1990-06902-Minutes for Meeting March 07,1990 Recorded 3/15/199090-06902 10 0 - 1 7 3 7 MINUTES raw k DESCHUTES COUNTY BOARD OF COMMISSIONERS ACTING AS THE GOVERNING BODY FOR THE BLACK BUTTE RANCH SERVICE DISTRICT March 7, 1990 Chair Throop opened the meeting at 11:00 a.m. Board me~rs (.sin attendance were Dick Maudlin, Tom Throop and Lois Bristow Pdnti. Also present was Rick Isham, County Legal Counsel. 1. MEMORANDUM OF UNDERSTANDING AND AN AGREEMENT WITH BLACK BUTTE RANCH ASSOCIATION Rick Isham reported that the resolutions and agreements before the Board included everything that would finally register the new county service district with the Secretary of State. He said the Order forming the District had been filed with the Department of Revenue. Before the Board was signature of a Memorandum of Understanding delegating to the Black Butte Ranch Association Board the operation of the Black Butte Ranch Service District as the District's Agent. The Black Butte Ranch Association Board agreed to establish an independent Managing Board of no less than five members whose appointments would be made by the Deschutes County Board of Commissioners acting as the Governing Board for the Black Butte Ranch Service District. Also before the Board was an Agreement with the Black Butte Ranch Association Board regarding the structure of the Service District Managing Board. Rick Isham said that these documents authorized the Black Butte Ranch Service District to operate in the same formate that was adopted for the 911 County Service District. The Managing Board would take care of all the details, and the Board of County Commissioners would take care of the legislative issues such as adopting resolutions and taking the legislative action necessary for the district to operate. Rich Isham said the tax base measure set forth the amount of the tax base which was expected to last over a five-year period, and would be levied only within the Black Butte Ranch boundaries. Unlike the 911 Service District, the Black Butte Ranch Managing Board would direct their own accounts and would not be accounted for in the County budget. When taxes were collected, they would be turned over to the service district. The Black Butte Ranch Service District would be audited through the County audit process which would be paid for out of service district funds. PAGE 1 MINUTES: 3/7/90 rte 'i.uu - 1738 2. 3. Rich Isham informed the Board that they needed to appoint an ex-officio member from the County to attend the meetings of the managing board (3 p.m. on the third Friday of the month). Commissioner Throop suggested appointing Mike Maier, County Administrator, to the position. The Board decided to discuss it with Mike Maier before making an appointment. RESOLUTION 90-021 DESIGNATING BLACK BUTTE RANCH SERVICE DISTRICT'S REGISTERED AGENT AND REGISTERED OFFICE Before the Board was signature of Resolution 90-021 designating Becky Lu Brown as Black Butte Ranch Service District's Registered Agent; and Administration Building, P.O. Box 8000, Highway 20 West, Black Butte Ranch, Oregon 97759, as the registered office of the District. VOTE: PRANTE: YES THROOP: YES MAUDLIN: YES RESOLUTION 90-020 CALLING FOR A DISTRICT TAX BASE ELECTION AND PROVIDING A BALLOT TITLE Before the Board was signature of Resolution 90-020 providing for the calling of a district tax base election in Black Butte Ranch Service District on May 15, 1990, for the purpose of submitting to the qualified voters of the district the question of establishing a tax base for the purpose of applying the limitation on taxation set forth in Article XI, Section 11, Oregon Constitution, and providing a ballot title. PRANTE: I move to appoint John Schmidt, Position 1, Expires 6-30-93; Richard Rix, Position 2, Expires 6-30-91; Ed Denniston, Position 3, Expires 6-30-92; Charlie Coe, Position 4, Expires 6-30-92; and Pat Fordney, Position 5, Expires 6-30-93.
