Also present were Karen Green, Community Development Director and George Read, Planning Director. SITE 342 (Crown Pacific site east of Wickiup Reservoir George Read reported the this 40 acre parcel was zoned surface mining and contained 200,000 cu yds of fair quality cinders. There was no testimony on this site. The staff recommendation was surface mining zoning with the standard conditions. THROOP: I'll move approval of surface mining for site 342 with the standard conditions recommended by staff and Planning Commission. MAUDLIN: Second. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES SITE 394 (Windlinx site east of the S. Hwy 97 Weigh Station) George Read reported that this 20 acre parcel contained 270,000 cu yds of coarse red cinders and was currently zoned SMR. He said that the original map showed a much larger area than Mr. Windlinx was asking to be zoned for surface mining. He only was interested in the area around the State Highway Division site. Mr. Windlinx was asked to provide a legal description of the area he wanted zoned SM, but he had only provided a map. THROOP: I'll move that only the mining site itself that's reflected on the map be zoned surface mining, including the conditions that are recommended by the Planning Commission and staff, with the condition that an adequate legal description for the boundary being zoned SM be provided to the Community Development Department. MAUDLIN: I would second the motion. MAUDLIN: I would like to amend that motion to be acreage that they're asking for is approximately 60 acres. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES SITE 395 (State Highway Division Site) George Read reported this site, which was currently zoned SM, was 22 acres in size with 100,000 cu yds of good quality cinders. The parcel was located within the previously discussed Windlinx site. The site had been mined for 30 years and used as a reserve sanding stockpile site. Testimony indicated that the site would be needed for the Division Street project and work on the rail beds. The staff recommendation included the standard conditions. THROOP: I'll move approval with the conditions Commission. of surface mining zoning for site 395 recommended by the staff and Planning MAUDLIN: Second. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES SITE 423 (Rothbard sitel George Read reported that the site was 10 acres with 20,000 cu yds of aggregate resource. It abutted the flood plain of the Little Deschutes River. There was written testimony regarding the proximity to the river and concern over the impact on the shallow water table and the road. The DOGAMI report on the site said the water table was 6-7 feet. The owner had indicated he was considering wildlife ponds as a reclamation plan. The Planning Commission and the staff recommended no processing on the site, seasonal operating conditions as set forth by the ODF&W, and the other standard conditions. MAUDLIN: I would move that site 423 not be zoned due to the fact that because of the water table we would not allow crushing or processing in any event, and the significance of 20,000 cu yds just doesn't seem to be enough that the other assets would not overcome it. PAGE 2 MINUTES: 10/12/89 ~ 1. 099 - 0022 THROOP: I would concur with Commissioner Maudlin, I think the other natural resources and uses in the area are of more significance: wildlife, wet lands, water resources, and rural residential. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES SITE 426 (LaPine Redi-Mix east of Hwy 97) George Read reported that the 18 acre parcel, which was currently zoned SM, contained 1 million cu yds of good quality aggregate. He said it was an operating surface mine. The staff recommended approval with the standard conditions and processing on site. MAUDLIN: I'm going to move that 426 remain an SM zone with the conditions in the staff report. THROOP: I'll second the motion. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES SITE 427 (Bagley Site) George Read reported that this site was next to site 426 and the public testimony indicated that the site had 1.2 million cu. yds. of material. The site was currently being operated illegally and would need a zone change and site plan to operate legally. MAUDLIN: I am going to move that we zone site 427 SM with the standard restrictions that would come from Planning and staff, and that processing and mining could only be allowed once a site plan is filed and approved. THROOP: I'll second the motion. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES SITE 433 (LaPine Pumice in Newberry Crated George Read reported site 433 was the lump pumice site between Paulina Lake and East Lake. He said there was an estimate of 10 million cu yds in the staff report. He said testimony from Mr. Miller indicated that the quantity was much greater than that and included one-half of the pumice cone. The staff recommended that this site not be zoned surface mining due to all of the other Goal 5 resources in the area. PAGE 3 MINUTES: 10/12/89 099 - 0023 MAUDLIN: I move that we uphold the staff and Planning Commission report, that we do not zone site 433 as SM. THROOP: I'll second the motion. THROOP: Under discussion I might note the very sensitive nature of those other natural resources in the area that conflict and clearly those other natural resources are of much greater significance than the lump pumice resource: open space, fish and wildlife, ecologically and scientifically significant natural areas, outstanding scenic views and sites, the water areas around East Lake, the caldera itself, etc. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES SITE 529 (State Highway Division Site east of LaPinel George Read reported that the site contained 31,000 cu yds of aggregate which met ODOT specifications and was currently zoned F2. There was no testimony on the site in the file. The staff recommended surface mining zoning with the standard conditions. MAUDLIN: I move we zone State Highway Division site 529 as SM with processing on site and standard conditions as outlined in the staff report. THROOP: Second.
