Chair 'lhroop of the meeting at 10 a.m. Board members in attendance
were Dick Maudlin, Tom Throop and Lois Bristow Prante. Also
present was Rick Isham, County Legal Counsel; Larry Rice, Public
Works Director; Lynn Premselaar, Health Director; Kevin Harrison,
Planner; and Brad Chalfant, Property Manager.
ORDER 90-095 TRANSFERRING 1,600 ACRE RESERVE INDUSTRIAL SITE TO
THE CITY OF BEND
Before the Board was discussion and decision on whether to transfer
a 1,600 acre industrial reserve site to the City of Bend. The
Board had held a public hearing on the issue on August 1, 1990.
Commissioner Prante said she felt in order to make wise use of the
property, an in-depth study needed to be made.
Commissioner Maudlin said a number of people who testified at the
public hearing said there needed to be a plan before a transfer was
made. However, the City would be doing the plan, not the County.
So until the transfer was made,- the plan could not be done. The
land would still be under the zoning control of the County even if
the land were transferred. He said without a plan and a public
process, the land would just remain in its current state. The land
had always been intended for industrial reserve, and he felt it
must be transferred to the City to get that program going.
MAUDLIN: I would move that we transfer the 1,600 acres to the City
of Bend.
PRANTE: Second for more discussion.
PRANTE: Commissioner Prante asked for a friendly amendment to
Commissioner Maudlin's motion to include language that
as a condition for the transfer, the City proceed with
the study.
MAUDLIN: Commissioner Maudlin agreed to the friendly amendment.
Commissioner Throop said the history of the parcel was to reserve
it until the City was ready to go through a master planning process
which it was now prepared to do. He felt that to interrupt that
understanding, process, and what was envisioned in the
Comprehensive Land Use Plan would not be appropriate.

THROOP: Commissioner Throop asked that a couple of conditions be
added to the motion to transfer. (1) The first was the
same as Commissioner Prante's suggestion that there be
a master plan required for the parcel, and that as a part
of that master plan, there be an open and public process
with citizen participation and public involvement.
(2) The second condition would be that 10% of the parcel
be dedicated to park purposes (parks and buffers) and be
managed by whatever the park authority would be in
perpetuity into the future for the Bend urban area. He
said he had spoken with Larry Patterson, Bend City
Manager, who had no objection to this condition.
Commissioner Prante said she had no problem with this amendment as
it would only clarify "on the record" what she felt was already
intended by the City.
Commissioner Maudlin felt that having 10% of the land designated
to parks as a condition of the transfer would make the planning
process more complicated. He asked if the 10 acres would be in one
piece or four pieces? He didn't want to make any "hard and fast"
rules since the planning process was a working process with the
public, and these decisions should be done during that process.
He said the language in the motion could cause arguments between
the City of Bend and Bend Metro Park and Recreation about where
this 10% would be, and this would stall the whole process. He said
he had no objection to there being parks but felt it should be
decided as a part of the process.
Commissioner Throop said he did want a "hard and fast" condition
that a minimum of 10% of the parcel be dedicated to park purposes.
The City would own the land, the master plan process would
determine which 10% of the land would be most appropriate for park
development and buffers.
THROOP: I'll move to amend the motion that a minimum of 10% of
the parcel be allocated for park purposes, and it could
be buffer, to be managed by the entity that is
responsible for park and recreation programs for the Bend
area.
PRANTE: I'll second the motion to amend.
Commissioner Maudlin asked if the County would be giving 10% of the
1,600 parcel to Bend Metro Parks and Recreation? Commissioner
Throop clarified that the County would be requiring that as a
condition on the transfer of the property, the City would provide
10% of the land area for park purposes to the authority responsible
for parks when decisions were made on how the land would be used.
