1989-28000-Minutes for Meeting October 18,1989 Recorded 10/20/198989-28000 0 9 6 ~ 17 7 0 MINUTES DESCHUTES COUNTY BOARD OF COMMISSIONERS October 18, 1989 Chair Prante called the meeting to order at 9:00 a.m. Board members in attendance were Dick Maudlin, Tom Throop and Lois Bristow Prante. Also present were Rick Isham, County Legal Counsel and Dennis Maloney, Corrections Director. 1. CONSENT AGENDA Consent agenda items before the Board were: #1, authorization to rebid Sheriff's impound building eliminating bond requirements and revising the specifications; #2, signature of Amendment #4 to 1989-91 Mental Health Division Intergovernmental Agreement #09-001; #3, appointment of James Eriser and James Ramey to River Forest Acres Road District Commission; #4, signature of Order 89-091 budgeted cash transfers; #5, signature of Conservation Easement from Michael and Judy Wright. DESCHUTES COUNTY CORRECTIONAL FACILITY Rick Isham reported that pursuant to SB 591 and t'eorts that the County had undertaken in the correctional 4c"ity, a report from the Sheriff, District Attorney and himself relating to jail capacity under emergency conditions, was almost completed. The draft report was being reviewed by the Jail Administrator, the Sheriff, and the District Attorney. Before finalizing the report regarding the population control issue, they've developed a proposed population policy which would increase the capacity from 52 to 53 inmates. They have implemented the new classification system so that like inmates are housed in the same areas. They have worked with the Community Corrections work group and Commissioner Maudlin to propose a change in the matrix which would provide consequences for persons who had violated their parole. The policies, which were completely redrafted, reviewed and redone, were substantially completed. The repairs and changes within the correctional facility were also substantially PAGE 1 MINUTES: 10/18/89 3. 4. completed. They had not completed training for the Correctional Officers but had requested overtime to do so. He said before the Board could consider adoption of Order 89- 090, they had to receive the report, therefore, he recommended that this issue be continued to Wednesday, November 1, 1989, at which time the final report, the training, and the facility issue should be completed. MAUDLIN: I move that we continue the Corrections Facility recommendations to November 1, 1989. THROOP: Second the motion. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES FUTURE OF JUVENILE REFEREE PROGRAM Dennis Maloney reported that three years ago Deschutes County had one of the slowest juvenile court system in the state and had a poor reputation for not holding juveniles and their families accountable for problems. Cases were often postponed when an adult trial went past its scheduled time, and then the family would disperse and were difficult to get back into court. He said that today, because of the Juvenile Referee Program, Deschutes County had one of the fastest systems in the state and had an extremely high appearance rate. Because they were able to stay on top of the cases with court intervention, they had achieved the lowest incarceration rate and the highest restitution rate in the state. He had received a communication for Judge Mosgrove that the Juvenile Referee Program was in jeopardy because the State could not pay for the referee position. He said that if the County lost the Juvenile Referee Program, it would seriously hinder his department's ability to carry out its current duties. PAGE 2 MINUTES: 10/18/89 He wanted the Board of Commissioners to allow the use of funds coming in from SB 1065 to pay for the referee position and then to ask the Children and Youth Services Commission (CYSC) to pick up whatever additional amount was left to fully fund the position. He felt they would agree since it had been the highest priority of the Juvenile Service Commission. Commissioner Maudlin expressed concern that this would leave the CYSC with an unknown budgetary amount. He suggested that the Board of Commissioners ask the CYSC to dedicate $10,000 from their funds every year to pay for the referee position, and that the County agree to return to CYSC whatever monies were left from SB 1065 revenue after the referee program was fully funded. Commission Throop said he would like to take it one step further and ask CYSC to fund $10,000 which was about one-half the cost of the program, and the County would pay the rest out of SB 1065 fees. Any excess fees from SB 1065 would stay with the County to keep current juvenile programs funded or to expand programs. Dennis Maloney said that any excess fees would be a good back up transfer fund. If they had any unforseen medical costs, they wouldn't have to ask the County for more general fund money. Commissioner Prante stated that if for some reason the funds from SB 1065 were not adequate to fund the remainder of the position, the County would agree to make up the difference. PUBLIC HEARING: ORDER 89-084, CREATING BLACK BUTTE RANCH SERVICE DISTRICT Chair Prante opened the public hearing at 10:10 a.m. Before the Board was a public hearing on Final Order 89-084 creating the Black Butte Ranch Service District.
