1988-28912-Minutes for Meeting December 06,1988 Recorded 12/13/198888-28912 0095 0065 PUBLIC HEARING t r:+ 52 SURFACE MINING INVENTORY tr, 10:00 a.m., December 6, 1988 Deschutes County Administration Building ` Chairman Maudlin called the meeting to order at 11:06 a.m. Board members in attendance were Dick Maudlin, Lois Bristow Prante, and Tom Throop. Also present were Karen Green, Assistant Legal Counsel; Craig Smith, Planning Director; and Chuck McGraw, Associate Planner. Before the Board was a continuation of the public hearing on Ordinance No. 88-039, adoption of surface mining inventory. Craig Smith gave the staff report. He stated that the first step of the Goal 5 process for review of mineral and aggregate sites in Deschutes County was the adoption of an inventory. Based upon the hearings that had taken place since May of 1988, a final list of sites had been compiled. The next step would be the ESEE analysis and the final step would be the zoning of the sites. No mining could take place on sites that were not already operating mining sites until this process has been completed. Sally Wegner, 60675 Bobcat Road, Bend, representing the Southeast Property Owners Association, stated her concern that the Rose site was on the inventory even though the owners had not submitted evidence as to the quality and quantity of the site by the deadline that the County had given them. She requested that the hearing be continued until the Southeast Property Owners Association's attorney could be present. Commissioner Maudlin responded that if the site was not put on the inventory, the owners would be able to request a zone change at any time in the future. By putting the Rose site on the inventory now, the owners would only have until the June 1989 deadline to submit further evidence, and then the site would be zoned according to the information submitted. That way, the surrounding property owners would know what they could expect in the near future instead of waiting until the Rose site owners decided to request rezoning of their property. Karen Green recommended that the hearing not be postponed since the attorney for the Southeast Property Owners Association had already given testimony and could have attended this public hearing. Jim Long, 60535 Bobcat Road, Bend, stated he felt the Commissioners had the authority to leave the Rose site off the inventory. Commissioner Throop stated that since there was evidence of rock at the site, it could not be left off the inventory. The only PUBLIC HEARING: PAGE 1 DECEMBER 6, 1988 & N 0095 0006 other option was to place the site under 1(b) of the inventory which would put the timeline for analysis and zoning at the discretion of the site owner instead of during the timelines established for the rest of the inventory sites. Commissioner Maudlin stated that he did not want the process to take any longer than was necessary and would like to see all of the inventory sites go through the process at the same time so that the surrounding property owners would know what they could expect. From previous written reports and testimony, the Commissioners determined that there was evidence of a significant resource on the disputed Rose site and that it should, therefore, be on the inventory. However, evidence as to the quality of the resource would have to be brought forward during the ESEE process in order for the Rose site to be zoned for surface mining.
