WHEREAS, the Deschutes County Engineer has presented the Board of
County Commissioners of Deschutes County, Oregon, an Engineer's Report
on the proposed vacation of a portion of a fifty foot (501) public road
easement located near Rocking Horse Road on Lot 105 of River Bend
Estates, located in Deschutes County, Oregon, recommending vacation of
said road; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That the Engineer's Report relating to the vacation of
a certain dedicated public road easement known as a portion of a fifty
foot (501) public road easement located near Rocking Horse Road on Lot
105 of River Bend Estates be accepted and hereby approved.
Section 2. That on Wednesday, July 18, 1990, at 10:00 a.m. at the
Deschutes County Courthouse Administrative Building, Bend, Oregon
97701, the Board will hold a hearing to determine whether the
above-described public property, described in Exhibit "A", attached
hereto and by this reference incorporated herein, should be vacated.
Section 3. Notice of said hearing shall be posted in no less than
three (3) places, including the property proposed to be vacated, or
property within the vicinity of the property proposed to be vacated.
This notice shall be posted at least 20 days prior to the hearing.
Said notices must be visible from traveled public roads.
Section 4. Property owners of record abutting the property
proposed to be vacated shall be notified by Certified Mail, return
receipt requested, at least 30 days prior to said hearing.
Section 5. All public utilities and municipalities affected by the
proposed vacation shall be notified by Certified Mail, return receipt
requested, at least 30 days prior to said hearing.
Section 6. Notice of the hearing, in substantially the form marked
Exhibit "B", attached hereto and by this reference incorporated herein,
of such hearing shall be published at least twenty (20) days before,
and within ten (10) days of the date of said hearing.

A portion of a fifty (50) foot roadway right of way being
twenty five (25) feet on either side of the centerline
described as follows:
Commencing at a point on the north line of the River Bend
Estates subdivision whence the northeast corner of Section
19, Township 18 South, Range 12 East W.M. bears North 420
29, 24" East 1351.72 feet; thence South 221 021 02" West
59.35 feet; thence South 261 481 45" West 315.00 feet to the
True Point of Beginning; thence South 541 541 17" West
577.62 feet; thence South 211 53, 35" West 697.29 feet;
thence South 541 551 07" West 212.0 feet more or less to the
westerly property line of Lot 105 River Bend Estates and
there terminating. I

COURTHOUSE ADMINISTRATIVE BUILDING, BEND, OREGON, ON THE PROPOSED ROAD
VACATION PROCEEDING DESCRIBED BELOW. ALL INTERESTED PERSONS MAY APPEAR AND
BE HEARD.

REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST PROMPTLY BE FORWARDED TO

a fifty foot (501) public road easement located near Rocking Horse Road on
Lot 105 of River Bend Estates located in Deschutes County be vacated.

ORS 368.326 to 368.366 provides authority for road vacation.

SUBJECT: ENGINEER'S REPORT RELATING TO THE VACATION OF A
PORTION OF A FIFTY FOOT (501) PUBLIC ROAD EASEMENT
LOCATED NEAR ROCKING HORSE ROAD ON LOT 105 OF RIVER
BEND ESTATES, DESCHUTES COUNTY, OREGON.
Property proposed for vacation is owned by the
public and is used for the following: Was used for
access prior to the platting of River Bend Estates.
2. It is the Engineer's assessment that the proposed
vacation is in the public interest because: The
petitioner is providing a sixty foot (601) road
easement on the westerly boundary of their lot to
provide access to remaining.easement.
3. The following other pertinent facts were considered
in making this report: None of the utility companies
reported any facilities within the right of way.
