Also present were Rick Isham, County Legal Counsel; Mike Maier, Director of Administrative Services; Darrell Davidson, Sheriff; and Dennis Maloney, Community Corrections Director. 1. CONSENT AGENDA Consent Agenda items before the Board were: #1, signature of Amendment #7 to the 1989-91 Intergovernmental Agreement with the State Mental Health Division; #2, appointments of Rodney Bartz, Richard Coote, Shelly Damm, Deri Frazee, Tanya Garibaldo, Jody Houston, Jill Olin, Chanda Trujillo, Michelle Wheeler, Cammie Williamson, Kikki Young, Jesse Russell, Kelly Louden to Youth Advisory Subcommittee of the Children & Youth Services Commission; #3, appointment of Lynette Patterson to Great Start Subcommittee of Children and Youth Services Commission; #4, signature of Indemnity Agreement with The Lobos for Off-road Motorcycle Race on February 17 & 18, 1990; #5, signature of Indemnity Agreement with Pro Canam Racing, Inc. for Off-road Race on March 9 & 10, 1990; and #6, reappointment of Blair Armitage to the Panoramic Access Special Road District Board of Directors. PUBLIC HEARING: COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS FOR EXPANSION OF THE LAPINE SEWER DISTRICT Mike Burton, Economic Development Specialist, COIC, P.O. Box 575, Redmond, testified that he had been approached by the County to provide some assistance in preparing a grant application to the Oregon Community Development Block Grant Program. HUD, the funding source, had mandated that a preliminary meeting or hearing be held to collect proposals from which the most important, highest priority project or projects would be selected. Today's public hearing was to satisfy that requrement. He said the Oregon Economic Development Department had approximately $12 million available statewide to eligible cities and counties for community PAGE 1 MINUTES: 2/14/90 r , too - 1583 development activities. Deschutes County was eligible to apply once each year for one Public Works, Housing, or Community Facility Grant not to exceed $500,000 and one Technical Assistance Grant for up to $10,000. He said the range of activities which could be considered for community development grants were to: increase business and employment opportunities; conserve the existing housing supply and improve housing conditions; improve the availability and adequacy of public facilities; and resolve situations which pose a serious and imminent threat to community heath and welfare. He said the County was holding this public hearing to establish a list of projects for consideration for application to the program. In preparing the final application, the County needed to consider any citizen's comments and views and could modify the proposed application. The final application would be considered at a second public hearing before approval. Chair Throop asked if there was anyone from the audience who wished to bring a proposal before the Board. Bill Tye, Tye Engineering, 25840 Alfalfa, Bend, representing the LaPine Special Sewer District brought forth a proposal for a technical assistance grant to research the expansion of the LaPine Special Sewer District. He said they were looking at annexing: (1) the area just east of the existing sewer system where a number of low-income homeowners requested connection to existing sewer system, (2) the County industrial park, and (3) the Wickiup Junction area where several small businesses and some low income homeowners requested connection to the sewer system. He said the technical assistance grant would be used to determine whether it would be economically feasible to connect these three areas to the existing sewer system. In the grant application, there were leverage funds which the district had agreed to put up for the technical assistance grant. Commissioner Maudlin asked how far it was from the existing sewer system to Wickiup Junction, and Mr. Tye said it was about one mile. There being no other proposals submitted for consideration, Chair Throop closed the public hearing. Commissioner Throop said there were a couple of choices: one being to anoint the LaPine Special Sewere District project as the County's designated project today, ask Mike Burton from COIC to prepare the technical assistance grant application, and thank him profusely for doing so, or it could be postponed until the following week. COIC COLLECTION ACCOUNT FOR BUSINESS REVOLVING LOAN FUND Commissioner Maudlin reported on his meeting with Helen Rastovich, County Treasurer and Rick Isham regarding their concerns over an agreement with COIL for the collection of payments of the Business Revolving Loan Fund. The procedure was worked out as follows: Since COIC would be handling the collections for all of the loans in the Business Revolving Loan Fund, the Board would ask that COIC notify all the businesses who had loans with the county that all payments were to be made out to Deschutes County but sent to the COIC office. COIC would then receipt the loan payments and forward the checks to Deschutes County. COIC would send a monthly report to Deschutes County to verify records of receipts with payments. Deschutes County would give COIC existing information regarding the date of the monthly payment, the amount balance due, etc. and payments to date. Commissioner Maudlin said he discussed the process with Dick Donaca, the County's auditor, who didn't see any problems with the process. It was hoped that this process would improve collections. Commissioner Maudlin said that COIC needed to make sure that the checks were sent directly from COIC to Helen Rastovich at the County. Mike Burton, COIC, said the procedure sounded workable to him. The Agreement with COIC would be available for the Board of Commissioners to sign later in the month. 4. FORMATION OF A CORRECTIONS BOARD OF CONTROL Before the Board was signature of a cooperative agreement regarding the formation of a Jail Facility Control Board for Deschutes County to be in effect on March 1, 1990. Darrell Davidson, Sheriff; Dennis Maloney, Corrections Director, and Dick Maudlin, Commissioner would be the members of the Corrections Board of Control which was formed similar to the current Board of Control in Marion County. Day-to-day operation of the secure control, residence, and surveillance programs would be handled by Gary Giersdorf and supervised by Darrell Davidson. The Control Board would meet weekly, and any areas of disagreement would be brought before the Deschutes County Board of Commissioners. Dennis Maloney would still be in charge of the adult parole and probation and the juvenile detention programs. PAGE 3 MINUTES: 2/14/90 1.00 v 1585 5. 6. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES ORDINANCES 90-009 AND 90-010 AMENDING COMPREHENSIVE PLAN AND ADOPTING ZONE CHANGE FOR RURAL SERVICE CENTER IN SPRING RIVER AREA Before the Board was signature of Ordinances 90-009 and 90- 010 amending the Comprehensive Plan and adopting a zone change for a Rural Service Center in the Spring River Area. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES AOC LAND USE ASSESSMENT Mike Maier said he had received the bill (approximately $1,300) for Deschutes County's contribution for the support of a contract planner who would work for the Association of Oregon Counties (AOC) and county planning directors. Commissioner Maudlin expressed concern work performed by this position would duplicate work already being done on for the Secondary Lands Study. Commissioner Throop said the intent was not to specialize in something like secondary lands. He said AOC did not have any staff expertise in land use. Rather than hiring a staff person, AOC felt it was best to contract one-half time with the Planning Director from Marion County to represent the 36 counties and to develop a better PAGE 4 MINUTES: 2/14/90 a oo 1586 partnership on land use issues with the Department of Land Conservation and Development, the Land Conservation and Development Commission, and the legislature. He said it would give the counties the ability to participate in the legislative and administrative land use details. Commissioner Prante asked how closely the AOC planner would be working with central/eastern Oregon. Commissioner Throop said this program occurred last biennium, and the AOC planner worked out of two offices--Mayon County and Crook County. The planner had the very strong support of all 36 counties, the land use committee, the board of directors, and the legislative committee, and he felt the AOC planner would adequately represent all 36 counties.
