Chair Prante called the meeting to order at 10 a.m. Board members
present were Dick Maudlin and Lois Bristow Prante. Also present
were Rick Isham, County Legal Counsel and Larry Rice, Director of
Public Works.

CONSENT AGENDA
Consent agenda items before the Board were: #1, signature of
Termination Agreement with LaPine Preschool for Handicapped
Children; #2, signature of Development Agreement for Larry and
Elizabeth Pool; #3, signature accepting Declaration of
Dedication from the Mackie's; #4, signature of Development
Agreement for Chase Industries, Durus Division.

PUBLIC HEARING: ORDER 89-085 TRANSFER OF PROPERTY TO BEND
METRO PARK AND RECREATION DISTRICT
Before the Board was a Public Hearing on the transfer of
property to the Bend Metro Park and Recreation District
without consideration. The Board of County Commissioners
determined that Deschutes County no longer needed the property
for public use. No one testified against the transfer of
property.
Vince Genna, Director of Bend Metro Park and Recreation
District, testified that he felt that they would be able to
do several things with the property, i.e. abating the dust
problem, putting the property into turf, and using it for
recreational activities like the old city dump property which
was being used as an athletic complex.
Chair Prange closed the public hearing.
MAUDLIN: I would move signature of Order 89-085 and authorize
signature of appropriate deed transfer.

3. ORDINANCES 89-024 AND 89-025, PLAN AMENDMENT AND ZONE CHANGE
FOR THE RUSSELL'S
Before the Board was signature of Ordinance 89-024 amending
Ordinance No. PL-20, the Deschutes County Year 2000
Comprehensive Plan to change the designation of certain
property from Forest to Rural Industrial; and Ordinance 89-
025, amending Ordinance No. PL-15, Deschutes County Zoning
Ordinance, changing the Surface Mining Zone designation to
Rural Industrial with a limited use combining zone on a 11.9
acre parcel of property owned by Vic and Vickie Russell.
A public hearing was held before the Board of County
Commissioners on July 19, 1989, where the Board approved
rezoning of the property from Surface Mining to Rural
Industrial.

readings by title only.

4. SALE OF PROPERTY TO TERRY LYNCH
Before the Board was approval of the sale of Lot 1 Block 185,
Third Addition to Bend Park, City of Bend, to Terry Lynch for
$4,000.

5. RESOLUTION 89-084, PROCLAIMING RECYCLING AWARENESS WEEK AND
RESOLUTION 89-086, DECLARING CHILDREN'S DAY
Before the Board was signature of. Resolution 89-084,
proclaiming the week of October 7 to October 15, 1989 as
Recycling Awareness Week and the month of October 1989 as
Recycling Awareness Month in Deschutes County, Oregon; and
Resolution 89-086 declaring Tuesday, October 10, 1989, as
Children's Day in Deschutes County, Oregon.

BUILDING PERMIT FOR MIKE MCDANIEL
Mike McDaniel came before the Board to indicate that he had
received letters from the property owners surrounding his
property. One property owner did not have a problem with his
building, and the other property owner indicated several
problems. He had not been able to reach him by telephone.
Mr. McDaniel said that Mr. Johnson, owner of the white rental
house, wrote a letter indicating several problems--one of
which referred to Mr. McDaniel's access to Mr. Johnson's road.
Mr. McDaniel said that the road in question was not owned by
Mr. Johnson. Bert Merrifield, 20184 Reed Lane, said he was
the owner of the road in question and had the deed to it. Mr.
Merrifield said that he owned the property north of the
proposed building and had no problem with the building.
Commissioner Prante said that if the building were painted in
earth colors and landscaped and fenced so that the building
were hidden from surrounding homes, she wouldn't have a
problem approving the building permit.
MAUDLIN: I would move that we allow the placement of the
building subject to the conditional permit and the
items on it.

10. RESOLUTION 89-087 SALE OF CREST RIDGE ESTATES SUBDIVISION AND
SIGNATURE OF BARGAIN AND SALE DEED
Before the Board was signature of Resolution 89-087, and
Bargain and Sale Deed relating to the sale of Crest Ridge
Estates Subdivision to James R. Schmit and Robert H. Watson
for the consideration of $20,000 and satisfaction of the road
improvement lien in the amount of $324,000.
