by the
developer at his discretion. Commissioner Throop asked to add a
finding that the Board of Commissioners were working on the
major road improvements policies and that Ward Road was included
in that plan as a high priority. He also wanted to include a
finding that there would not be excessive demand on Ward Road if
a weight limit were to be placed on it.
THROOP: I'll move that the hearings officer's decision be
sustained and that condition #14, condition #17, and condition
#18 be stricken, that there be a condition included that covered
the road improvements that Dick described which includes the
method for collecting those dollars and the sections of the road
which would be improved, and that there be a second condition
added which would find that the development would not create
excessive demand on services as long as there is an appropriate
weight limit and recognizing that this Board's goal, through the
MRCIP, is to produce the road improvements necessary to eliminate
that weight limit in 1990/91 as we described. I LME Ci
