WHEREAS, the Board of County Commissioners has rec6fVed,,a
report from the District Attorney, Sheriff and County Cou",eiO
relating to the maximum number of inmates that should be held in
the Deschutes County Correctional Facility; and
WHEREAS, the Board of County Commissioners, after consulta-
tion with the persons described in Section 4 of Chapter 884,
Oregon Laws 1989, finds that the recommendation should be
adopted; and
WHEREAS, upon adoption of a jail capacity limit under
Section 3 of Chapter 884, Oregon Laws 1989, and upon the occur-
rence of a jail population emergency, the action plan to be
followed and the release of inmates shall be in accordance with a
release matrix adopted by the Deschutes County Sheriff, under
Deschutes County Correctional Facility Policy and Procedures
Policy No. 1.090, which will result in a decrease in the number
of inmates within the Deschutes County Correctional Facility;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That the recommendation of the District Attor-
ney, Sheriff and County Counsel, received pursuant to Section 2
of Chapter 884, Oregon Laws 1989, marked Exhibit "A," attached
hereto and by this reference incorporated herein, is hereby
adopted, and a maximum of 54 inmates may be held in accordance
with that recommendation in the Deschutes County Correctional
Facility.
Section 2. If the arrival of an additional inmate at
Deschutes County Correctional Facility means that the population
limit for any housing area will be exceeded, a county jail
population emergency shall be deemed to exist and the Sheriff and
designee(s) shall release an inmate of that security level
classification pursuant to the policy approved in Section 3 of
this Order.

Section 3. That the Deschutes County Correct 'anal FaU*litb
policy entitled "Population Control," Policy No. K.049, i6a 2(B
Exhibit 11B,11 attached hereto and by this reference incorporated
herein, is hereby approved as the action plan for release of an
inmate when a county jail population emergency exists because of
the arrival of an additional inmate for incarceration greater
than the population limit of the appropriate housing area as
established herein.
Section 4. Based on the recommendation and information
received, it is likely to becoiue necessary in the near future to
release inmates under Section 3 of this Order. The Sheriff shall
immediately notify all police agencies of the county to make
maximum use of citations in lieu of custody pursuant to
ORS 133.045 to 133.100 until further notice.

At the request of the Board of Commissioners, we are providing
our joint recommendation regarding the maximum number of inmates
that should be lodged in the Deschutes County Correctional
Facility (DCCF). This memorandum contains a discussion of how
DCCF meets prevailing constitutional standards relating to
conditions of incarceration. It also includes information
regarding design capacity, condition of DCCF physical plant and
programs available to inmates.
Our joint recommendation is that the Board of Commissioners
resolve to raise the maximum number of inmates that may be lodged
at DCCF at any one time to 54 inmates. This includes one inmate
in each of the four "side cells;" however, these special use
cells should remain restricted to use for medical segregation,
disciplinary segregation, administrative segregation, protective
custody, detoxification and for inmates awaiting a mental health
consultation. Under ordinary circumstances, the "A section"
houses maximum security inmates, the 11B section" houses medium
security inmates, and the "C section" lodges minimum security
inmates. Under our recommendation, the population would be
assigned as follows:

OVERVIEW
The United States Constitution requires that correctional insti-
tutions: (1) attend to the basic life support needs and health
of inmates through the provision of a sanitary and healthful
environment, adequate medical care, nutritious diet, the ability
to maintain a healthful level of personal hygiene and an oppor-
tunity to maintain physical and mental health by access to
exercise; (2) assure reasonable protection from harm at the hands
of other inmates, themselves or natural disasters such as fire,
riots, bomb threats, etc.; (3) permit the exercise of inmates'
basic civil rights that are not inconsistent with institutional
security, including access to the courts through attorney or law
library, a reasonable opportunity to visit and communicate with
the free world, access to religious programs and due process when
discipline or other forms of segregation are imposed. Although
in some respects the federal case law is unclear as to some
issues, in the District of Oregon, a fairly consistent set of
rules has resulted from the many cases that have resulted in
"consent decrees" and the few cases that have actually been
litigated.
In the fall of 1988, Legal Counsel and the Sheriff's Department
participated in a comprehensive review of the physical plant,
existing policies and procedures, staffing pattern, programs,
population level and other aspects of DCCF operation. This
culminated in a series of recommendations which preceded the
Board's Resolution No. 89-011 on February 1, 1989. The jail
review process was ongoing and further work by the County's
lawyers and the Sheriff's Department provided the Board with
advice resulting in Resolution No. 89-038 on June 13, 1989. A
program for successive renovation of the three major housing
areas predated this jail review process; capital improvement
programs and maintenance activities are ongoing.
DESIGN CAPACITY
The original design capacity of DCCF when the facility opened in
1978 was 76 inmates.
PHYSICAL CONDITION OF DCCF
The physical plant of DCCF is now in top condition following a
program of renovating the three major housing areas (A, B and C
sections), retrofitting of all showers with stainless steel
liners, an ongoing program of replacing chipped porcelain com-
modes with stainless steel units, modification of the intake

