WHEREAS, Deschutes County Department of Public Works petitioned the
Board of County Commissioners of Deschutes County, Oregon, to vacate a
portion of S.E. 9th Street (Formally Baer Road), located in the South
Half of the Southeast Quarter of Section 4, Township 18 South, Range 12
East W.M., located in Deschutes County, Oregon; and
WHEREAS, the Board of County Commissioners has determined it to be
in the public interest to consider such vacation; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That it is the intent of the Board of County
Commissioners of Deschutes County, Oregon, to vacate a portion of S.E.
9th Street described in Exhibit "A ", attached hereto and by this
reference incorporated herein, because it appears the road is no longer
needed for public use, and will not be needed in the future.
Section 2. That the County Engineer shall file an Engineer's
Report with the Board of Commissioners, describing the ownership and
uses of property to be vacated, and whether the vacation would be in the
public interest, within fourteen (14) days of the date of this
Resolution.

DESCRIPTION OF PARCEL TO BE VACATED
A parcel of land lying in the South half of the Southeast
Quarter of Section 4, Township 18 South, Range 12 East of the
Willamette Meridian, Deschutes County, Oregon being more
particularly described as follows:
Commencing at the Southeast corner of said Section 4; thence
North 89° 57' 05" West along the south line of said Section 4
1320.00 feet to the Southwest corner of the Southeast Quarter of
the Southeast Quarter of said Section 4; thence North 00° 06' 53"
West along the west line of the Southeast Quarter of the Southeast
Quarter of said Section 4 57.85 feet to the Point of Beginning;
thence South 89° 23' 38" East 32.73 feet along a line 45.00 feet
northerly of, and parallel to, the centerline of Reed Market Road;
thence, along the easterly right of way line of 9th Street, North
05° 03' 47" West 280.50 feet; thence continuing along said
easterly right of way line 17.05 feet along the arc of a 316.48
foot radius curve to the left, the chord of which bears North 06°
36' 24" West 17.05 feet; thence North 46° 59' 52" West 127.59
feet to a point on the westerly right of way line of 9th Street;
thence along said westerly right of way line 115.86 feet along the
arc of a 256.48 foot radius curve to the right, the chord of which
bears South 18° 00' 16" East 114.88 feet; thence continuing along
said westerly right of way line South 05° 03' 47" East 231.29 feet
to a point on the easterly right of way line of the Burlington
Northern Railroad; thence along said easterly right of way line
45.15 feet along the arc of a 2914.79 foot radius curve to the
right, the chord of which bears South 16° 56' 09" East 45.15 feet;
thence South 89° 23' 38" East 18.23 feet along a line 45.00 feet
northerly of and parallel to, the centerline of Reed Market Road
to the Point of Beginning.
