WORK SESSION MINUTES
DESCHUTES COUNTY BOARD OF COMMISSIONERS
January 23, 1989
Chairman Maudlin called the meeting to order at 10:00 a.m. Board
members in attendance were Dick Maudlin, Lois Bristow Prante and
Tom Throop. Also present were Rick Isham, County Legal Counsel;
Craig Smith, Planning Director; Larry Rice, Director of Public
Works.
1. BUSINESSES ON ROCKING HORSE ROAD
Mr. Dodge, the Rocking Horse Road property owner, his realtor,
and a prospective buyer came before the Board of Commissioners
to discuss whether commercial businesses could legally
continue to operate on his property. Craig Smith reported
that the property was zoned RR10 which did not allow any
commercial or industrial uses. In 1980 a permit was issued
allowing a rabbit slaughtering and processing business only
because it was directly tied to a current agricultural use on
the property which was raising rabbits. The owner stated he
did not check with the Planning Department when he
discontinued his rabbit business and started leasing his
buildings to other businesses. He said he did get a permit
to build a third building in which he housed his construction
equipment, however, there was no record of it in the Planning
Department. The Commissioners asked the Planning Director and
Legal Counsel to consider the legal options available and to
report back to them. Chairman Maudlin postponed further
discussion until the February 6, 1989, Board work session.
2. RESOLUTION 89-007 LEASE OF JOHN DEERE FRONT-END LOADER
Before the Board was signature of Resolution 89-007,
authorizing the lease of a John Deer Front-End Loader.

3. REDEMPTION OF PROPERTY BY VERN BELT
Before the Board was signature of a Bargain and Sale Deed and
the acceptance of payment from Vern Belt for all encumbrances
of record, which allowed him to redeem his property.

PRANTE: I would move that we accept the payment and allow
redemption.

COUNTY SURVEYOR
The Board of Commissioners notified Jeff Kern, the County
Surveyor, that they felt it would be an ethics law violation
to allow his private firm to do the surveying work discussed
in his report to the Commissioners. Commissioner Prante
stated she would be contacting the Ethics Commission for a
decision on the issue and Rick Isham said he would have a
legal opinion on it by the end of the week. The Commissioners
told Jeff Kern that any ideas or changes he felt were needed
in the operation of the Surveyor's duties would be most
appropriately brought up during the next cycle of budget
committee meetings, since the budget was already set for this
year. Commissioner Throop mentioned that the 1987 State
Legislature gave authority to the Counties to decide whether
the Surveyor should continue to be elected or appointed.
SOUTHWEST LANDFILL REPLACEMENT
Larry Rice gave a report from the Solid Waste Advisory
Committee on conversion of the Southwest Landfill to a
transfer station. He stated that the County had received a
one-year extension from the U.S. Forest Service to close the
site. The Commissioners agreed to contact the U.S. Forest
Service to see if continued use of the site would possible if
the landfill were closed and the site used only as a transfer
station. Various alternatives were discussed regarding how
it would be determined which franchises would be moving the
refuge from the transfer station. Larry said he would discuss
the legality of the various alternatives with Karen Green,
Assistant Legal Counsel.
THROOP: I'll move we authorize Public Works to proceed and
begin implementation and then keep us posted on all
of the actions to implement closure and
establishment of a transfer station and involve us
at every major policy decision step.