shower facility and construction of an Indoor Recreation Room,
which is scheduled to go on line on December 1, 1989. A security
portal has been constructed to facilitate in-person observation
of inmates using the Outdoor Yard. Hallway floors and walls have
been resurfaced and the trustee/work release dormitory has been
repainted. A new video observation system has been installed and
a new medical treatment room has been built. A new policy has
been implemented which provides for sanitation -plumbing inspec-
tion by corrections officers three times weekly; county mainte-
nance personnel have been directed to respond to DCCF maintenance
requirements on a priority basis. The no -smoking policy imple-
mented on November 1, 1989, has improved the facility's air
quality. As a result, the physical plant defects commonly asso-
ciated with older correctional facilities are simply not present
in DCCF.
INMATE PROGRAMS
Although no formalized programs have been instituted to date at
DCCF, inmates are able to receive visitors five times a week,
telephones are available in all major housing areas, inmates may
send and receive mail with few restrictions, an Outdoor Yard and
an Indoor Room are available for exercise, a modest law library
is located in the facility, inmates are permitted access to
religious activities, commissary items are available, radio and
television programming is available except during lockdown hours,
movie videotapes are shown periodically, jail administration
plans to develop a program for televised educational instruction,
a newspaper is provided daily to each housing area and inmates
may have access to magazines and paperback books from the
Deschutes County Library and the DCCF Library. A volunteer
program is being developed to provide in -facility meetings of
Narcotics Anonymous.
CONSTITUTIONAL CONDITIONS
In our opinion, the totality of conditions at DCCF are sufficient
to secure the constitutional rights of confined citizens.
Space Per Inmate. Although the U. S. Court of Appeals for the
Ninth Circuit has long held that federal trial courts may not
"constitutionalizell professional standards or guidelines issued
by organizations such as the American Correctional Association or
the American Medical Association, as a practical matter, federal
trial judges not infrequently use the ACA standards as a rough
yardstick for determining how many inmates may be lodged in a

given housing area. The ACA's "Standards for Adult Local Deten-
tion Facilities" (2nd Ed. 1981) include guidelines calling for 50
square feet of living or cell space and 35 square feet of separ-
ate day room space for each inmate. The individual cells of A, B
and C sections range between approximately 65 to 70 square feet.
The Multi -Use section's cells contain 70 to 77 square feet. The
Female section cells consist of approximately 73 square feet.
The four "side cells" each have between 65 and 70 square feet.
Given the generous amount of day room space in each of the major
housing area, multi -use and the female section, it is clearly
constitutionally permissible to lodge one inmate in each cell.
It is also our opinion that inmates can -be double -celled to the
extent noted in the above chart (for periods that do not exceed -
30 days) consistent with the federal constitution given the
totality of conditions, amenities, policies and procedures
prevailing at DCCF. The work release/trustee dorm consists of
approximately 608 square feet including shower and restroom
areas, which computes to 60.8 total square feet for each of 10
iranates; however, given the fact that both the trustees and work
release inmates are out of that housing area for periods that
exceed 12 hours daily, the recommended population level is
constitutionally adequate in our opinion.
Staffing. As a result of the hiring and the staffing reassign-
ment directed by the Board's two Resolutions, the Sheriff's
Department personnel assigned to the Corrections Division are 30
in number. When compared to a 54 inmate maximum population, this
results in a 1.8 to 1 inmate -staff ratio. The 30 staff member
level (21 sworn officers) has been justified by the Facility
Commander using a generally accepted staffing analysis procedure.
At all times one corrections clerk, except for a short period in
the early a.m., and three corrections officers are present within
DCCF, and at peak times additional personnel are available to
assist with inmate movement, court escort and prisoner transport.
Outdoor Exercise is offered to inmates one hour daily in the
Outdoor Yard. In mid-February 1989, footwear and outerwear for
winter use was purchased. The policy of one hour of outdoor
exercise daily exceeds that which has been ordered in most
federal court cases.
Indoor Exercise. When the Indoor Room comes on line for use on
December 1, 1989, inmates will be allowed to shuttle into the
facility every half-hour so that they can utilize exercise
equipment which will include a stationary exercise bicycle,
rowing machine and two Soloflex weight machines.

