1989-26306-Minutes for Meeting October 04,1989 Recorded 10/9/1989• - 01 71 89_26."O DOG HEARING 0096 1993 DESCHUTES COUNTY BOARD OF COMMISSIONERS October 4 1989 chair Prante opened the hearing at 11:00 a.m. Board members present were Dick Maudlin, Tom Throop and Lois Bristow Prante. Rick Isham, County Legal Counsel, was also present. Jon Sholes, Deschutes County Sheriff, reported that on September 17, 1989, he was contacted by a dispatcher at 9:22 a.m. and advised that Mr. Chadwell had called about 8:30 a.m. that morning. He went to 15845 Camino DeOro about 11:30 a.m. and spoke with Mr. Chadwell, who reported that he heard a commotion outside that morning, and when he went outside he saw three dogs chasing his horse in a small, wooden pole corral. He told the officer that two of the dogs were biting at the heels of the horse, and one was attempting to bite at the head of the animal when it would lower its head to kick. When Officer Sholes observed the horse, he did not find any marks or any blood. There was a spot on the horse's head above the eye that was missing some hair. Mr. Chadwell told him he knew where the dogs were from, so he contacted his neighbor Bessie Hustead to get the telephone number, called Mr. Saul's residence, and notified them that their dogs were chasing his horse and to come and get them immediately. Mr. Chadwell told the officer he went outside and fired a few shots in the air to scare the dogs away. Shortly there after, he said Mr. Saul's daughter- in-law came and got the animals. Officer Sholes said he then spoke with Bessie Hustead and asked her to sign a statement. Later he went over to the Saul's residence and spoke with Mr. & Mrs. Saul. The owners of the other two dogs had returned to Salem with their dogs. He then impounded Marvin Saul's dog. He submitted two pictures, one of the animal that was impounded and one of the corral where the incident occurred. Larry Chadwell, 15845 Camino DeOro, LaPine, stated that the picture of the corral was not the correct corral and that the incident occurred in the back corral. He said he heard dogs barking in his back yard, and saw Mr. Saul's dogs in the corral with his horse. He said he had had a problem with Mr. Saul's dogs before. He called Mr. Saul's residence to let him know that the dogs were hurting his horse. He threatened them, saying he was going out to shoot the dogs. He said a blonde lady showed up and said only one dog was hers and that she didn't know where the other dogs belonged. He told her to get her dogs off his property, and then he called the sheriff. Commissioner Prante asked him if the dog in the picture was one of the dogs he saw chasing his horse. He said yes it was one of the dogs. Commissioner Maudlin asked about the previous problem. Mr. Chadwell said that the last Name the dogs came to visit they chased his wife. PAGE 1 DOG HEARING: 10/4/89 ti Oo96 11,994 Mary Chadwell, 15845 Camino DeOro, LaPine, testified she heard dogs barking, looked out the bedroom window, and saw Mr. Saul's white dogs. She told her husband and went downstairs while he telephoned. Through the kitchen window, she was three dogs jumping, lunging, and barking at their horse. She ran back and told her husband that the dogs were killing the horse. She said she had seen and met the dogs before and identified the picture as looking like the dogs that attacked their horse. Bessie Hustead, 15875 Camino DeOro, LaPine, said that Larry Chadwell called her for Mr. Saul's telephone number. After the call, she heard noises and looked out her kitchen window. She saw some white figures jumping in the horse's corral with the grey horse. She heard some shooting. She didn't know for sure they were dogs until she saw a big white long-haired dog run by. She couldn't identify the picture. Marvin Saul, 53770 Agular, LaPine, owner of the impounded dog, submitted pictures of his dog and his dog's papers. He said he was keeping the dog for his son who lived in Gladstone. He said they had pens for the dogs and took the dogs every place they went. He said the dogs seldom barked, and were kept in the house at night. He warned the grandson not to let the dogs out. On the morning in question about 6:30 a.m., his grandson opened the door and the dogs ran outside. He came back and told his folks that the dogs got out, and his daughter-in-law started after them when the phone rang and there was some shooting. The man on the phone was screaming and using fowl language. By the time he got his shoes on, his daughter-in-law was coming back with the dogs. They scolded the dogs. His son took his dogs home. Commissioner Prante pointed out that the only issue the Commissioners could consider was whether the dogs were chasing livestock. Mr. Saul admitted that his dogs were the dogs that were barking at the horse, but said there was no blood drawn. He said that last Thanksgiving Mrs. Chadwell contacted him about his dogs barking at her at her home. He felt it was a good record that his dogs had not been out since then. Debra Saul, 4456 Roselawn Dr., Salem, OR 97305, testified that she owned two of the dogs that were involved. She originally thought only one dog, her eight month old, was involved. When she came to the area, the smallest dog ran back home, and then the Chadwell's showed her the other two dogs running through the woods. It was her son that opened the door to take one older dog out on a lease when the other three ran by him. She forgot to check and see if there was any damage to the horse. MAUDLIN: Based on the information that we've received, two eyewitnesses who have identified the dog, and the fact PAGE 2 DOG HEARING: 10/4/89 v 0096 1995 that the dogs were loose, I think we have no choice but to find that the dogs were harassing the horse and have them put to death as humanely as possible, and I would so move.
