Chairman Maudlin called the meeting to order at 10:05 a.m. Board
members in attendance were Dick Maudlin, Lois Bristow Prante, and
Tom Throop. Also present were Rick Isham, County Legal Counsel,
Karen Green, Assistant Legal Counsel, Craig Smith, Planning
Director, and Larry Rice, Director of Public Works.
1. CONSENT AGENDA
Consent agenda items before the Board were item #1,
signature of personal services contracts for prenatal
services with Daniel Brown, William Claridge, Stephen Knapp,
Stephen Mann, and Mountain View Women's Clinic; #2,
signature of hospital contract with Pioneer Trail; #3,
appointment of Robert Berryhill to Special Road District #8;
#4, signature of an indemnity agreement for Eastmont Church
Eagles Run; #5, signature of Order No. 88-057, refunding
taxes; #6, approval of work crew program for Corrections
Division; #7, chair signature on maintenance agreement with
Diverse Integrated Systems for computer equipment in Clerk's
office; #8, chair signature of liquor license renewals for
7-11 (South Highway 97, Bend), Woodmark Bowl (LaPine), Rock
Springs Guest Ranch (Bend), Three Creeks Lake Store
(Sisters), Casa De Ricardo (Sunriver), Deschutes Fly and
Tackle (LaPine), Mt. Bachelor's Nordic Lodge, Main Lodge,
MiniLodge, Summit Lift, and Sunrise Lodge (Bend), LaPine Hi -
Way Center (LaPine).

2. PUBLIC HEARING: WARD ROAD PARTNERS
Before the Board was a public hearing on an appeal of the
hearings officer's decision on a conditional use and
tentative plat application. The applicants were appealing
some of the conditions placed by the hearings officer for
approval of their applications.

George Read, Associate Planner, presented the staff report.
He stated that the hearings officer had approved the
applications subject to some criteria to ensure that a
hardship would be not created on existing roads that served
the area. Some of the conditions were that construction
vehicles were not allowed on Ward Road, that $500 per site
be submitted to the County to assist in road improvement
efforts, and that no building permits would be issued until
Ward Road was reconstructed.
Larry Rice testified on the appeal, stating that there were
no roads in the area that could handle the additional
traffic that would be created by the proposed development
and that there would be adverse effects and demands on
public facilities. He stated that much work would need to
be done on Ward Road to be able to accommodate the traf f ic
and that the developer should be responsible for half of the
cost of reconstruction for a certain stretch of the road.
Don Bauhofer, speaking on behalf of the applicants, argued
that Ward Road was not the only access to the property and
that there was another adequate County road to serve the
development. Mr. Bauhofer also stated that his company
would be willing to pay half the cost of the required road
improvements but that they would have to be able to sell
their lots before they could improve Ward Road.
Nancy Peterson of 61275 Ward Road, Bend, spoke in
opposition. She felt that Billadeau Road was not an
adequate road to serve the facility and that it would not
be used as an access anyway. She also expressed her
concerns over the condition of Ward Road.
Robert Gordon of 61365 Ward Road, Bend, spoke in opposition.
He asked that the Board require Ward Road to be improved
before construction began due to safety considerations.
Melinda Foster of 61345 Ward Road, Bend, spoke in
opposition. She also expressed concern over the safety on
Ward Road and asked the Board to place a great deal of
consideration on the safety issue.
Larry Rice clarified that the number of cars on Ward Road
was not the primary concern, but the wear and tear on the
roads. Don Bauhofer also pointed out that the number of
cars would not increase for the first couple of years
because that would be their preparation and development
stage; no new residents would be added.
The Board continued the public hearing to Monday, August 15,
at 10 a.m. for a decision on this appeal.

3. PUBLIC HEARING: ORDER NO. 88-047
Before the Board was a public hearing to consider Order No.
88-047, an order setting a f inal hearing on the annexation
of property to the Deschutes County Rural Fire Protection
District #1, known as the Chase Annexation. No one from the
audience wished to testify.

4. ORDINANCE NO. 88-008
Before the Board was a second reading and adoption of

approving a zone change application by Fred and Judy
Gunzner from EFU-80, Exclusive Farm Use, to SM, Surface
Mining, and acceptance of a conservation easement.

ACCEPTANCE OF BIDS FOR OLD COUNTY SHOP PROPERTY
Three bids had been received for three separate lots. Two
were submitted by Bear Country Petroleum, and one was
submitted by Cascade Heating. Actual agreements still
needed to be drafted.

old County shop property with wording Mike Maier is working
on.