Medical Care. The jail doctor now conducts a sick call each
week. A registered nurse is on duty 40 hours weekly to dispense
medication, review intake medical screening forms, evaluate
inmate sick call requests and attend to the basic medical needs
of inmates under the jail doctor's supervision. The correction
officers have all received an eight-hour program of health care
instruction and testing leading to their certification as Health
Trained Officers. Access to dental care is provided for dental
emergencies, to alleviate pain or infection. Health appraisals
are given to all inmates who are lodged at DCCF for more than 14
days or who assist with food service or preparation. A compre-
hensive set of Treatment Protocols for Health Trained Officers
have been developed under the supervision of the jail doctor who,
as Chief Medical officer, has ultimate responsibility for all
aspects of medical care delivery.
Mental Health Care. Incoming inmates identified by Health
Trained Officers as falling within a "target population" as
potentially needing mental health care are closely monitored
until they are seen by a Qualified Crisis Worker within 12 hours.
A semi-weekly mental health sick call is conducted by appropriate
personnel. An area psychiatrist has contracted to provide super-
vision of the delivery of mental health care to DCCF inmates.
Inmates incarcerated for 14 days receive a mental health
appraisal.
Food. The DCCF menu has been approved by a dietician and meals
are prepared by independent qualified cooks. The food quality
and kitchen sanitation has historically exceeded prevailing
governmental standards.
Inmate Securit . The Facility Commander has recently revised
DCCF jail operational policies to assure proper response to the
emergency situations presented by bomb threats, escapes, hostage
incidents, fires and other events. An ongoing fire safety plan
has been developed in consultation with the local office of the
State Fire Marshall. A new classification policy has been
devised to assure that inmates are properly classified according
to their security risk and lodged with similarly classified
inmates. Corrections officers make a formal check hourly in
compliance with state law, and make other supervision checks on a
frequent irregular basis as a matter of normal routine. A video
camera surveillance system monitored by the corrections clerks
adds to the level of inmate security. Corrections officers
working the floor wear intercom devices permitting them to
communicate with each other and the dispatch control center. All

interior jail keys have been "touch coded" to prevent confusion
during evacuation in the event of fire or smoke conditions.
Jail Policies. The efforts of the Facility Commander, other
corrections staff and legal counsel over the past year have
resulted in a wholesale revision of jail operational policies,
medical policies and the inmate manual, such that corrections
officers and clerks have the maximum degree of guidance reason-
ably possible to handle circumstances that arise.
JAIL POPULATION EMERGENCIES
Pursuant to Section 4 of Chapter 884, Oregon Laws 1989, we recom-
mend that the Board resolve that if the arrival of an additional
inmate at DCCF means that the population limit for any housing
area will be exceeded, a County Jail Population Emergency exists
and the Sheriff and designee(s) may order inmates of that secur-
ity level classification to be released pursuant to the attached
matrix release plan.

POLICY: The Deschutes County Sheriff will provide guidelines
and direction to corrections staff to maintain the
correctional facility population within maximum capacity while
protecting the public safety to the maximum extent possible.
DEFINITIONS: For the purpose of this document, the following
finitionB shall apply.
A. Capacity: The total capacity of the Deschutes County
Correctional Facility (DCCF) is fifty-four (54).
(Capacity for male inmates is fifty (50) in housing areas
A, B, C, Work Release Dorm. Capacity for female inmates
is four (4).
B. Inmate Score Sheet: The release score sheet used by the
staff of DCCF to determine inmate matrix score.
C. Original Matrix Number: Inmate release score for
pretrial detainees, and for sentenced inmates before
calculations for time served.
D. Final Matrix Number: Inmate release score for pretrial
detainees, and for sentenced inmates after calculation
for time served. Final matrix number determines priority
for early release.
E. Matrix List: List of all inmates lodged in the DCCF
subject to release by Final Matrix Number.
F. Early Release: Release of sentenced inmates for time
served and release of pretrial detainees on conditional
release.
G. Facility Commander: Includes designee in the absence of
the Facility Commander.
H. Escape Risk: Subject arrested for Escape I; subject
arrested for Escape II from a maximum or medium security
institution; subject has had an institutional violation
for possessing escape tools or attempting to escape from

