An Order Finding that Livestock
Owned by Joel Lusby was Killed by
a Dog, Establishing the Value of
the Livestock, and Ordering a
Warrant Drawn to Pay Livestock
Loss Claim.
ORDER NO. 89-040
WHEREAS, on June 1, 1989, Joel Lusby filed a claim, pursuant
to ORS 609.170, for the loss of livestock, namely a ewe, as a
result of a dog attack; and
WHEREAS, the Board reviewed and considered the evidence
presented by Joel Lusby in support of their livestock loss claim;
and
WHEREAS, the Board received and considered additional
evidence submitted by the Crook County Extension Office relating
to the value of Joel Lusby's ewe; and
WHEREAS, the Board of County Commissioners finds that:
1. A ewe owned by Joel Lusby was killed as the result of a dog
attack; and
2. Evidence was presented that the ewe's value as livestock was
$80.00; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. The livestock loss claim of Joel Lusby is
allowed in the amount of $80.00.
Section 2. The Deschutes County Treasurer shall issue a
check from the Deschutes County Animal Control Fund made payable
to Joel Lusby, in the amount of $80.00.
Section 3. Deschutes County Legal Counsel shall take
appropriate action to collect $80.00 from the owner of the dog or
dogs responsible for the attack on the ewe owned by Joel Lusby.
