RESOLUTION NO. 90 -089
WHEREAS, ORS 271.330 provides that Deschutes County may --
transfer surplus real property to another governmental body by
proper resolution and hearing; and
WHEREAS, the Bend Metro Park and Recreation District has
requested that the County transfer to it the County's interest in
certain surplus real property without consideration; and
WHEREAS, the Board of County Commissioners finds that the
Bend Metro Park and Recreation District, a governmental body in
the State of Oregon, will use said property for a public purpose;
and
WHEREAS, ORS 271.330 provides that said transfer shall only
be made upon notice and after hearing; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That Deschutes County intends to transfer real
property described as:
A tract of land lying in the north half of Section 6,
Township 18 South, Range 12 East of the Willamette
Meridian, Deschutes County, Oregon, and described as
follows:
Commencing at the southeast corner of the northwest
quarter of said Section 6; thence North 89° 48' 24"
West 274.21 feet along the southerly line of said
northwest quarter to the point of beginning; thence
continuing along said line North 89° 48' 24" West
1051.42 feet to the southwest corner of the southeast
quarter of said northwest quarter; thence North 06° 03'
46" East 348.35 feet to a point; thence North 78° 37'
50" East 511.32 feet to a point; thence North 20° 36'
06" East 111.18 feet to a point; thence North 39° 05'
16" East 60.00 feet to a point; thence South 50° 54'
44" East 401.11 feet to a point on a 289.23 foot tan-
gent curve to the right; thence along the arc of said

curve 220.27 feet, the chord of which bears South 29°
05' 42" East 214.98 feet to a point of tangency; thence
South 07° 16' 40" East 161.94 feet to the south line of
said south half of the northwest quarter and being the
point of beginning, containing 9.8 acres more or less;
and subject to the following access and utility ease-
ment:
By both grant and reservation, a perpetual, non- exclu-
sive easement for access and utilities across a strip
of land sixty (60) feet in width, being thirty (30)
feet on each side of the following described center
line, located in the north half of Section 6, Township
18 South, Range 12 East of the Willamette Meridian,
Deschutes County, Oregon, and described as follows:
Commencing at the southeast corner of the northwest
quarter of said Section 6; thence North 89° 48' 24"
West 304.47 feet along the southerly line of said
northwest quarter to the point of beginning; thence
North 07° 16' 40" West 158.00 feet to a point on a
259.23 foot tangent curve to the left; thence along the
arc of said curve 197.42 feet, the chord of which bears
North 29° 05' 42" West 192.68 feet to a point of tan-
gency; thence North 50° 54' 44" West 401.11 feet to a
point on a 236.52 foot tangent curve to the right;
thence along the arc of said curve 188.03 feet, the
chord of which bears North 28° 08' 15" West 183.12 feet
to a point of tangency; thence North 05° 21' 46" West
346.76 feet to a point on a 1313.24 foot nontangent
curve to the left, being the southerly right -of -way
line of Simpson Avenue and there terminating, contain-
ing 1.8 acres more or less.
Section 2. A hearing for the purpose of receiving objec-
tions to the above transfer will be held on Wednesday,
October 10, 1990, at the Deschutes County Juvenile Justice
Building, 1128 N. W. Harriman, Bend, Oregon, at 10:00 a.m.
Section 3. That the Clerk of the County Court shall give
notice of the time and place for the hearing set in Section 2 of
this Resolution by publication of the notice Marked Exhibit "A,"
attached hereto and by this reference incorporated herein, in
"The Bulletin" once each week for two consecutive weeks prior to
the date of such hearing.

On Wednesday, October 10, 1990, at 10:00 a.m. in the Juven-
ile Justice Building, 1128 N. W. Harriman, Bend, Oregon, the
Board of County Commissioners of Deschutes County, Oregon, will
hold a hearing on a land transfer between Deschutes County,
Oregon, and Bend Metro Park and Recreation District, a govern-
mental body in the State of Oregon. The land to be transferred
