SURFACE MINING HEARINGS

Chair Prante called the meeting to order at 10:00 AM.
Commissioners Throop and Maudlin were also present. Staff members
present were Karen Green, Community Development Director, George
Read, Planning Director, and Sue Stoneman, Recorder.
Public Hearing
There were no members of the public present. Staff presented the
staff reports for the Board's consideration.
Site 416, 417, 418, 419
George Read gave the staff report. He stated that this is a 10
acre site owned by Deschutes County and is comprised of five small
sites on one parcel. It is located on Highway 20 East about three
miles east of Millican. The site contains aggregate resource.
Staff had made the standard recommendation.
After further examination, it was determined that these were four
different sites all in the same area. Mr. Read then indicated the
respective acreage and estimated quantities for each of the four
sites.
Site 421
Mr. Read gave the staff report. This is the Barbwire Ranch site
and it is owned by Bob Coats. This site is between Hampton and
Brothers. It contains an estimated 500,000 cubic yards of
aggregate. It is presently zoned EFU-320. This site is out of
view of the highway. Staff and Planning Commission had recommended
SM zoning.
Site 312
George Read stated there is a map that shows an approximate
location. It is owned by Clyde Carlson and is located east of Bend
near Johnson Ranch Road. The file contains a letter to Clyde
Carlson indicating that we need more information about this site.
We did not receive more information. Part of this is in the flood
plain. The current estimate of quantity is 1.5 million cubic
yards. There was no opposition to this site.

Site 317
Mr. Read stated this is a Willamette Industries cinder site with
1,200,000 cubic yards. It was recommended for SM zoning, and the
staff report was changed to include fish and wildlife standards.
Mr. Read indicated access was from Santiam Wagon Road, or the old
Highway 20. It is a ten acre site. This site is almost two miles
from Black Butte Ranch, notice just went to the Forest Service.
He stated that this is currently zoned F-2, but there is nothing
in the file to indicate it is a pre-existing site.
Site 347
Mr. Read stated this site is located north of Dusty Loop west of
Gerking Market Road. It is a Deschutes County site 60 acres in
size with 10,000 cubic yards of fill material. Conflicting uses
identified were fish and wildlife habitat and rural residential.
Staff had recommended SM zoning with standard conditions. There
was some discussion about whether it was worthwhile to zone this
site with such a small quantity of fill. They will get more
information on this site from the Public Works Division.
Site 353
Mr. Read stated that this is a Tumalo Irrigation site located on
the northern side of Laidlaw Butte just west of Tumalo. The
present zoning is SMR in a landscape management area. The resource
type is pumice, estimated to be 50,000 to 200,000 cubic yards, but
there has been no testing. Conflicting uses are the views from the
highway, fish and wildlife habitats, and rural residential uses.
There are no DOGAMI permits or exemptions in the file, however,
Commissioner Maudlin stated that he believes there are many pits
on this site. The Planning Commission and staff recommended
approval and allowed on-site processing.
Sites 413 and 414
Mr. Read gave the staff report. Site 413 is next to site 414 and
is located partway up the base of Pine Mountain. It is owned by
Deschutes County and is presently zoned SMR and wildlife area
combining zone. It is a 35 acre site with 30,000 cubic yards of
aggregate. Site 414 is part of the same 35 acres and is part of
the 30,000 cubic yard estimate. The file contains one letter in
opposition from Pat Smith in Florence, Oregon, who owns property
in the area and who wants his site zoned SM too. They were
recommended for approval by the Planning Commission. They are in
the antelope winter range.
Site 445
This site is located just south of Alfalfa Store and contains
50,000 cubic yards of aggregate. It is owned by Central Oregon

Irrigation. Conflicting uses are open space and outstanding scenic
views. Staff had recommended to allow mining with conditions and
no processing on site. The Planning Commission voted to allow
processing on site. Commissioner Maudlin asked if there were any
people within a half mile and if there was any notification. Mr.
Read responded that there was not at one hearing, but then 16
parcels were notified. Two people came to testify, but they did
not stay late enough to testify.
Sites 459 and 469
These are located just east of Sisters View Drive in the Goodrich
Loop area. Present zoning is F-3. This is a county cinder site
with approximately 50,000 cubic yards of cinders. No people had
come to testify on these sites. Staff had recommended approval,
the Planning Commission noted that there were 2,000,000 cubic yards
on site 469 which is right next to it. Staff recommended the
standard conditions which include processing.
Site 501
This is located one mile east of Millican on the north site of the
highway. This is a county site, 144 acres, with 30,000 cubic yards
of ODOT spec aggregate. The site is presently zoned SM. Staff
recommended approval with the standard conditions.
Site 397
This didn't have an appraiser's report. This is a Central Oregon
Irrigation District site which is a storage site only located
southwest of the intersection of Ten Bar Road and Highway 20E.
The site is presently zoned SM.
Site 446
This site is located southwest of Alfalfa. It is presently zoned
EFU-40 and is fairly close to the Alfalfa Store. It is owned by
Central Oregon Irrigation and contains 2,000 cubic yards of fill.
There was one letter from John Rings asking that this not be zoned
SM.
Site 270
This is located along Jordan Road east of Sisters. It is a
Deschutes County stockpile storage site with some fill material.
It is 3.5 acres currently zoned SM. Staff recommended approval
with the standard conditions.
Site 322
This is owned by Fred Gunzer and is in the state scenic waterway.
They were able to zone 5 acres of this for surface mining through

