ORDER NO. 89-087
WHEREAS, on the 4th day of October, 1989, the Board of
County Commissioners held a hearing in the Deschutes County
Administration Building, Bend, Oregon, on the issue of whether or
not a certain Samoyed dog kept by Marvin Saul engaged in the
killing, wounding, injuring or chasing of livestock; and
WHEREAS, any dog not under the control of its owner or
keeper found chasing livestock not on the property of such owner
or keeper shall be prima facie deemed to be engaged in killing,
wounding or injuring livestock; and
WHEREAS, Jon Sholes, Larry Chadwell, Mary Chadwell, Bessie
Hustead, Marvin Saul and Debra Saul offered testimony before the
Board of County Commissioners and the Board having considered the
evidence and testimony, and being fully informed in the premises;
and
WHEREAS, the Board finding that a certain Samoyed dog kept
by Marvin Saul while on the premises of Larry Chadwell and not
under the control of its owner or keeper on or about September
17, 1989, engaged in the chasing of livestock; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That the certain dog described as a Samoyed dog
owned by Marvin Saul's son in the possession of the Deschutes
County Humane Society Shelter be killed in a humane manner.
Section 2. That the recording secretary
