1989-30972-Resolution No. 89-092 Recorded 11/21/1989999 — 0098 89- 309''2 LEr etMU sa BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Adopting the Deschutes County Safety Manual and Establishing the * Vehicle Accident Review Board.* 21 ftH 6: RESOLUTION NO. 89 -092 WHEREAS, the Risk Management Committee, in conjunction with the safety committees of the County, have proposed a Deschutes County Safety Manual which establishes policies relating to general safety, hazard communication, risk identification, communicable disease transmission, general office safety, field representatives safety, health /mental health safety, maintenance safety, public works department safety, and vehicles safety policies; and WHEREAS, it is necessary and appropriate that this document be adopted as a policy document of the County in order to con- tinue the fostering of a safe work environment for County employees; and WHEREAS, department heads, managers, supervisors, and employees have responsibility for assuring safety in the work place; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That the Deschutes County Safety Manual, marked Exhibit "A," attached hereto and by this reference incorporated herein, is hereby adopted as the safety manual for Deschutes County, Oregon. Section 2. That, from time to time, the Deschutes County Safety Manual shall be amended as necessary to promote the general safety policy of the County, through review and revisions by the various safety committees, and the Risk Management Committee of the County. Section 3. That policies and practices set forth in the Deschutes County Safety Manual shall constitute work rules of the County. An employee's failure to follow safety practices shall be reported to the Risk Management Coordinator for evaluation. Section 4. That department heads, managers, and supervisors of the County shall utilize the safety manual for orienting new, employees and training existing employees in the safety adti' es of the County. When an employee violates safety policies and 1 - RESOLUTION NO. 89 -092 099 - 0099 practices described in the Deschutes County Safety Manual, the department head, manager, or supervisor, shall, when considering an appropriate response to the violation, consider whether or not discipline or discharge is appropriate. Section 5. That a Vehicle Accident Review Board be established to review vehicle accidents and make recommendations as set forth in the document entitled "Vehicle Accident Review Board (VARB)," marked Exhibit "B ", attached hereto and by this reference incorporated herein. To establish a Vehicle Accident Review Board (VARB) and assign that Board the authority to investigate and recommend necessary action up to and including suspension. PROCEDURE The VARB shall consist of two (2) department heads or department managers and three (3) other County employees. Members to be appointed by the Deschutes County Board of Commissioners. Department heads will be appointed for a period of 18 months, and all other appointments shall be for 12 months. The Risk Management Coordinator will act as ex- officio member of this board on a permanent basis. The VARB will meet on the third Thursday of each month, at a time to be set, to review the vehicle accident reports for the previous month. All reports and memos pertaining to all vehicle accidents to be reviewed shall be made available by the Risk Management Coordinator on the Monday preceding the date the VARB is to meet. EMPLOYEE APPEARANCE The employee involved in any vehicle accident, including accidents involving any vehicle used for County purposes, may be requested or may request to appear at the VARB meeting if additional information is needed FINDINGS OF THE VEHICLE ACCIDENT REVIEW BOARD After reviewing all reports, memos, statements and other evidence, the VARB shall make recommendations to the Department Head of the employee involved who shall take action on the recommendation. The Department Head shall not implement a penalty less than that recommended by the VARB but may increase the penalty up to and including termination. Any employee disciplined may appeal in writing within five (5) working days to the Board of County Commissioners. The Board of County Commissioners will set a hearing date within ten (10) days. The Board of County Commissioners' decision is final. CHALLENGING A VARB MEMBER If an employee involved in an accident believes that a member of the VARB is prejudiced and will not review the accident fairly and impartially, the VARB member may be challenged. The challenge must be submitted to the chairman of the VARB, in writing, within ten (10) days prior to the next scheduled meeting. If the challenge is successful, the Risk Management Coordinator shall take the place of the VARB member and act in his or her place. EXHIBIT_-