the quasi-judicial process. This would zone the remainder of the
parcel SM. This contains 1.5 million cubic yards of gravel which
meets ODOT specifications. There was some discussion about whether
this was part of the subdivision parcel. They will look into this.
Mr. Gunzer had provided some conservation easements with the
subdivision and the surface mining zoning. The site is located at
Lower Bridge. It was the concensus that they needed a little more
information on this site. Mr. Read will present that to the Board
when it is prepared. It was suggested that there be a site visit
before making a decision. It was noted that the old wagon road,
which is a public road, goes through the middle of this site. That
was filed in Crook County. There were no specific conditions
attached to the staff report.
Site 461
This is the old diacolite site on Lower Bridge Road. It is 660
acres owned by Franklin Nolan, Fred Gunzer, Robert Reimenschnider,
and Norman Weigan. The resource type is aggregate and diacolite.
Mr. Read noted that the previous site contains diacolite as well.
Diacholite contains silica, it's used in glass, mushroom bedding,
filters, kitty litter, decorative uses, and many other uses. This
site contains a higher quality resource that they are looking at
new uses for. They have done core drillings and it does go down
80 to 90 feet. This could be a major mining operation in the
county if they further develop some of the uses being researched.
Commissioner Throop indicated he would like a site visit.
Site 450
This is in the EFU-40 zone located southeast of Terrebonne. This
site is above the river, and probably not too far from the mobile
home park and the state park near Smith Rocks. This is a Central
Oregon Irrigation District site with 10,000 cubic yards of fill
material. This is about one half mile south of Smith Rock Road.
There was a photo of the site showing that there has been some fill
taken out and there is some debris on the site.
Site 543
This site is owned by Keith Cyrus and is located on Jordan Road.
There is a letter on file from Bill Boyer testifying in favor of
the site if they access from a certain direction. This is a 70
acre site containing 1.1 million cubic yards of good quality
aggregate. Staff had recommended approval with standard
conditions.
Site 248
Mr. Read stated that this site is southwest of the intersection
with Highway 126 and Slayton Road. This is Mr. Cyrus's present
cinder pit. It is a pre-existing cinder pit. Staff report had

recommended approval with the standard conditions. The Planning
Commission approved it. The file contains a letter of support on
this site. It is presently zoned SM and has a site and reclamation
plan.
Site 383
This is located off of Century Drive and is a Central Oregon Pumice
site. It is a 160 acre cinder site presently zoned SM containing
an estimated 3.5 million cubic yards of good quality cinders.
Staff recommended approval subject to conditions. It is presently
zoned SM and has a reclamation plan dating back to 1977. This is
one of three sites in this general vicinity, but the other sites
were pumice sites. The Planning Commission recommended that the
fish and wildlife conditions be placed on this site.
Site 399
There was some discussion about the taxlots shown for this site.
This is 18-13-10 taxlot 500. This has a pre-existing DOGAMI permit
with a 1978 reclamation plan. It contains 30,000 cubic yards of
fill and is owned by COI. It is located 1/4 mile south of the
intersection of Ten Bar Road and Highway 20. It is presently zoned
SM. There were no respondents to the notification. Staff
recommended approval with the standard conditions.
Site 401
This site is located southwest of Alfalfa. It is a COI fill site
with 10,000 cubic yards of fill material. The present zoning is
EFU-40. It is 38 acres in size and is in a wildilfe area combining
zone. Staff recommended approval with processing limited to
screening. Mr. Read stated that it appears there is no winter
closure requirement, but since it is in a wildlife area combining
zone that is a standard condition.
Site 408
This site is located on the West View Ranch way out east and is
owned by R. L. Coats. It is 640 acres presently zoned EFU-320 and
wildlife area combining zone. It is quarry rock that meets ODOT
specs and the quantity is 1 million cubic yards. This site is
several miles south of the highway and is east of the Barbwire
Ranch. One person from Los Angeles who owns property in the area
had written a letter of testimony on this site. Staff recommended
approval and the Planning Commission recommended that there be
seasonal operating conditions since this is in a wildlife area
combining zone.
