Call to order
Chair Prante called the meeting to order at 6:02 P.M. Commissioner
Throop and Commissioner Maudlin were also in attendance. Staff
members present were Craig Smith, Planning Director, Karen Green,
Legal Counsel, Chuck McGraw, Planning Staff, and Sue Stoneman,
recorder.
Public Hearing on Site 394
Chair Prante explained the purpose and procedures of the hearing.
She then asked for any disclosures of bias or conflict. There were
none. It was noted that there was no staff report ready for
presentation at this time. Chair Prante then called for comments
in favor.
Robert Windlinx stated that they have a site behind the weigh
station south of Bend which borders on the northeast and south side
of the state cinder pit. They have presented a map and legal
description tonight of the proposed cinder pit. They have talked
to Don Kerr, their closest neighbor, who was concerned about having
the entire taxlot zoned SM. The taxlot is 460 acres and it borders
Mr. Kerr's property. Mr. Kerr had indicated to him that he would
have no objection as long as they defined the area around the
cinder pit. As long as they have a meets and bounds description
of the mining area, they can zone it separately.
Commissioner Throop disclosed that his wife, Caryn Throop, works
for Mr. Kerr. She had mentioned that she had a conversation with
Mr. Kerr, he interjected indicating he was not permitted to discuss
this action. They did not continue the conversation.
Other Business
Dave Jaqua, attorney representing the applicant on site 322, came
forward. He asked what the process and procedure would be for the
hearing on this site. Craig Smith responded that they will
renotify all of the other sites and the decision has not yet been
made whether or not to renotify the other sites that have already
been heard. They will place a large ad in the paper providing
community notification. There will be some new hearings but the
dates have not been established. There was some discussion of
possible hearing dates in July, the 5th, 6th, 7th, 12th, or 13th
are possible hearing dates. They will first establish what sites

did not receive adequate notice and reschedule hearings
accordingly.
Craig Smith announced that they have a field trip scheduled for
Tuesday morning of some of these sites.

Being no further business, the meeting was adjourned at 6:35 PM.