a medium or maximum security institution. Severity of
charge or combination of charges leads staff to believe
subject may attempt to escape.
III. PROCEDURES: The procedures below shall be followed and govern
the early release of inmates when capacity has been, or is
about to be, reached:
A. This procedure will be implemented when all other forms
of release have been exhausted.
B. When a housing area or the total jail population reaches
capacity, or within twenty-four (24) hours will reach
capacity, the Facility Commander shall authorize the
early release of inmates according to the criteria
herein. The number of inmates released will be
determined by the Facility Commander in order to achieve
or maintain capacity.
C. All inmates in the DCCF, except those listed in paragraph
III F, below, will be considered for early release,
including pretrial detainees and sentenced offenders.
The inmate with the lowest Final Matrix Number will be
released prior to an inmate with a higher number,
regardless of pretrial or sentenced status.
D. Shift sergeants will complete an Inmate Score Sheet on
all newly booked inmates at the time of booking, or
whenever possible, to determine the Original Matrix
Number. The original Matrix Number will be based on the
following factors:
1. Highest Ranking Charge - Most serious offense
charged. Score will be obtained from
"Classification Charge List".
2. Additional Charges - Each additional offense
charged. "Classification Charge List" will
determine classification and score.
3. Holding Charge Modifiers - The number of failure to
appear (FTA) warrant charges, violation of release
warrant charges, and probation violations will be
entered and computed.
4. Additional Modifiers - If the defendant failed to
comply with work crew or community service orders
that information will be entered and computed.
5. Custody Status - If the defendant meets the criteria
for escape risk or disciplinary status, additional
points will be added.

6. Criminal History - Using the irLmate'B CCH and/or RAP
sheet the number hall be entered for arrests and/or
convictions for:
a. All violent misdemeanor and violent
convictions.
b. All violent misdemeanor or violent felony
arrests.
C. Probation violation convictions.
d. Parole violation entries.
E. Inmates sentenced to the DCCF will receive the following
additional points based on the percentage of time served
on the sentence. The points below will be added to the
Original Matrix Number to determine the Final Matrix
Number for sentences inmates.

F. Inmates on the following status shall not be eligible for
early release:
1. Fugitive charges
2. Facility hold (witness, in -transit)
3. Extradited to Deschutes County
4. Parole Violation
5. Sentenced to state time, being held pending
transport to State Corrections facility.
6. In or awaiting disciplinary segregation at
DCCF.
7. Exceptional danger hold, as determined by Facility
Commander.
G. Inmates on hold status for another jurisdiction without
Deschutes County charges shall be released to the
jurisdiction for which the hold/detainer is lodged,
regardless of the inmate's final matrix score.
1. When an inmate on a hold/detainer status is lodged
in DCCF, the jurisdiction(s) for which the
hold/detainer has been lodged shall immediately be
contacted and arrangements shall be made for the
inmate to be transferred to such jurisdiction.
H. Inmates lodged in DCCF with local charges and on
hold/detainer status for another jurisdiction shall be
placed on the matrix list. The charge(s) or holds for

another county will be added to the additional charges
on the Matrix Form.
1. If the inmate's final matrix number is the lowest
on the Matrix List, the other jurisdiction shall be
notified that the inmate may be released under the
Population Control Policy and they should make
necessary transport arrangements to pick up the
inmate or provide us with the authorization to
release inmate pending a court appearance in their
jurisdiction.
2. If the jurisdiction having the hold/detainer on the
inmate indicates or authorizes release of the inmate
on their warrant, authorization via teletype will
be requested and obtained from the holding
jurisdiction. The written authorization will be
placed in the inmate's file and any matrix points
assigned to the inmate for the reasons of the
hold/detainer status shall be removed and the
inmate's matrix score recalculated.
I. Shift sergeants will review and update the Inmate's Score
Sheet under the following conditions:
1. Whenever inmates have received additional charges.
2. Local or state sentences.
3. Percentage of time served.
4. If disciplinary actions are pending.
J. The Matrix List will be updated each day at 5:00 a.m. by
the shift sergeant.
K. Each day, shift sergeants will review the Facility
Commander the population of the DCCF and release the
appropriate number of inmates in accordance with this
policy.
L. The Matrix List will be provided to the District
Attorney, Sheriff and State Release Officer each working
day. The District Attorney may request, in writing, a
twenty-four (24) hour postponement be placed on the
release of any inmate on the Matrix List. The request
shall be date stamped when received by DCCF. Inmates
with a 24-hour postponement will not be considered for
release during that 24-hour period. If new charges are
filed by the District Attorney within the 24-hour period,
shift sergeants will update the Inmate's Score Sheet.
If new charges have not been filed the 24-hour
postponement will be dropped, and the inmate will be
release according to the policy.

M. If capacity is reached in the female dorm, the female
with the lowest Final Matrix Number will be released

N. Pretrial detainees who are released will be required to
sign a Release Order and Agreement For #109. The
corrections of f icer will assure the correct court date
is on the Release Order and Agreement and that it is
signed by the inmate.
0. The State Release Officer will be notify, in writing,
each day of the inmates released under this policy.
