WHEREAS, the Deschutes County Engineer has presented the ar-d of
County Commissioners of Deschutes County, Oregon, an EngineerlwReport
on the proposed vacation of a 30 foot parcel of land located in the
South 1/2 of Section 22, Township 17 South, Range 12 East W.M., located
in Deschutes County, Oregon, recommending vacation of said road; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That on Wednesday, March 7, 1990 at 10:00 a.m. at the
Deschutes County Courthouse Administrative Building, Bend, Oregon
97701, the Board will hold a hearing to determine whether the
above-described public property, described in Exhibit "A", attached
hereto and by this reference incorporated herein, should be vacated.
Section 2. Notice of said hearing shall be posted in no less than
three (3) places, including the property proposed to be vacated, or
property within the vicinity of the property proposed to be vacated.
This notice shall be posted at least 20 days prior to the hearing.
said notices must be visible from traveled public roads.
Section 3. Property owners of record abutting the property
proposed to be vacated shall be notified by Certified Mail, return
receipt requested, at least 30 days prior to said hearing.
Section 4. All public utilities and municipalities affected by the
proposed vacation shall be notified by Certified Mail, return receipt
requested, at least 30 days prior to said hearing.
Section 5. Notice of the hearing, in substantially the form marked
Exhibit "B", attached hereto and by this reference incorporated herein,
of such hearing shall be published at least twenty (20) days before,
and within ten (10) days of the date of said hearing.

RIGHT-OF-WAY VACATION
DESCRIPTION OF PROPOSED REALIGNMENT
OF A PART OF STAG ROAD
A strip of land being a portion of Stag Road in the
subdivision plat of Plat #271 of "The Farm" as filed on
November 30, 1979 in the office of the County Clerk of
Deschutes County, and being located in the NW 1/4 of Section
24, Township 17 South, Range 11 East, W.M., Deschutes County,
Oregon, more particularly described as follows:
Beginning at the NE corner of Lot 4 of said Plat, being
a point on the Westerly right-of-way line of Stag Drive;
thence along said right-of-way line South 00 degrees 00
minutes 50 seconds West 1.98 feet to a point on a 123.34
foot radius curve to the right; thence along the arc of
said curve 92.01 feet, the chord of which bears South 21
degrees 23 minutes 06 seconds 89.89 feet; thence leaving
said right-of-way line North 42 degrees 45 minutes 21
seconds East 27.86 feet to a point on a 172.99 foot
radius curve to the left; thence along the arc of said
curve 76.02 feet, the chord of which bears North 30
degrees 09 minutes 59 seconds East 75.41 feet to a point
on the North line of said Lot 4; thence along said North
line North 89 degrees 55 minutes 31 seconds West 24.03
feet to the point of beginning.
Contains 0.02 Acres (924.32 SQ. FT.).
SUBJECT TO the reservation of a utilities easement in
and upon all of the property; for the purposes of
continuing, constructing, installing, maintaining,
repairing, reconstructing, replacing, enlarging and

parcel of land located in the South 1/2 of Section 22, Township 17 South,
Range 12 East W.M. located in Deschutes County be vacated.

ENGINEER'S REPORT FOR PUBLIC ROAD VACATION
DATE: JANUARY 18, 1990

FROM: DESCHUTES COUNTY ENGINEER
SUBJECT: ENGINEER'S REPORT RELATING TO THE VACATION OF A 30
FOOT PARCEL OF LAND LOCATED IN THE SOUTH 1/2 OF
SECTION 22, TOWNSHIP 17 SOUTH, RANGE 12 EAST W.M.,
DESCHUTES COUNTY, OREGON.
Property proposed for vacation is owned by the
public being dedicated in MP -80-76 and by
Declaration of Dedication recorded in Deed Volume
329, Page 955. This right of way has not been used
for access to the parcels in MP -80-76.
2. It is the Engineer's assessment that the proposed
vacation is in the public interest because: A new
right of way is being dedicated to replace this
parcel.
3. The following other pertinent facts were considered
in making this report: The new right of way shall be
dedicated along with an easement for utilities
before the vacation becomes final.
